SEC. 2. FINDINGS.

The Congress finds that -

(1) The Food and Drug Administration and other public health
5
authorities consider the use of tobacco products by the Nation's children to
6
be a pediatric disease of epic and worsening proportions that results in new
7
generations of tobacco-dependent children and adults.

(2) A consensus exists within the scientific and medical communities
9
that tobacco products are inherently dangerous and cause cancer, heart
10
disease and other serious adverse health effects.
11
(3) The Food and Drug Administration and other health authorities
12
have concluded that virtually all new users of tobacco products are under
13
legal age.

(4) The President, the Food and Drug Administration, the Federal
15
Trade Commission, state attorneys general, and public health authorities
16
recognize that tobacco advertising and marketing contribute significantly to
17
the use of nicotine-containing tobacco products by adolescents.
18
(5) Because past efforts to restrict advertising and marketing of
19
tobacco products have failed to curb tobacco use by adolescents, new,
