The support of this group will be vital if we are to be successful in cleaning our urban air of ozone and other pollutants. As part of the Omnibus Trade Act of 1988 (P.L. 100-418), the National Commission on Superconductivity was to be established to assure U.S. leadership in this vital technology. In addition, the National Superconductivity and Competitiveness Act (P.L. 100-697), passed late last year, called for the White House Office of Science and Technology Policy (OSTP), together with the National Critical Materials Council, to develop a five-year, action plan for high temperature, superconductivity research and development. This legislation intended that OSTP use the recommendations and advice of the Commission in developing this national, five-year plan. Unfortunately, the Commission has yet to be officially convened, though steps had been taken earlier in the year to name members of the Commission and its Chairman. OSTP has begun initial efforts to formulate the five year plan, they are proceeding without the vital views and opinions of the private sector, views and opinions which were to be provided through the Commission. As has been noted by a number of experts on technological competitiveness, the U.S. can not afford to continue as in the past, with Federal efforts moving on one track and private efforts on another. Given the actions of Japan and other nations to dominate this, as well as other technological fields, we must begin to work more collaboratively with the private sector in setting our national course. The Commission and the development of the five-year, superconductivity action plan present an excellent opportunity for establishing a working model for such collaboration. We reiterate the importance of our schools to the nation by quoting an editorial from Forbes, December 12, 1988: For the enormous and enormously depressed inner cities of Chicago, New York, Boston, Cleveland, Newark et al, Catholic schools provide hugely consequential oases of impact and hope. Their value is -- literally as well as figuratively - - beyond measure. Many minority parents make the choice of Catholic schools because they regard them as the only places where their children can get a decent education - 'The only way out of the ghetto' in street parlance. We believe parental choice for all children is crucial. Ways must be found and structures put in place SO that every parent has the ability to share in his/her educational tax dollar. We feel it would benefit the image of the President if he indicates in all his statements clearly and forthrightly that he is the education President for all. We wish to reiterate that the asbestos legislation passed by the federal government without the necessary financial - assistance to make it possible is but another example of injustice and inequity. We ask that the financial issue continue to be addressed and that Catholic schools be written into any proposed legislation. If asbestos is a health hazard, it is a hazard to all children. 2. When legislation makes possible assistance to our students through entitlement programs, we ask that streamlining delivery systems be considered. Many of us deal with inestimable number of LEA's. Why not give entitlement directly to parents? Allow them to direct the flow of monies to those educational institutions which they believe best serve the needs of their children. We ask for representation in the White House Conference on Education as well as significant representation on the President's recently announced Educational Advisory Committee and on other committees addressing education in general or educational excellence in particular. We ask you to follow up on our request that the President visit one of our schools in the near future. We look forward to a continuation of this conversation through the briefing sessions suggested and through having another opportunity in the near future to pursue this dialogue. Louisiana Energy Services will proceed with plans to develop the country's first domestically owned enrichment plant. Washington, D.C. 20500 JohN Dear Governor Sununu: The time for a decision on the extension of steel trade restrictions (the "VRAs") is approaching. Enron, the nation's largest gas pipeline network, is dependent on a healthy and viable steel pipe industry to supply large-diameter pipe for replacement and new construction. We support and need a healthy and competitive domestic steel industry. While we do not oppose extension of the VRAs, we must have adequate supplies of steel plate for our pipe suppliers in this country. If steel plate is not available to our pipe suppliers from domestic sources, we need to be assured that foreign supplies of plate will be available through the "short supply" system (or some other procedure for exemption of products from the VRAs). The short supply system needs several improvements to be more effective for our needs and those of our pipe suppliers. First, applications for short supply must be processed rapidly and transparently. Rules governing the short supply process should be issued and followed by the Department of Commerce. Second, decisions on short supply applications should be rendered within thirty days after submission, or more rapidly if market conditions and customer requirements make more rapid response necessary. The fact that a short supply application has been filed means that the shortage already exists, and time is of the essence. Third, suppliers should not be able to frustrate short supply applications by declaring their ability to make a product, as has happened in the past. Prospective suppliers should be required to prove that they have experience in making the product to the necessary specifications, and that they are approved and qualified suppliers of that product to the applicant. Furthermore, the prospective supplier, who seeks to supply domestic production in lieu of the applicant's proposed imports, should be required to offer specific goods and performance that are contractually enforceable by the applicant. This is necessary to prevent frivolous assertions by opponents of the application intending only to buy time. Fourth, offering a product at an excessive price is tantamount to a refusal to supply the product. For example, the Department of Commerce should disregard an offer to supply plate to a pipe producer at a price which clearly is above an ascertainable market price. We do not advocate using short supply as a lever to control steel prices, but we think that clearly excessive prices should be taken into account in evaluating offers to supply a steel product. Fifth, no domestic manufacturer should be forced by these trade restrictions to buy raw material from a direct competitor. For example, a pipe manufacturer forced to buy plate from a steel company who also makes and sells pipe in direct competition. Enron plans to begin construction of more than 1,300 miles of pipeline in the 1989-1990 period. Access to adequate supplies of large diameter steel pipe is an essential part of this program. We intend to buy domestic pipe, and we need domestic pipe supplies for both our pipeline projects and for small orders for replacement of existing pipe. With the short supply reforms outlined above, we believe the proper balance can be struck between the needs of Enron and the energy industry and the legitimate requirements of the domestic steel industry.
