The Orphan Drug Act Has Successfully Provided
Incentives To Develop Life Saving Drugs For
Rare Diseases And Should Not Be Modified
The Orphan Drug Act
The Orphan Drug Act ("ODA") (P.L. 97-414, as amended) was
adopted in 1983 to provide financial incentives for companies
to develop drugs to treat rare diseases. The act was based on
a finding by Congress that, in the absence of such incentives,
companies were not likely to take the necessary risk and make
the necessary investment to develop these needed products. In
1984, the definition of "rare" was set at "less than 200,000
persons in the United States" by P.L. 98-551. The number of
persons in the patient population is determined at the time of
the Orphan drug designation.
The primary financial incentives created by the ODA are (1)
a tax credit equal to 50% of the qualified clinical testing
expenses for orphan drugs and (2) a seven year period of
exclusivity for marketing the designated drug for the
designated orphan disease. No exclusivity is given for the
drug for the treatment of other diseases and there is no
exclusion of other drugs for treatment of the designated
disease. In order to receive orphan status for a drug for a
particular disease, a company must request such status from the
FDA before filing the necessary application for approval to
market the drug.
Orphan Diseases
It has been estimated that 10 to 20 million Americans
suffer from orphan diseases, including hemophilia, cystic
fibrosis, muscular dystrophy, Huntington's disease, pituitary
dwarfism, end stage renal disease and AIDS, among thousands of
lesser known conditions. In the ten years before the ODA was
passed, only 10 drugs were approved for rare diseases; in the
seven years since its passage, 45 drugs have been approved.
Hundreds more are at various stages of clinical trials.
Numerous lives have been saved by orphan drugs and, despite the
high cost of some orphan drugs (which does not necessarily mean
high profits), substantial overall reductions in the cost of
hospitalization and treatment have been achieved. It is
precisely the hope of adequate economic reward generated by the
seven year exclusivity provision which has induced companies to
make the investment to develop and test these drugs.
Cost of Drug Development
In 1988, over $60 billion was invested by the U.S.
pharmaceutical industry in research and development programs.
Based on data from the FDA, it takes about 7 to 13 years to
bring a new drug to market and costs in excess of 150 million
dollars. More than 90% of all drug entities demonstrating
potential clinical benefit never make it beyond the
animal-safety stage of evaluation.
For every single success story like AZT (the only approved
drug to inhibit AIDS virus replication), there are literally
hundreds which never succeeded in the clinic. It is doubtful
that AZT, for example, would have been resurrected from the
1960's and brought to successful clinical fruition had the
Orphan Drug incentives not been in effect.
The Proposed Amendments
HR 4638 would make two major changes in the Orphan Drug
Act. First, it would require the FDA to base an orphan drug
designation on its estimate of the patient population three
years in the future, rather than at the time of designation,
and would terminate exclusivity if at any time the patient
population for the orphan disease exceeds 200,000. Second, it
would allow "co-exclusivity" to companies which
"simultaneously" develop the same drug. (Simultaneous
development would mean that the second company requested orphan
drug designation within six months of the first company's
designation and submitted its application for marketing
approval within one year of the first company's application).
In addition, the bill contains no grandfather clause and
therefore would permit the termination of exclusivity for
orphan drugs currently on the market.
The Proposed Amendments would Destroy the Incentives Created by ODA
The ODA incentives work in two ways. First, they encourage
all companies, large and small, to make the investment necessary
to develop orphan drugs by guaranteeing market exclusivity for a
reasonable time during which development costs can be recovered
and profits achieved without the fear of "me too" competitors who
follow behind after the risk is reduced by the pioneers. Second,
they provide a special incentive for smaller companies, which have
been the source of much of the recent revolution in biotechnology
and the developers of many innovative products. These companies
can better focus on the smaller markets created by the orphan
diseases, but can only succeed if they are not threatened by the
possibility of a multinational pharmaceutical giant adopting a
crash program to catch up and achieve co-exclusivity after
- 2 -
feasibility is established or if the patient population grows. If
the ability of small companies to recover investments through
orphan drug protection is weakened, investment in these innovative
enterprises will be curtailed.
Conclusion
Skyrocketing costs for developing new drugs and bringing them
through the FDA regulatory process and into the clinic are serious
impediments to treating orphan diseases. While collectively 20
million Americans suffer from orphan diseases, the potential
return on drugs for individual orphan conditions does not provide
the economic incentives that drug companies need to shift their
focus away from developing products to treat more frequently
occurring medical problems. Unless compelling incentives are
provided, drug manufacturers will avoid dedicating their efforts
and devoting their resources to development of orphan drugs since
the likelihood for eventual product success is exceedingly small.
The ODA has achieved its purpose. Forty five drugs have been
approved under the program and hundreds are in the pipeline. The
ODA has been so overwhelmingly successful that Presidential AIDS
Commission Chairman Watkins has recommended using the ODA as a
model for the development of AIDS therapeutics and vaccines. He
recommended in his final report that "market exclusivity and
special tax credits" (the heart and soul of the ODA) be employed
to encourage development of AIDS and pre-AIDS drugs.
The fact that the investment made by a few companies has
resulted in a few high cost treatments which have proved
successful in treating orphan diseases, should not be used as a
justification to destroy the incentives. It is precisely the hope
of achieving a profit which, of course, causes private companies
to invest in this area.
Biogen, Inc. would be pleased to discuss this matter further
with interested parties or to furnish additional information.

Dear Bill,
Governor Sununu shared with me your letter regarding the
Department of Defense (DOD) humanitarian assistance program. DOD
has reviewed the concerns you expressed. We recognize your
special and continuing interest in the effective administration
of this program which resulted from legislation you sponsored.
The program is indeed an important one.
As you are aware, the Administration's policy is to support the
Afghan resistance and the Cambodian non-communist resistance.
DOD's humanitarian assistance program provides excess DOD
property to these groups and to other recipients as directed by
the Secretary of State. Under the defense authorization and
appropriation acts for fiscal year 1990, DOD received $13 million
for the provision of humanitarian assistance. The authorization
act specifically provided that no more than $3 million of those
funds shall be used for transportation of Afghan refugees or
displaced persons, and no more than $3 million may be used for
relief supplies for the non-communist resistance organization at
or near the border between Thailand and Cambodia.
With respect to your concern about how long it is taking to
obligate funds for assistance to the Cambodian non-communist
resistance, DOD advises that the flow of materials to the
resistance is increasing as a result of personnel and program
adjustments since the beginning of the year. Your letter also
expressed concern that the Department provided excess property
only from the Pacific Command region. DOD advises me that it is
its interpretation that there is no geographical restriction on
the source of materials to be provided to the resistance.
Both DOD and the Department of State are monitoring the situation
with respect to reported use of chemical weapons by Pathet Lao
forces. They advise that, to date, they have been unable to
corroborate independently reports of such use. We are, however,
extremely concerned about such reports. Appropriate action will
be taken if these reports are found to be true. Your letter also
reflected concern that non-governmental organizations are aiding
Pathet Lao and communist regimes. We regret that the aid
policies of such organizations often differ from U.S. government
policies.
Your continued support, and that of your staff, for U.S.
assistance to people seeking freedom is respected and greatly
appreciated.

Dear Mr. Sunuhu: John -
I believe you will find the enclosed information very
interesting and I would appreciate any assistance you might be
able to provide regarding this serious situation.
of particular concern to me is the fact that the excess
property designated in the DOD Excess Program is being sent
somewhere other than to a priority country (ex; Laos, Cambodia).
The Office of Humanitarian Assistance (OHA), specifically
Dr. Walthius, has told my staff repeatedly in the last two years
how difficult and troublesome the Thai government and AID has
been in implementing the program. All the while the office of
OHA has spent the dollars earmarked for the Non-Communist
Resistance (NCR) on other missions, most of which were less
critical in nature.
My chief of staff, Vaughn Forrest, has just returned from
Thailand where Thai government officials, State Department
officials and AID officials all informed him that they have been
begging for materials for at least the last twenty months.
Apparently, the Department of Defense, particularly Dr. Walthius,
informed them that under the "excess" program only $500,000 a
year was made available to the NCR, instead of the $3 million
authorized and appropriated by Congress. Dr. Walthius also
informed these agencies that the supplies could only be drawn
from the Pacific area. It appears that Dr. Walthius has used
NCR monies for projects he feels are more important than the
priorities set by Congress. If so, this is a major problem and
must be quickly addressed.
I am also greatly concerned with continued reports of the
use of chemical weapons by the Pathet Lao forces as late as last
month, April, 1990. This should be investigated and any U.S.
aid, contracts or grants to either Cambodia or Laos should be
held in escrow until this investigation is completed. It is also
my understanding that certain non-governmental (NGO's) are
providing aid to the Pathet Lao and Communist regimes. If that
is so, is this consistent with U.S. policy in that region?
There is only one major problem to the successful completion
of this program and that is Dr. Walthius. In the hopes that we
may be able to expedite this process, my chief of staff, Vaughn
Forrest, is available to meet with Ed Rogers and answer any
questions you might have.
This is a serious situation as people in these countries
continue to suffer. Please do not hesitate to contact me if you
have any further questions. I will be in touch.
Sincerely,
Bill

Dear Andy,
Thanks very much for taking time out to refer my resume. I just received a response
from Ron and he has advised me of the situation and has also forwarded it on to some
others, it all sure helps, you never know what might come from getting the word out.
Again thanks for taking the time I am sure both you and Ron are up to your elbows
and taking time out to help me certainly means a lot. After just finishing my degree I,
like most I'm sure, expect the world to open up, especially the way this state is right
now that certainly hasn't happened. But I feel I have a lot to offer and have a record of
accomplishment, so I'll just be patient and persistent and wait for the right opportunity.
Hope everything is well with you and your family. Uh (gulp) one more thing, I'm
going to be in D.C. Aug. 30 & 31 with my son this time, if I could arrange for a tour
again I would be most grateful. Thanks, if its a problem I'm sure I could make other
arrangements.

Dear Andy:
I am writing to you for two reasons. First and more important
is regarding a federal program I heard about recently. I understand
that the President signed a bill allocating monies for various tree
planting projects. My interest in something such as this is obvious,
especially with the financial troubles plaguing this area's towns and
cities. We have always had a good relationship with the Town of Holbrook.
This program could offer the town some needed funds for a beautification
project and give Yards of Pleasure a chance to provide that service.
Any direction you could give me on this matter, Andy, would be most
appreciated.
Secondly, my family and I are planning a trip which involves a
couple days in Washington, D.C. We will probably be in town on August
6 and 7 and then will be continuing on to Williamsburg, Va. Both my
wife and I have been to the Capitol before and we thought the experience
would be good for the children. If there are any points of interest
other than the usual which you could recommend, we would really appreciate
it.
I realize with your crazy schedule, you may not even get a chance
to read this before we leave on our trip.
Both Beth and I watch for you closely when the news has an item
on the President. You might be surprised how many times we see you
in the background. Your name usually comes up in conversation with
your Dad while we're discussing legal matters. He will tell me where
you have been recently, how exciting the job can be and the long hours
it entails.

without stopping in and seeing you and Ron. Sorry Ron wasn't around.
I can't tell you how much it meant to me to see you and at the same time, sit in the West
Wing of the White House. In all the years I worked and lived in Washington, I never saw
the West Wing. The closet I got was when Lee Atwater invited me to lunch at the White
House mess.
Andy, thank you very much for the presidential tie-clip and key chain. You didn't have to
give me a gift. It was very nice of you to think of me in that light and I will put them with
my other George Bush memorabilia from the old days. Thank you very much.
We didn't have much time to talk, but I wanted to tell you that my wife and I have decided
to move near her family in San Diego, California. Our move is primarily for our son, as I
have no family here and its becoming a problem with seperation and baby-sitters. He doesn't
know anyone but us.
I spoke to Ron about the move, and that I applied for a position in San Diego. Anything you
could do would be most appreciated. Ron has all the paperwork and specific's.
Again, thank you for our meeting and the gifts, and best wishes for your continued success.
Sincerely,
Bernie Sweeney

Dear Mr. Secretary:
In support of resolutions by the Evangelical Lutheran Church in
America, we the members of the Church Council of Lutheran Church
of The Redeemer, Woburn, Massachusetts are compelled to write to
you relative to the situation in El Salvador.
As New Englanders, steeped in the history of freedom and
democracy we urge you to use your influence with the President
to ensure:
... protection of church members and leaders, as well
as those seeking refuge in the churches;
...
freedom and protection for church and humanitarian
workers as they minister to those in need, and permission
for workers from other countries to join them in such
efforts; and
...
a favorable outcome to the negotiations between the
Salvadoran government and the insurgents, with the aim
of a just settlement to the conflict.
...
an end to all military aid by all foreign countries
including the United States.
The dimensions of the evil occuring in El Salvador are
appalling. The killing of the poor and persecution of churches
must be brought to a halt.

Dear Mr. Card,
In response to the letter of July 9, 1990 written to my father
Wayne Peters, I can hopefully give a few pointers to the President on his
fishing. I was very impressed with the Bush compound in Kennebunkport
and with the property on a peninsula as it is, can not understand why the
President does not catch very many fish.
As for the cod fish, have him use a standard cod hook but bait it
with bright orange shrimp. Clams work well but shrimp does better.
Sounds foolish to catch a $2.99 fish on $4.99 bait but its fun.
His bluefish luck is, well if the media is correct, in need of
improvement. Rebel has a lure called a "Jawbreaker". This is the only
lure I use and have great success. Without going into a big fish story,
I've lost more of these lures because the 'really big ones' hit so hard
that my eighty pound test line breaks before they get in the boat. O.K.,
maybe a little fish story.
If fishing with cod jigs, don't assume when the jig is hooked on
the bottom that it is the bottom. My Dad hooked into prime real estate
220 feet down when after a lot of tugging, the jig released and attached
was jawbone formally belonging to a halibut of considerable size. A few
moments later I had the same experience. This fish quickly earned the
name 'Walter' from the movie 'On Golden Pond'.
Anytime Mr. Bush wants to fish he, you and the gang are more than
welcome to join me on a trip out of Newburyport Massachusetts anytime.
Sincerely and Happy Fishing,
Charlee

The Honorable George Bush

Dear Mr. President,
My campaign for Governor of Connecticut is a
campaign to bring Republican principles and values to
the people of Connecticut. I have been through this
beautiful state that we both love many times during
the past nine months and I know that Connecticut
residents are crying for fiscal prudence, cuts in
state spending, and to hold the line on taxes.
It is because of our shared values and high
esteem in which you are held by Connecticut residents
that I extend this request to you to campaign in
Connecticut on my behalf. Your participation in my
campaign is vital to restoring responsible government
to your home state. I would be honored if you would
agree to appear on my behalf this fall.
This would be an opportunity to renew your
friendships in this state while driving home the
message of how important a Republican-led Connecticut
is to you and to the nation. Your presence would
boost the already considerable efforts of our
supporters, help with our fundraising and invigorate a
campaign that already shows great promise of success.
Debi and I look forward to the opportunity of
welcoming you and Barbara "home". I hope to hear from
you soon.

Dear Andy:
I cannot thank you enough for the splendid hospitality
and very moving personal courtesies that you, the President
and your staff extended to me from Houston throughout your
stay in Portland.
The time the President was able to give me was extremely
valuable to me and to Oregon, and I hope also to him. The
visit was a smashing success, despite the annoyance of a tiny
vocal and splintered minority. Lynn and our children were
genuinely moved by the personal attentiveness and strong
character of President Bush. The help to my campaign simply
cannot be measured or adequately acknowledged by my words
of gratitude.
Followup
On a personal note, Andy, I have asked several of the
medical experts who deal with life-saving new drugs to give
me information that I can then forward to you. I deeply
appreciate your willingness to be a conduit to the FDA about
these concerns and about the promise of a new direction by
a new administration in helping to save lives.
I am sure we will be in touch in the months ahead. I
look forward to a continuation of a partnership and friendship
which I esteem beyond measure.

Dear Mr. Card:
Thank you for your prompt reply (copy enclosed) to my letter,
but I think you may misunderstand the point I am trying to make.
I assume that from all indications that the Post Office is
going to go up on postage by 10¢ in the very near future. My
suggestion is that if they are going to go up within the next six
months, make the stamps for six months. If you would take out your
calculator and figure out what 10¢ extra, for stamps only, for six
months per piece of mail, you will see what this could do for the
deficit.
Since we know that postage will be going up very shortly, I
feel that to do this for six months would help lower the deficit.
Respectfully submitted,

Thank you for your recent correspondence
which I reviewed today. Your suggestion
that a postal surcharge which would
include a special stamp, "to help lower
the deficit" was very interesting, and I
have shared it with appropriate officials

be generated, but it warrants further
review.
Budget negotiations are very important.
The President's leadership has resulted in

meaningful deficit reduction ro reality.

Dear Andy:
I am enclosing suggested language for a Presidential Proclamation for the 37th
Anniversary of the end of the Korean War, Friday, July 27, 1990.
I am sure you will find in President Reagan's and Vice President George's files
no Presidential Proclaimation has been issued on "Korean War Veterans Day, but
they will show President Reagan sending a letter, picture and a representative in
1988 and President George Bush sending Lt. Col. Terry, Mattke, USMC to repre-
sent him in 1987 and a letter, picture and my lifelong friend, Ambassador John A.
Volpe (former Governor & Sec. of Transp.), to represent him in 1988!
As you know, Gov. Dukakis' CVS effectively prevented me and our non-profit corp.
from conducting the finest I ever put together and because of that I cannot conduct
this year's Services (legal advise dictates I do not do anything until after 7/27/90),
I, as all Marines do, will do my utmost to honor all Korean War Veterans on July 27th!
I have already secured Proclamations from: Governor Martinez; Mayor Freedma of
Tampa; Mayor Ulrich of St. Petersburg and Mayor Williams of Gulfport. I will be re-
ceiving on from Gov. Dukakis and probably Gov. Cuomo.
I have sent requests by FAX (after telephone calls) to: ABC's "Good Morning America"
(Roberta Dougherty); CBS' MORNING NEWS (J. Kernis); NBC's "TODAY" Program
(coby Atlas) for special coverage (possibly involving me in dress blues) through their
local affiliates WTSP-TV (Larry Ganns); WTVT-TV (Daniel Webster) and WFLA-TV
(Vicky Benchtmol) as well as the St. Pete Times and Tampa Tribune for next Friday.
If President Quob goods me an original CODY of his Proclamation ASAP, I will read it
with his permission wherever I appear next Friday and try to put together a Special
Ceremony at Mc Dill Air Force Base or the National Cemetery at Bay Pines. Please
let me know as soon as possible.
Best personal regards,
Dick Mc Grath
