Dear Secretary Brown:
I wish to express my appreciation for your attendance at the 25th Anniversary Celebration Gala
Dinner for Black Enterprise Magazine. As you know, it was a signature event for both Black
Enterprise and Morgan State University, two prominent African-American organizations. The fact
that President Clinton and his Secretary of Commerce were key players in the event speaks volumes
for the commitment of the Administration to inclusion and full participation of all people in the
American enterprise.
As I indicated at the dinner table, Morgan would like very much to pursue with the Department of
Commerce opportunities for funding support in two areas. First, we are interested in developing an
international dimension to our School of Business and Finance, with special focus on South Africa
and the Caribbean. I traveled to South Africa on the eve of democratization and had an opportunity
to discuss with the African National Congress (ANC) the upcoming needs for training and technical
assistance to Blacks in the area of business and management. Specifically, we would like to establish
an Institute for International Business that would involve some faculty going to South Africa and the
Caribbean, and some students and budding entrepreneurs coming to our campus for training and/or
formal studies. The Institute would also provide the opportunity for our students to train abroad in
preparation for working with American companies who will be investing or reinvesting in South
Africa in particular.
The other area of interest is mathematics and science education. Morgan is one of the leading
producers in the country of African-Americans in science. In fact, I was on a panel two weeks ago
with Kathryn Sullivan of your National Oceanographic and Atmospheric Administration (NOAA)
discussing how NOAA might assist in increasing the pool of Black scientists in this country.
Essentially, my recommendations called for support to historically black colleges for pre-college,
undergraduate and graduate education. Morgan is particularly interested in pursuing a major grant
to support its efforts in these areas.
Finally, I am a member of the President's Advisory Council on Historically Black Colleges and
Universities (HBCUs), and we are seeking to assist the Department of Commerce in increasing the

HBCU share of its funding going to institutions of higher education in general. There is no question
that Morgan wants to be among the HBCUs receiving the first major grants.

CEO Budget Strategy Meeting
Following our meeting with you, I have spoken to Felix Rohatyn,
Paul Allaire and Paul O'Neill to express your appreciation for
the meeting and to confirm that we wanted to have a follow-up
mechanism. To that end, it has been generally agreed upon that
Felix would act as the point person in coordination with Bob
Rubin. Felix has agreed to work with Bob on a framework on how
we might proceed to think through strategies in order to move the
growth curve from 2 1/2% to 3%. Paul Allaire and Paul O'Neill
will take the lead in the business community.
Paul O'Neill has already taken significant steps and has had
private conversations with BRT leaders. He is asking them to
give more visible leadership on a potential budget crisis.
In addition, Paul O'Neill has spoken to Martin Feldstein,
President and CEO of the National Bureau of Economic Research.
Feldstein is interested in convening a forum under the auspices
of the National Bureau of Economic Research to elevate awareness
in the business community on what it would take to move the
growth curve. Additionally, he has also had additional
conversations regarding the other reactions. (Erskine Bowles has
details.)
I have indicated to Felix, Paul Allaire and Paul O'Neill (per my
conversations with Rubin, Bowles and McLarty) that our White
House team would be coordinated through the leadership of Rubin
at Treasury, with Bob and Laura Tyson giving particular attention
to the discussions on the growth strategy. Mack, Erskine and I
will work closely with the busines leadership that was present at
the meeting as well as others to develop bi-partisan support on
the need to avoid a "train wreck."

SUBJECT: Update on Speaker's meeting with the Pope
I have had several conversations, last night and today, with the Speaker's office in an effort
to sort through the details of their frustration with setting up a meeting with the Pope. They
have not been able to provide a name of anyone from the Vatican who confirmed this
meeting that they claim is now cancelled. However, I have indicated to them that we
support the Speaker's desire to have a meeting, and certainly in no way would block such a
request.
Archbishop Caccivillian and I spoke today and I relayed to him that if the Pope desired such
a meeting, we had no objection. He stated that the message was "very clear" to the Speaker's
office that the Pope's schedule was set according to protocol and that the Speaker and
Senator Dole were welcome to attend the departure, but that no meeting would take place.
He added that a letter from Rome was sent to the Speaker and the Senator to that effect. He
also noted that there was no confusion on their part, only persistence.
I have conveyed this to the Speaker's office, who seemed grateful for our efforts. Hopefully,
this issue will not be raised again.

This 1s to protest in the strongest possible terms the planned
invasion of the Capital of the Conch Republic (Key West) by
the 478th Civil Affairs Battalion of the United States Army
Reserve this weekend (the 22nd-24th of September).
This so-called "training exercise" is being conducted without
any prior consultation with the duly constituted government
of the Conch Republic, and is a direct affront to our sovereign
status under the adverse possession statutes of International
Law. In fact, it is being conducted without prior consultation
with the civil government of the City of Key West, as well.
It is my duty and responsibility, acting on the authortity of
the Prime Minister, to inform you that my Office has placed
the Armed Forces of the Conch Republic on full alert. A War
Cabinet meeting has been scheduled this evening to plan our

It has come to the attention of the duly constituted government
of the Conch Republic through the press that the United States
Army is planning to invade the Conch Republic on a "training
exercise" this weekend.
Prime Minister Dennis Wardlow, who will be out of country this
weekend on R&R from his last go-round with the Federalist Forces,
has placed the Office of the Secretary General in charge with
full faith and confidence in our ability to defend the Republic.
The Hcnorable Peter Anderson, Secretary General of the Conch
Republic, has placed the Armed Forces of the Conch Republic
on full alert, pending resolution of this total affront to our
sovereignty, and our hospitality. A War Cabinet meeting is
scheduled for tonight at the Schooner Wharf at 9:15.
"This is being done without any prior consultation with our
government, whatsoever', said the Secretary, "It is an affront
to our sovereign status under adverse possession statutes of
International Law, and is tantamount to an act of aggression."

with either the duly constituted authorities of the Conch
Republic, or of the City of Key West is extremely troublesome.

Debbie or Ruby,
It is critical that we get a decision today, on whether the
President wants to go to Vespers (evening prayer service) with the
Pope, so we can begin the negotiations.
I spoke to Alexis in the hallway about a half hour ago and
emphasisized this to her. In the meantime, Lee S. spoke to Billy
Webster. Billy has not asked the President yet because he wants
to be prepared to answer the President's possible question on,
"What will the Pope be saying in his remarks at Vespers?"
I can't get a definative answer on that today. Can you have
Alexis call Billy Webster as soon as possible to discuss. In the
meantime, I will run you over a copy of the Pope's Vespers
Scenario for Alexis to see.

Issues for the Pope's Visit
At the stages current height (one foot high), we are very
concerned that the press will not get a clear view of the Pope
and the President. Potentially, the press shot (shooting down
from a three tiered press riser) is the Tarmac behind them
instead of the plane which places you at an arrival ceremony or
people standing (or even sitting) in front of them. Also if we
raise the stage it will give the guests , especially those in the
back a much better view of the President and the Pope raised
above the crowd.
If the Vatican has a problem with adding another step to
accommodate a higher stage, we could build a gradually sloped
ramp off the back of the stage.
We would like to build the stage in such a way that brings the
Pope and the President into the people. We can do this by
extending the seats down along the sides of the stage while still
preserving the buffer zone.
We would like the Pope to greet the President in front of the
Archbishop's residence on arrival (as opposed to inside) It
offers us the only good photo-op outside of the arrival picture.
The residence provides an appropriate backdrop.
The current plan is to have the Pope greet the President inside
and put a hugh tent over the arrival area providing no picture at
all. The motorcade would actually drive into the tented area.

On September 7, 1995, about 5,000 Teamster represented workers went on
strike on Ryder Systems, the nation's largest car hauling company. This
strike followed a breakdown in negotiations (which began in January) between
the Teamsters and the National Automobile Transporters Division which
represents major car haul companies in the U.S. Ryder is the sole target
of the strike.
Ryder, the largest of the carhaul operations ships about 60 percent of
General Motors new vehicles to dealers from assembly plants and ports
throughout the nation. Chrysler ships its new vehicles by rail to 38
distribution centers; 15 of which subsequently use Ryder to ship to dealers.
In addition, about 30 percent of Ford's new vehicles go by truck and about
half of the vehicles sold in the U.S. by Honda and Toyota are shipped by
Ryder. General Motors is its largest customer.
Since September 14, the Teamsters have engaged in a leaflet campaign to
discourage dealers from picking up vehicles directly, and have encouraged
rail and longshoremen unions not to handle vehicles at rail yards and ports.
On September 21, the National Labor Relations Board rejected a move by Ryder
to end the strike--Ryder had filed unfair labor practice charges with the
Board which were rejected in a ruling that the Teamsters were acting within
their rights because their primary objective is to preserve their work.
Ryder has said it will appeal the ruling and is continuing with a separate
civil suit filed in U.S. District Court in Alexandria VA for lost revenues
of up to $1 million a day.
Offers of mediation from the Federal Mediation and Conciliation Service have
been taken by either party to the dispute. While no talks are scheduled,
there are unconfirmed, confidential reports that an unofficial private
meeting between company and union representatives was held today in Miami,
where the company headquarters are located.

coming days.
You should note that Marilyn will be reaching out to these
and other groups at a staff level as early as this
afternoon. She has also re-scheduled a White House briefing
with key providers for the week of 9.25.

Outreach to Senior Groups
I am also doing a temperature/activity check today with all
of the key senior groups on their perspectives and hill

TALKING POINTS-ACADEMIC HEALTH CENTERS
--It is very important you not put yourself in the posit on of appearing to
support the Republican Medicare plan. Your appearing to say that the plan
will protect quality would be devastating for the Democratic effort to
defeat it or cut it back.
--The promises they have made to you are fool's gold. You need to look at
the total impact of their program, not just on IME and DME but on the
market-basket, disproportionate share payments, bad debt payments,
whether they are doing anything meaningful on AAPCC, Medicaid cuts, and
what their "look-back" will entail in additional cuts.
-The money they are proposing to finance their program with is funny
money. I doubt cuts in "corporate welfare" are going to last beyond the
markup. I'm sure that they will not last beyond conference--and they are
certainly not proposing dedicated funds, in any event.
--You have to look at the end game. The end game is going to be a
negotiated deal between the Republicans and the President. Once they've
gotten their press conference, they have absolutely no interest in
protecting you.
--We will be helpful to you in cutting the final deal, because we know how
you important you are to quality care. In particular, we want to work on
moderating any IME/DME cuts to reasonable levels and to making sure that
the AAPCC issue is addressed. But we will also have lots of of other
priorities, and if you have undercut the President's position, it will be
very hard to persuade him that he should spend any chips protecting you.

Post-Adarand Issues: Revisions to FAR Rules
In his absence, Deval asked me to bring to your attention
the following matter.
Section 7102 of the Federal Acquisition Streamlining Act of
1994 (PASA or the Act) authorizes certain federal agencies to set
aside contracts for small business concerns owned and controlled
by socially and economically disadvantaged individuals; where
set-asides are not used, FASA authorizes agencies to offer a 10%
price evaluation preference to such concerns. Under Section
7102, members of racial and ethnic minority groups are presumed
to be socially disadvantaged. Thus, Section 7102 authorizes
agencies to use racial and ethnic criteria as a basis for
decisionmaking in the allocation of contracts.
Section 7102 of FASA applies to all federal agencies except
the Defense Department, the Coast Guard, and NASA -- all of which
already have that same authority under what is known as the "1207
program. # The DOD has created the Rule of Two as a vehicle to
implement the 1207 program. Section 7102 of FASA provides
authority to extend the existing 1207 program government-wide.
However, the authority granted by Section 7102 did not go
into effect on the date of enactment of FASA. Rather, Section
7102 is to be implemented in a uniform fashion through revisions

to the Federal Acquisition Regulation (FAR). A proposed rule
containing revisions to the FAR were published in the Federal
Register on January 6, 1995 by the FAR Council (which is
coordinated by OMB and GSA). As I understand it, those proposed
regulations would have extended the 1207 program government-wide.
The final rule must be published by September 7, 1995. However,
the proposal to extend the 1207 program government-wide will not
be a part of the final rule.
As you know, in the months since the proposed rule was
published, the Supreme Court handed down its opinion in Adarand
Constructors, Inc. V. Peña, which held that federal affirmative
action programs that use racial and ethnic criteria as a basis
for decisionmaking are subject to strict judicial scrutiny.
Furthermore, President Clinton has directed executive branch
agencies to review such programs to determine whether they
comport with the Adarand standard. As a result of the
President's directive, the 1207 program, among others, is under
review.
In light of Adarand and the President's directive that
agencies review existing affirmative action programs, the FAR
Council has decided to eliminate from the final rule the
provision that would implement Section 7102 of FASA. We
understand that the FAR Council has the discretion to make that
decision, because FASA does not mandate that agencies use the
authority granted to them under Section 7102.
our Office of Legal Counsel has reviewed the draft
regulations and has informed us that the final regulations to be
published later this week will state that the provision
implementing Section 7102 "remains under consideration" [or
"remains under review. "]
We: are calling this to your attention because it is possible
that some minority contracting and civil rights groups may be
concerned that the final rule will not extend the 1207 program
government-wide. We understand (from conversations between our
OLC folks and William Coleman of OMB) that minority business
groups and key members of Congress were made aware of this fact
at the end of July during Congressman Mfume's minority business
forum. Nonetheless, we thought it prudent to bring this matter
to your attention.
