Chayet Sincerely NLC/par Enclosure 5658n The Orphan Drug Act Has Successfully Provided Incentives To Develop Life Saving Drugs For Rare Diseases And Should Not Be Modified The Orphan Drug Act The Orphan Drug Act ("ODA") (P.L. 97-414, as amended) was adopted in 1983 to provide financial incentives for companies to develop drugs to treat rare diseases. The act was based on a finding by Congress that, in the absence of such incentives, companies were not likely to take the necessary risk and make the necessary investment to develop these needed products. In 1984, the definition of "rare" was set at "less than 200,000 persons in the United States" by P.L. 98-551. The number of persons in the patient population is determined at the time of the Orphan drug designation. The primary financial incentives created by the ODA are (1) a tax credit equal to 50% of the qualified clinical testing expenses for orphan drugs and (2) a seven year period of exclusivity for marketing the designated drug for the designated orphan disease. No exclusivity is given for the drug for the treatment of other diseases and there is no exclusion of other drugs for treatment of the designated disease. In order to receive orphan status for a drug for a particular disease, a company must request such status from the FDA before filing the necessary application for approval to market the drug. Orphan Diseases It has been estimated that 10 to 20 million Americans suffer from orphan diseases, including hemophilia, cystic fibrosis, muscular dystrophy, Huntington's disease, pituitary dwarfism, end stage renal disease and AIDS, among thousands of lesser known conditions. In the ten years before the ODA was passed, only 10 drugs were approved for rare diseases; in the seven years since its passage, 45 drugs have been approved. Hundreds more are at various stages of clinical trials. Numerous lives have been saved by orphan drugs and, despite the high cost of some orphan drugs (which does not necessarily mean high profits), substantial overall reductions in the cost of hospitalization and treatment have been achieved. It is precisely the hope of adequate economic reward generated by the seven year exclusivity provision which has induced companies to make the investment to develop and test these drugs. Cost of Drug Development In 1988, over $60 billion was invested by the U.S. pharmaceutical industry in research and development programs. Based on data from the FDA, it takes about 7 to 13 years to bring a new drug to market and costs in excess of 150 million dollars. More than 90% of all drug entities demonstrating potential clinical benefit never make it beyond the animal-safety stage of evaluation. For every single success story like AZT (the only approved drug to inhibit AIDS virus replication), there are literally hundreds which never succeeded in the clinic. It is doubtful that AZT, for example, would have been resurrected from the 1960's and brought to successful clinical fruition had the Orphan Drug incentives not been in effect. The Proposed Amendments HR 4638 would make two major changes in the Orphan Drug Act. First, it would require the FDA to base an orphan drug designation on its estimate of the patient population three years in the future, rather than at the time of designation, and would terminate exclusivity if at any time the patient population for the orphan disease exceeds 200,000. Second, it would allow "co-exclusivity" to companies which "simultaneously" develop the same drug. (Simultaneous development would mean that the second company requested orphan drug designation within six months of the first company's designation and submitted its application for marketing approval within one year of the first company's application). In addition, the bill contains no grandfather clause and therefore would permit the termination of exclusivity for orphan drugs currently on the market. The Proposed Amendments would Destroy the Incentives Created by ODA The ODA incentives work in two ways. First, they encourage all companies, large and small, to make the investment necessary to develop orphan drugs by guaranteeing market exclusivity for a reasonable time during which development costs can be recovered and profits achieved without the fear of "me too" competitors who follow behind after the risk is reduced by the pioneers. Second, they provide a special incentive for smaller companies, which have been the source of much of the recent revolution in biotechnology and the developers of many innovative products. These companies can better focus on the smaller markets created by the orphan diseases, but can only succeed if they are not threatened by the possibility of a multinational pharmaceutical giant adopting a crash program to catch up and achieve co-exclusivity after - 2 - feasibility is established or if the patient population grows. If the ability of small companies to recover investments through orphan drug protection is weakened, investment in these innovative enterprises will be curtailed. Conclusion Skyrocketing costs for developing new drugs and bringing them through the FDA regulatory process and into the clinic are serious impediments to treating orphan diseases. While collectively 20 million Americans suffer from orphan diseases, the potential return on drugs for individual orphan conditions does not provide the economic incentives that drug companies need to shift their focus away from developing products to treat more frequently occurring medical problems. Unless compelling incentives are provided, drug manufacturers will avoid dedicating their efforts and devoting their resources to development of orphan drugs since the likelihood for eventual product success is exceedingly small. The ODA has achieved its purpose. Forty five drugs have been approved under the program and hundreds are in the pipeline. The ODA has been so overwhelmingly successful that Presidential AIDS Commission Chairman Watkins has recommended using the ODA as a model for the development of AIDS therapeutics and vaccines. He recommended in his final report that "market exclusivity and special tax credits" (the heart and soul of the ODA) be employed to encourage development of AIDS and pre-AIDS drugs. The fact that the investment made by a few companies has resulted in a few high cost treatments which have proved successful in treating orphan diseases, should not be used as a justification to destroy the incentives. It is precisely the hope of achieving a profit which, of course, causes private companies to invest in this area. DOD has reviewed the concerns you expressed. We recognize your special and continuing interest in the effective administration of this program which resulted from legislation you sponsored. The program is indeed an important one. As you are aware, the Administration's policy is to support the Afghan resistance and the Cambodian non-communist resistance. DOD's humanitarian assistance program provides excess DOD property to these groups and to other recipients as directed by the Secretary of State. Under the defense authorization and appropriation acts for fiscal year 1990, DOD received $13 million for the provision of humanitarian assistance. The authorization act specifically provided that no more than $3 million of those funds shall be used for transportation of Afghan refugees or displaced persons, and no more than $3 million may be used for relief supplies for the non-communist resistance organization at or near the border between Thailand and Cambodia. With respect to your concern about how long it is taking to obligate funds for assistance to the Cambodian non-communist resistance, DOD advises that the flow of materials to the resistance is increasing as a result of personnel and program adjustments since the beginning of the year. Your letter also expressed concern that the Department provided excess property only from the Pacific Command region. DOD advises me that it is its interpretation that there is no geographical restriction on the source of materials to be provided to the resistance. Both DOD and the Department of State are monitoring the situation with respect to reported use of chemical weapons by Pathet Lao forces. They advise that, to date, they have been unable to corroborate independently reports of such use. We are, however, extremely concerned about such reports. Appropriate action will be taken if these reports are found to be true. Your letter also reflected concern that non-governmental organizations are aiding Pathet Lao and communist regimes. We regret that the aid policies of such organizations often differ from U.S. government policies. My chief of staff, Vaughn Forrest, has just returned from Thailand where Thai government officials, State Department officials and AID officials all informed him that they have been begging for materials for at least the last twenty months. Apparently, the Department of Defense, particularly Dr. Walthius, informed them that under the "excess" program only $500,000 a year was made available to the NCR, instead of the $3 million authorized and appropriated by Congress. Dr. Walthius also informed these agencies that the supplies could only be drawn from the Pacific area. It appears that Dr. Walthius has used NCR monies for projects he feels are more important than the priorities set by Congress. If so, this is a major problem and must be quickly addressed. I am also greatly concerned with continued reports of the use of chemical weapons by the Pathet Lao forces as late as last month, April, 1990. This should be investigated and any U.S. aid, contracts or grants to either Cambodia or Laos should be held in escrow until this investigation is completed. It is also my understanding that certain non-governmental (NGO's) are providing aid to the Pathet Lao and Communist regimes. If that is so, is this consistent with U.S. policy in that region? There is only one major problem to the successful completion of this program and that is Dr. Walthius. In the hopes that we may be able to expedite this process, my chief of staff, Vaughn Forrest, is available to meet with Ed Rogers and answer any questions you might have. Dear Mr. Card, In response to the letter of July 9, 1990 written to my father Wayne Peters, I can hopefully give a few pointers to the President on his fishing. I was very impressed with the Bush compound in Kennebunkport and with the property on a peninsula as it is, can not understand why the President does not catch very many fish. As for the cod fish, have him use a standard cod hook but bait it with bright orange shrimp. Clams work well but shrimp does better. Sounds foolish to catch a $2.99 fish on $4.99 bait but its fun. His bluefish luck is, well if the media is correct, in need of improvement. Rebel has a lure called a "Jawbreaker". This is the only lure I use and have great success. Without going into a big fish story, I've lost more of these lures because the 'really big ones' hit so hard that my eighty pound test line breaks before they get in the boat. O.K., maybe a little fish story. If fishing with cod jigs, don't assume when the jig is hooked on the bottom that it is the bottom. My Dad hooked into prime real estate 220 feet down when after a lot of tugging, the jig released and attached was jawbone formally belonging to a halibut of considerable size. A few moments later I had the same experience. This fish quickly earned the name 'Walter' from the movie 'On Golden Pond'. Anytime Mr. Bush wants to fish he, you and the gang are more than welcome to join me on a trip out of Newburyport Massachusetts anytime.
