The only issues related to choice are the same ones that we signed into law
last year or in previous years (e.g., restrictions on embryo research,
restrictions on coverage of abortions except in cases of rape or incest in the
Labor/HHS (medicaid), Treasury/Postal (FEHB), and CJS (Federal prisoners)
bills, and population planning funding restrictions (Foreign Ops bill). As you
know, the President has already signed the D.C. bill and the DOD authorization
bill, both of which contained restrictions on abortion. We are continuing to
raise the remaining issues as problematic to the Administration--and it appears
from what we have seen from the Labor/HHS conferees that we have secured the
deletion of the Porter family planning amendment (the provision requiring
people to meet certain income standards before getting assistance that could
have caused problems for teens who did not want to bring their parents into it,
because their parents income would be counted--but if I had to guess, I would
say the other bills will not change and the President will probably sign them
because we have signed these provisions in the past. The only exception to
this impression is with respect to the Foreign Ops bill, where I believe we
will succeed in getting more acceptable population planning funding language.

I need to give the VP a couple brief examples of Republican efforts to cut
family planning. This is what I have, and I know it's out of date. Can you
quickly update it and e-mail back to me? Thanks.
As part of the Labor/HHS Appropriations bill, the House Appropriations
Committee voted to
eliminate Title X funding and put the money into Maternal and Child Health
and other block grants
to states. Moderate Republicans joined with House Democrats to remove this
provision on the
House floor.
A ban of all federal funding for overseas family planning non-governmental
and multinational
organizations that perform abortions and/or attempt to influence
governmental policy on abortion
(similar to "Mexico City policy" overturned by President Clinton) passed
the House as part of the
Foreign Operations Authorization bill. Senator Helms failed to get cloture
on the Senate version
of the Authorization bill, which barred funding for the United Nations Fund
for Population Activities.

Talking About Falling Abortion Rates

Since 1992, there has been a consistent drop in abortion rates.
AGI preliminary data shows a 1.8% drop from 1992 to 1993 and a
4.4% drop from 1993
-1994, for a total 6.2% drop from 1992. (The
abortion rate has been falling steadily since 1981, so we cannot
and should not claim that Clinton Administration policies are
responsible for the falling abortion rate.)
However, we are the first Administration since 1981 to advocate
family planning policies and contraception, and the first to
devise a comprehensive approach to teen pregnancy prevention.
While we can't claim these policies are responsible for falling
abortion rates, we can say we've reduced unintended pregnancies
through increasing family planning dollars, and working to reduce
teen pregnancy.
Administration's Efforts To Increase Family Planning
The ten percent of women of childbearing age who use no
contraception account for more than half of the unintended
pregnancies in this country. Most of the remaining unintended
pregnancies are caused by inconsistent or incorrect use of
contraceptives. To help prevent unwanted pregnancies, the
President has requested budget increases for the federal Family
Planning Program for each year he has been in office. Among
other reproductive health and education services, this program
makes family planning information and contraception available to
millions of women who might not otherwise get reproductive health
care.
Administration's Teen Pregnancy Prevention Efforts
Each year, almost I million American teenagers become pregnant --
approximately 11% of all women ages 15
-19. Among teenagers, 85%
of pregnancies are unintended. Of the 1.5 million abortions
obtained by U.S. women in 1991, 327,000 were obtained by
teenagers.
To address this serious problem, the Clinton Administration has
pursued policies which recognize the fundamental obligation of
all Americans to exercise personal responsibility, while
expanding opportunities for at
-risk young people to make positive
life choices.
The country is seeing results: The teen birth rate has dropped
four years in a row by a total of 8 percent. Further, the birth
rate for unmarried women dropped 4 percent the first decline
in nearly two decades.
?Private
-Sector Initiative: President Clinton challenged leaders
across the nation to come together to address the serious problem
of teen pregnancy. In response, an independent, bipartisan
organization was formed. The National Campaign to Prevent Teen
Pregnancy was established as a private, not
-for
-profit entity
under the direction of Thomas Kean, former Governor of New Jersey
and now President of Drew University.
?Welfare Reform: From day one of this Administration, we have
pursued policies to reform welfare. Of the Administration's many
initiatives, the President took executive action in May 1996 to
require teenage mothers to stay in school and sign personal
responsibility contracts or lose their welfare benefits. In
August 1996, President Clinton signed the welfare reform bill
which includes proposals that promote work, reduce teen
pregnancy, improve opportunities for youth, and strengthen
families. In particular, the new welfare law requires the
Secretary of Health and Human Services to set national goals to
reduce teen pregnancy January 1, 1996;
?Appointed Senior Advisor on Teen Pregnancy Prevention: In
January 1996, President Clinton appointed Dr. Henry Foster
(Professor of Obstetrics and Gynecology at Meharry Medical
College and founder of the "I Have A Future" teen pregnancy
prevention program in Nashville) to serve as Senior Advisor to
the President on teen pregnancy and related youth issues. Dr.
Foster works with community
-based organizations across the
country to give young people the tools they need to build
responsible and productive lives.
What Republicans Will Say
Jack Kemp will likely argue that the falling abortion rate is due
to Republican's policy of abstinence. We can argue that is not
true.
-
-Sexual activity is still very high, but more people are using
contraception and are using it better. Teen birth rates have
fallen for the fourth year in a row for a total 8% drop, while
teen abortion rates have not gone up. Also, for the first time
in almost 20 years, the birth rate for unmarried women fell.
-
-Republicans have consistently tried to eliminate family
planning programs both in our country and abroad. Among many
attempts, Republicans have tried to eliminate Title X funding and
put the money into Maternal and Child Health and other block
grants to states.

*Note of explanation for the two sets of data: One is from CDC
and the other is from the Alan Guttmacher Institute. The Alan
Guttmacher Institute (AGI) numbers are higher than the CDC
numbers by approximately 12
-15%. This is because they adjust the
CDC numbers to include abortions reported by small providers,
which are not included in the CDC calculations. The AGI numbers
are well
-respected and generally accepted as more accurate. Note
that though the numbers may be higher, the rates of decline they
show are the same as the CDC. (Again, because AGI numbers are
based on the CDC numbers.)
Currently official abortion data are available for 1993 according
to CDC calculations, and for 1992 for AGI calculations (AGI's
Deputy Director of Research, Stanley Henshaw, provided AGI's 1993
and 1994 preliminary data and says it should change little.)

On domestic family planning, your bullet is essentially correct: During the FY
1996 budget process, the House Appropriations Committee zeroed out Title X
family planning programs and transferred that funding to the Maternal and Child
Health block grant. The funding was restored on the House floor.
With respect to international family planning efforts, there are two areas of
focus. First, in the 1995 Foreign Operations Authrorization bill, which the
President eventually vetoed, the congress tried to reinstitute the so-called
"Mexico City" policy that had been followed by the Bush Administration.
President Clinton signed an executive order on his first day in office that
changed this policy, which had banned the receipt of Federal funds by
international family planning agencies that performed abortions or attempt to
influence governmental policy on abortion, even if they use their own funds
from another source for those activities. Second, over the past two years, the
Congress has tried in the appropriations process to reinstitute "Mexico City."
While they have not succeeded in that effort, they have added other
restrictions that have effectively reduced funding for international family
planning efforts from more than $500 million in FY 1995 down to around $150
million in the fiscal year that just ended, FY 1996. The Administration was
successful in getting much of that funding restored for the newly-started
fiscal year, FY 1997.

As promised, here's a brief update on issues/projects etc.:
WELFARE REFORM
Main issues under discussion:
USDA has to get out guidance this week on how states are to
determine whether immigrants have the 40 quarters of work they
need to continue eligibility for food stamps. Drafting proceeding
well; hope to have it out by Friday.
USDA also has drafted guidance on waivers for states to apply for
on the high employment definition for 18-50 year olds. This is
the area the President asked about on your WR memo. Diana, OMB,
Elena and I are reviewing. Again we hope to have this out soon as
well.
SSI Kids - Diana has been keeping you posted, I believe. Meeting
on the Hill, advocates position, Ken position, etc.
Medicaid - difficult issues here re waivers and a "bucket" for
people losing SSI so they can still qualify for Medicaid.
Meetings have happened to discuss - work in ongoing.
Means Tested Benefits - Based on your, Jack and Frank's feedback,
as well as the POTUS note, we are moving forward with the
entitlement approach. HHS will be sending a memo to DOJ
shortly.
Web Page - the web page should be up and running by next week.
Jeanine has done a terrific job pulling this together and I am
excited by the progress.
OTHER ISSUES
Partnerships:
- we are moving forward with planning for the Conference on Dec 3
and 4. Save the Date notices have gone out.
- the National Indicators are about to be finalized by the
statistics folks with the goal of a memo to the President by the
beginning of December.
- the Partnerships web page is also nearly done, and I hope can be
unveiled at the Conference.
- I am working closely with Kumiki, Elaine, and others (OMB, NEC)
on a proposal for reworking the CEB - to dramatically upgrade its
staff and support and to provide a true field presence of
Community "Barrier Busters" who would help communities develop and
fulfill strategic plans for their communities. I would love to
update you more about this in person. The goal is a memo to the
VP just after the election.
Zero Tolerance/Driving/Drugs
- Working with Dennis, Bruce, DOT, ONDCP, Counsel on three
announcements: (1) the letter to the FCC on liquor advertising
(just hard liquor is the call); (2) annoucement of zero tolerance
regs on minor drinking and driving; and (3) Pres memo to DOT
asking them to look at drug testing minors for drivers licenses.
Family Planning
- Martha Foley asked us to pull together a group to work on the
issue of Family Planning money for int'l NGOs. This is one of the
most consistently sticky issues in the appropriations process each
year as you know and this year there is a requirement for a
Presidential certification on the topic in February. It seems to
make most sense for DPC to take the lead, so Lyn and I held one
meeting last week internal to the WH and will be having an
interagency chit-chat next week.
Welfare to work internships
- Bruce's idea; can't remember if we have discussed - we are
trying to set up a WH welfare to work internship program so a few
people from wtw programs nearby can fulfill their work
requirements by working at the WH. Dorothy is working on this
with the intern office and with Counsel's office. Looks
promising.
1-800 Number
- Have met with Goodwill and with United Way as well as NGA and
our business liaison staff. Lyn has been helpful on this as well.
Probable next step is that NGA has to produce list of 50 contacts
that businesses can call in each state. Best way to do it appears
to be at state level rather than national.

Linda Brown checked on the Arkansas family planning waiver and makes the
following status report:
As you may recall, HCFA approved Arkansas's waiver on June 18, 1996.
The state did not respond to HCFA's award letter because it was dissatisfied
with the budget neutrality term and condition.
Discussions were re-opened on this waiver and HCFA has been working with the
state to revise the terms and conditions. HCFA expects to send revised terms
and conditions to the state by the end of this week (Nov. 1).
The state will then review them and let HCFA know if they are acceptable.

Do you know what happened to the $30 million for The Teen Pregnancy
Prevention program HHS tried to get last cycle? My understanding is Jeremy

covered in this budget? If not, any chance of getting it in?
2) Can we get an exact $$ figure for teen preg prevention funds in this

Background/Status:
According to the Health Budget Briefing, Lyn attended on Tuesday,
November 19th, OMB plans to zero out the Healthy Start program
for FY '98 and move those funds to other related programs.
Specifically, $50 million of the $96 enacted for Healthy Start
will likely be transferred to the Maternal and Child Health Block
Grant. It is not clear yet where the other dollars would
transfer.
As mentioned in Lyn's first e
-mail, the OMB rationale to cut this
program was that Healthy Start was a Bush demonstration program
that is popular but hasn't really produced results. HHS
attempted to zero it out once before, but was not successful.
States like the block grant better, so it makes sense to put the
money there.
Response Points
?
It is true that they do not have consistent data across
project, but this is because each project is community
specific and chose their own benchmarks given the priorities
in the communities they serve. This aspect of the program
should not be a penalty.
?
States do like block grants because of the flexibility they
provide, however I'm not so sure that rational works here.
Healthy Start programs have traditionally been flexible and
their Maternal and Child Health Bureau link has helped their
respective states make the most of their MCHB block grants.
?
Healthy Start supports and encourages community
collaboration.
?
MCHB has forwarded some highlights from the original 15
sites they include:
?
All projects are reporting a drop in infant mortality
rates(IMR);
?
NYC between 1990
-1994, the IMRs decreased by 38% in the
project area compared to a 22% decline city
-wide;
?
In FY 90, only 14% of women in the Northern Plains area
received family planning services, currently 78% of the
women who delivered received postpartum family planning
services; and
?
The proportion of pregnant and parenting women in the
Project Area who fail to keep or make prenatal and/or
pediatric appointments due to the lack of child care
and/or transportation decreased from 30% in 1990 to 9%
in 1994 in Boston.
Possible Next Steps
1) Convene larger discussion with appropriate HHS stakeholders,
including contracted evaluators of the program.
2) Reduce number of sites, instead of whole program.
3) Outline the added value of giving states @ $1 million more
toward their block grant vs. targeting those dollars to areas
with high rates of infant mortality.

I met Friday afternoon with Liz Maguire and other AID pop and health people to
talk about the paper as well as pipeline and expenditure estimates.
On the paper, we agreed that AID is going to put in a range of estimates of the
total cost (in terms of unwanted births and abortions) of the July start date.
The boundaries of the range are determined by using a couple of different
methodologies (one of which was prepared by a university grantee). The
advantage to this is that it does not sound spuriously accurate, as the current
draft does, and it makes the point that, whatever methodology we use and
whatever end of the range we're at, the result is still a large number of
unwanted pregnancies and abortions. This makes it more difficult for critics
to try and invalidate the conclusion by criticizing the methodology. AID also
agreed to include more specifics on their best country-specific examples, which
they think that they can get from missions in time to make the Dec. 3 deadline,
and to beef up other aspects of the paper, such as the inability of other
donors to pick up the slack.
Finally, AID is working on a number of charts that will show different
scenarios for obligations, expenditures and resulting pipeline. They think
that what these charts will show is that, while a March start date will result
in a large increase in obligations for FY 97, expenditures will increase much
more gradually (or may simply decrease less rapidly). I think that this is the
point that Gingrich was interested in (i.e. that the March start date would not
lead to large short-term increases in expenditures).
I'm meeting with AID again tomorrow to see where things stand, particularly on
the obligation and expenditure estimates, and will let you know how it looks.
So far, AID's been extremely cooperative and hard-working on this, so I expect
that the final result will be a pretty strong paper.

FYI,
I've been working with HHS and DOJ and the following three reports due early
January to the President as well as the International Family Planning Report due
in Feb.
1) Statutory Rape Report, due from DOJ Jan. 1
I've seen a draft and passed my comments on to Bruce including event ideas, and
will forward those comments to you in a separate e-mail.
2) Teen Pregnancy Prevention Program/National Goals, due from HHS Jan. 1
HHS progress on this has been slow. They have not been able to share anything
in writing with us to date, though I received a phone briefing yesterday. The
bottom line is that the strategy builds on the HHS document laid out last
September. Overall message will be: abstinence, a focus on young adolescents,
and developing a targeted, parallel strategy for boys. I will send around
highlights of that phone briefing in a separate e-mail, with ideas for events.
3)
Domestic Violence Directive Progress Report, due to the President Jan. 3
HHS has prepared a progress report, as required in the October Directive, but it
is not for public release. In fact, HHS has a lot of ideas for action, but has
made little concrete progress on meeting the requests in the directive, namely
offering states guidance and technical assistance. I am working with HHS to
come up with something concrete they can announce on Jan. 3 to show progress.
Women's groups and state folks are expecting something from them on Jan. 3.
4)
Early January will be the one year anniversary of the privately run
National Campaign to Prevent Teen Pregnancy launched as a result of the
President's challenge. We should begin thinking about a possible event to
showcase their progress. They now have a distinguished group of House and
Senate members on their Congressional Advisory Panel, and the Campaign is fully
operational.

President's Report to Congress on Funding Restrictions on Voluntary
Family Planning due to Congress by Feb. 1
I have been working with Martha Foley, State and USAID on this. It is in great
shape and we should have a final draft around Jan. 10 to distribute to senior
White House staff. The report will precipitate a vote on the Hill regarding
family planning.

FYI, HCFA will shortly approve a Medicaid waiver request from
SCarolina that has been pending for a very long time: a waiver
that would offer only family planning services to women who are
not poor enough to qualify for Medicaid generally. We approved
similar waivers for 1 or 2 states in the past. It took a long
time to work out all the details, but supposedly now everyone is
happy.

I have scheduled a meeting for Monday, Jan. 13 from 2:00 p.m.-
3:15 p.m. in room 211 OEOB to discuss the international family
planning report due from the President to Congress Feb. 1, 1997.
We will review the final draft of the report and discuss strategy
for the draft report distribution.
A copy of the final draft report from AID and State will be
distributed for your review prior to the meeting. Please bring

Martha Foley asked me to put together a message meeting to discuss releasing the
President's report on international family planning. The meeting is scheduled
for Thursday, Jan. 16 from 2:30-3:30 in room 211 OEOB.
The President is due to submit his report to Congress no later than Feb. 1 and a
vote on the report is likely to occur shortly thereafter. The report and the
vote are expected to be controversial. In addition, the VP is scheduled to
speak to NARAL on Jan. 22 (the Roe V. Wade and Mexico City policy anniversary)
and he will likely have to field questions about the report and the upcoming
vote, so we need to be clear on message as soon as possible.
We need to discuss the following questions:

Actual report release date (we have discussed Jan. 30)
2)
Message
3)
Release strategy (remarks, press release or what?)
A draft of the report will be distributed to you this evening.
State and USAID are making final edits to the report and are clearing it through
Secretary designate Albright and others. The final report will be available
Tuesday, Jan. 21.

Options Memo
Following is an options memo on transmittal strategies for the
President's report on international family planning. By February
1, the President must submit a finding on the effects of cuts and
delays in disbursement of international family planning funds
included in the 1997 Foreign Ops Appropriations Act.
The President's report will detail the negative consequences of
cuts and metering on international family planning programs.
Following the transmittal of the President's report, Congress
will vote up or down on the finding by adopting a joint
resolution no later than Feb. 28, 1997. A positive
Congressional vote would release FY '97 funds in March rather
than in July. Funds are needed in order to prevent the erosion
of the international family planning infrastructure. (These
funds are not new money. The funds are already appropriated, but
have been held back through statutory language placed in the '97
Foreign Ops appropriations bill by Republicans.)
There are several upcoming events and positions to consider as
you craft the transmittal strategy.

During the Inauguration weekend and through Jan. 22, right
to life groups will hold anti
-family planning/anti
-abortion
rallys.
?
Jan. 22 is the anniversary of both Roe V. Wade and President
Clinton's overturn of the Mexico City Policy.
?
On Jan. 22, the Vice President will give a C
-Span broadcast
speech to NARAL, during which he will certainly be
questioned about the President's report.
?
On Wednesday, January 29, the Rockefeller Foundation will be
releasing a general pro
-family planning report.
?
As soon as the President's report is transmitted, Rep. Chris
Smith (R
-NJ), will charge that international family planning
programs use federal funds to provide or promote abortion.
These accusations are false. Using federal funds to provide
or promote abortion is illegal.
?
Once the President's report is transmitted, women's groups
will send a strong message that family planning prevents
abortion and that cutting family planning funds will
increase abortion.
?
This is the first reproductive health vote in the new
Congress and will be one of the only votes on family
planning services.
