The 5 Secretary may order such person to provide compen- 6 satory damages to the complainant. If an order is is- 7 sued under this subparagraph, the Secretary, at the 8 request of the complainant, shall assess the person 9 against whom the order is issued a sum equal to the 10 aggregate amount of all costs and expenses (includ- 11 ing attorneys' and expert witness fees) reasonably 12 incurred (as determined by the Secretary), by the 13 complainant for, or in connection with, the bringing 14 of the complaint upon which the order is issued. 15 (3)(A) The Secretary shall dismiss a complaint 16 filed under paragraph (1) of this subsection, and 17 shall not conduct the investigation required under 18 paragraph (2) of this subsection, unless the com- 19 plainant has made a prima facie showing that any 20 behavior described in subsection (a) of this section 21 was a contributing factor in the unfavorable in the 22 unfavorable personnel action alleged in the com- 23 plaint. 24 (B) Notwithstanding a finding by the Secretary 25 that the complainant has made the showing required S. 1415 Amdt.
