other measures relating to or prohibiting the sale, distribution, possession,

exposure to, or use of tobacco products by persons of any age that are in addition
3
to the provisions of this Act and the amendments made by this Act, No 10 provision
4
of this Act or amendment made by this Act shall limit or otherwise affe any
5
State or local taxation of tobacco products. Section 521.of the Federal Food,
6
Drug, and Cosmetic Act (21 U.S.C. 360k) and the amendments made by section
7
412 of the Food and Drug Modernization Act of 1997 (Public Law 105-115) shall
8
not apply to any law, rule, regulation or other measure enacted, adopted,
9
promulgated or enforced by a State or its political subdivisions or the
10
government of an Indian tribe with respect to tobacco products.

SEC. 6. DEFINITIONS.

As used in this Act the term —

(1) "Cigarette" means any product which contains nicotine, is intended to
14
be burned under ordinan/conditions of use, and consists of -
15
(A) any roll of tobacco wrapped in paper or in any substance not
16
containing tobacco; or

(B) any roll of tobacco wrapped in any substance containing
18
tobacco which, because of its appearance, the type of tobacco used
19
in the filler, or its packaging and labeling, is likely to be offered to, or
