FDA Authority Is Fundamental Part of Any Comprehensive
Tobacco Control Legislation
At least two Senate committees - Labor and Commerce - will begin mark-ups on
tobacco control legislation before the April recess.
It is imperative that full FDA authority be a central part of any tobacco control
legislation.
ENACT has stated clearly and unequivocally that we will not support any legislation
limiting or preventing full FDA authority.
The benefits of FDA oversight of tobacco products include:
It will force the tobacco companies to tell the truth about what is in their
products.
It will provide a coordinated, comprehensive approach to reduce tobacco use
among children.
It will encourage and assist adults to quit.
It will reduce the harm to the American public caused by products that remain
on the market.
The public health community is united in the conclusion that tobacco control
legislation must:
Reaffirm the authority of the FDA to treat Nicotine as a drug, and tobacco
products as drug delivery devices.
Not abridge the FDA's authority to be the primary federal agency to reduce
the ease with which children obtain tobacco products.
Retain the FDA's authority to restrict tobacco advertising that affects children.
Not impose substantive burdens for product performance standards that
exceed the requirements imposed on performance standards for other
products.
Not require congressional approval of FDA's actions for tobacco products.
