Solicitation of Contributions by Non-Federal
Persons from Ambassadors
This memorandum responds to your memorandum of May 20, 1994,
regarding solicitation of contributions from Ambassadors by
persons who are not employees of the Federal government.
Your memorandum correctly states that Ambassadors, like other
Federal employees, are permitted to give contributions to
candidate campaign committees and political organizations. And,
because the Hatch Act applies only to Federal employees,
individuals who are not employees of the Federal government (or
the District of Columbia government) are not subject to any
restrictions regarding solicitations of political contributions;
therefore, they may solicit Ambassadors for contributions.
I should point out, however, that it is worth considering now
whether there will be any foreseeable questions raised by
Ambassadors giving contributions to candidates or political
committees. You are perhaps in the best position to determine
how they should be addressed.
