if enacted into law, would greatly endanger this voluntary
sector by subjecting it to pervasive, intrusive and needless
governmental control. Worse, H.R. 3 also denies parents who
choose religious child care for their children equality of
benefits with parents who choose secular child care.
In urging that you vote against the foregoing bills, we
do not at all desire that you neglect parents who need child
care services. Sound child care measures were placed before
Congress in 1988. These measures (a) would afford effective
help to parents and families, as opposed to bureaucracies,
(b) would not impose massive centralized, Swedish-type
governmental controls upon child care activities, and (c)
would not deny religious and parental rights by penalizing
parents who choose religious child care.
A bill that carries out these positive principles is
the amendment offered by Rep. Stenholm. It would expand the
earned income tax credit (EITC) and significantly increase
new funding for child care services through Title XX. It
meets all of the three criteria above mentioned.
We shall deeply appreciate your response to this
letter, and the assurance that you will seek legislation
meeting these criteria.

General Thornburgh regarding the vacancy on the
Fourth Circuit United States Court of Appeals.
Since the Court composition includes only two
Marylanders, it is very important to me personally
that our representation not be cut to one member
to increase another state to three when Judge
Harrison Winter takes senior status on December 31.
We in Maryland worked very hard to carry our
state for George Bush in 1988. The appointment of
a Marylander to this prestigious post would send a
strong message as we enter the 1990 election cycle
and look down the road to the President's re-election
in 1992: Support for George Bush and the Republican
party and philosophy does not go unnoticed.

Dear Governor Sununu:
Many of the business, agricultural, and humanitarian leaders of Iowa
are interested in how they can become involved in assisting Eastern
Europe. At this point, I felt that it was inappropriate to send an
official delegation from Iowa. However, I have asked one of Iowa's
top agricultural experts, Varel Bailey, to lead a private sector
delegation to explore the possibility of building humanitarian and
commercial ties.
On January 4, 1990, we will be conducting a briefing in Des Moines
for the members of the delegation and other interested parties. Up-
to-date information is essential to the success of this initiative. I
need your help to arrange for an Assistant, or Deputy Assistant
Secretary on East European Affairs from the State Department to
provide a presentation during this briefing.
Your assistance will be greatly appreciated and will help ensure the
success of this initiative. Please have your staff contact Phillip
Stanhope of my staff to follow up.

Dear Governor Sununu:
The aviation community and the traveling public lost a true
friend and accomplished colleague when National Transportation
Safety Board Member Joe Nall was killed in an aircraft accident
several weeks ago. We at AOPA were deeply saddened by his death
and will greatly miss his important contributions to aviation
safety.
The loss of Joe leaves vacant his seat as an NTSB member, a
particularly important position given the general malaise and
disruption that the Board has suffered from over the past
months. As such, we also think that it is imperative that a new
member be appointed in a timely fashion to serve the remainder of
Joe's term.
It is my understanding that Kenneth Peppard, Joe's able Special
Assistant since 1986 and a highly qualified aviation expert, is
interested in serving out Joe's term on the Board. Ken is
extremely knowledgeable in aviation safety and transportation
issues, and his diversity of experience at NTSB make him
well-qualified for the position. Ken has an extensive background
with the Federal Aviation Administration, and as a pilot and
safety expert would be a welcome and needed addition to the Board.
I am enclosing a copy of his biography for your information and
hope that you will give every consideration to nominating Ken to
serve Joe's term at NTSB. It is essential that the Board be
fully staffed, and with knowledgeable experts such as Ken. I
hope the Administration will not delay in filling this important
position.
As always I appreciate your interest and support of aviation
issues. I wish you and your family the best for this holiday
seasón, and a happy and healthy New Year.

Dear John,
Further to our conversation on lobster, I would
make the following points respecting national treatment
and the environment.
On national treatment, while a ban on so-called
undersized lobsters would meet a theoretical national
treatment test. (since U.S. lobster fishermen are
prohibited from marketing lobsters of the same size),
this is exactly the kind of measure which provoked U.S.
retaliation against the European Community. In this
case, the EC imposed a ban on the production and sale of
hormone-containing meat, thereby eliminating a profitable
U.S. market. The ban meets the national treatment
requirement since neither EC producers nor exporters to
the EC can sell hormone-containing meat in the EC. Our
position on lobster is identical to your position on
meat. Simply meeting the letter of the national
treatment test -- with no scientific justification --
does not entitle the United States to eliminate almost
$30 million of existing Canadian exports.
On the environment, the facts are that Canada
maintains a highly effective conservation programme that
sustains a steady supply for a growing industry. Canada
employs a range of management tools, including controls
on size, the number of traps and lobstermen and the
length of seasons. I would note that the United States
relies on just one tool, the size standard. Furthermore,
Canadian catches of big or small lobsters do not affect
U.S. lobster stocks in any way. It is not credible to
argue that either Canadian lobster catches or sales in

the United States reduce the lobster harvest for U.S.
fishermen.
As I mentioned to you on the phone, the heart of
the problem is that there are too many lobsters chasing
too few customers. It is not a problem of conservation

I hope the upcoming holidays find you, Nancy and all the
Sununu's in great spirit and Nina and I send you Best
Wishes for the Holidays.
John, I am writing as a follow up to a letter you received
from Ambassador Henry L. Kimelman on the consideration of
William Lamimer Mellon, Jr. as a candidate for the Medal
of Freedom.
While there is a family connection here, Mr. Mellon was
Nina's great uncle, I would like to ask that he be given
every consideration as I truly believe he was an
outstanding citizen and a fine example of what this
country of ours is all about.
Through the years my work in the Foundation has put me in
contact with his work at Deschapelles and the Haitian
people. Coming from his background and deciding what to
do with his life at midlife and then accomplishing so much
is truly remarkable. His legacy will continue, but I
believe his nation should single him out as he really was
a great American!
I know you have received background material already so I
will close hoping you will see that Mr. Mellon's
credentials are investigated fully.

partment of Justice's nominee to the United States Court of
Appeals, Eighth Circuit. As you know, the Department is presently
considering possible nominees to the Appeals Court.
I would like to recommend Mr. James B. Loken, Esq. of Minneapolis,
Minnesota, for this position. I have attached a copy of his
resume for your review. You will note that he has served as a law
clerk for the Honorable J. Edward Lumbard, then Chief Judge for
the United States Court of Appeals for the Second Circuit. On the
heels of that experience, he served as a law clerk to the Honor-
able Byron R. White, Associate Justice for the United State
Supreme Court. For the last 17 years, he has been a practicing
lawyer, and partner, in the law firm of Faegre and Benson serving
in the business litigation group.
It is my feeling that Mr. Loken would bring to the Eighth United
States Circuit Court of Appeals the appropriate blend of practical
litigation experience as well as an academic judicial background.
In addition, Mr. Loken is active in his community and the develop-
ment of public policy.

The American Library Association is deeply concerned about
the implications of a proposed executive order, requested by
Senator Armstrong, banning the sale of Playboy magazine and other
items of so-called pornography from military exchange facilities
and from all federal government controlled stores and "outlets." "
The latter definition is SO broad that it appears it could be
applied to libraries. A similar request to President Reagan was
properly rejected a year ago on constitutional grounds.
The American Library Association becomes gravely concerned
when the federal government is tempted to utilize its power to
illegally restrict the free flow of constitutionally protected
speech in any public forum. Playboy has never been found legally
obscene in any jurisdiction, and the American Library Association
supported legal action brought by the American Council of the
Blind to prohibit the exclusion of the braille edition of Playboy
from the Library of Congress' Talking Books program.
To suggest that limiting the access of service men and women
to a popular, widely accepted magazine is necessary to "protect
minors" distorts the function and use of military exchange
facilities. Armed forces personnel are not children and there
are less burdensome and constitutional means available for
members of the military to guide and control their own children's
choices in the marketplace than those contemplated here.
The proposed executive order, however, would not only
encroach on the constitutional rights of millions of Americans,
it also would set a truly frightening precedent of federal
content-based restrictions on protected speech. Prior attempts

on the part of over-zealous politicians and federal officials to
target this magazine have been repeatedly and properly rebuffed
by the courts. The language of Senator Armstrong's proposal
suggests that his targets may be even broader than Playboy.
On behalf of the American Library Association, I urge that
President Bush, like President Reagan before him, carefully
consider this matter and reject the proposed executive order. It
is unnecessary, unconstitutional, and unwise.

Dear Governor Sununu:
In a November 17, 1989, meeting with a number of
Administration officials, I was told that the President's
Clean Air Act Amendment did not include any further sulfur
dioxide emission controls on industrial boilers and processes
for the following reasons:
1.
Emission reductions from these sources would not be
cost-effective. Some reductions would cost as much as $2,000
to $3,000 per ton of SO2 reduction. Cost-effectiveness is a
primary goal of the President's acid rain control measure.
2. Further regulations on these sources would be
administratively problematic. The sources are extremely
varied and the inventory data is unreliable making a
confident estimate of reductions impossible.
3. These sources will "do their fair share for clean
air" by complying with the nonattainment and the air toxics
provisions. It was also acknowledged that these industrial
sources will shoulder the bulk of the electric rate increases
caused by electric utility compliance with the acid rain
control measure.
As you are aware, a number of draft proposals to amend
the President's acid rain title are being discussed. Some of
these proposals include S02 emission controls on industrial
boilers and processes. It was indicated at this meeting that
the Administration would apply the same reasoning and oppose
sources. any attempt to include further controls on industrial
I feel that it would be very helpful to the negotiating
process for the Members to receive a clarification of the
Administration's views on this issue. Though Congress is
officially in recess until January 23, 1990, meetings and
discussions will be held throughout the interim period.

Dear Mr. John Sununu:
I am writing to express deep disappointment that
the Administration did not oppose the trade restriction
on the import of live lobsters contained in bill HR 1668,
passed by Congress on November 20. This provision, which
cannot be justified on conservation grounds, is a
violation of the United States' FTA and GATT obligations.
As you recall, President Bush raised U.S. concerns
on lobsters with Prime Minister Mulroney during their
meeting at Kennebunkport. The action by Congress ignores
the commitment the Prime Minister made to the President
to work for a cooperative solution. When the bill was
introduced into Congress, the Canadian objections were
set out in a diplomatic note, dated October 6, delivered
to the Department of State. No reply has been received.
On November 17, consultations at the level of officials
took place in Washington, under the auspices of the FTA,
and no indication that the Administration would oppose
the bill was forthcoming. In 1988, the Administration
firmly opposed attempts to impose a similar trade
restriction as part of the FTA Implementation Act. We
had every reasonable expectation that the Administration
would do the same on this occasion.
I can only underline that the adoption of such a
trade-restrictive measure in the first year of
implementation of the FTA would be economically and
politically damaging in both countries. As you know, we
are currently at an impasse in our efforts to resolve the
salmon and herring dispute. The action by Congress on

lobsters can only exacerbate this already highly-charged
situation on fisheries with potentially grave
consequences for the FTA. The lobster issue, however,
can and should be managed. I would urge that the HR 1668
be vetoed and that we cooperate to this end.

However, because of Medicare short falls many of our nations
hospitals have failed and closed their doors, and many more are being
threatened with closure.
Medicare projections for 1990 and 1991 are potentially disastrous.
Adequate Medicare funding has to have a number one priority in
our budget.
I am a Trustee of the Exeter Hospital. I am gravely concerned.
I hope you will do everything you can to assure that full Medicare
funding is provided in the budget.

My dear Mr. Sununu:
I am in receipt of a copy of the letter, sent to you on October 25th of
this year by Mr. Tom Ellis, in which he recommends to you the reappointment
of Mr. Thomas Farr as a member of the Federal Service Impasses Panel of
which I am the Chairman.
I wanted you to know that I heartily endorse this recommendation by Mr.
Ellis. Tom is a fine young man and has done an excellent job as a member of
the panel these past five years.
I would also like to recommend to you the reappointment of Ms Jean
McKelvey, whose term expires at the same time as Mr. Farr's term. I have
communicated my position to the staff member of the Office of Presidential
Personnel. Ms KcKelvey is the former Dean of the School of Industrial
Relations at Cornell University and is a person of nationwide prestige in
the area of industrial dispute resolution. Her presence on the Panel has
been most helpful in getting acceptance of our decisions and our guidance
to parties who come to the Panel for assistance.
The manner in which this agency functions can have a considerable bearing
on the manner in which the bureaucracy functions in the handling of the
responsibilities and duties of government. I took the position of Chairman
at the request of President Reagan at the time that John Herrington was
Director of the Office of White House Personnel. Bonnie Newman handled much
of the detail and is familiar with our objectives at the time. I was not
available for a full time position, because of my family obligations would
not permit me to move to Washington.
The Panel members are not full time employees. They are paid on a daily
basis when they actually sit on the Panel meetings or when they are doing
other duties connected with their membership on the panel. In recent months
we have assigned Panel members to cases in their geographical areas to hold
informal conferences in an effort to effect a voluntary agreement and upon
on occasion to serve as fact finders and in some cases as arbiters. It has
been very effective as we have been increased the number of settlements by
agreement, thereby avoiding the necessity of issuing a formal Decision and
Order.

The present Panel has worked very well together and I think we have
succeeded to a considerable extent in stabilizing the collective bargaining
process in the Federal Sector I would like to keep present Panel intact for
the remainder of my term if possible. My term will expire on Jan 10, 1993.
I would like very much to discuss with you the function of the Panel and
the problems inherent in the entire collective bargain system as I see
them. I am aware of the tremendous demands upon your time but if you could
grant me a few minutes at our mutual availability I think it would be
fruitful. I will be in Washington on the late after noon of Dec 5th and all
day on Dec 6th if you might be available during that period.

Dear John,
One politically savvy friend read my memo on our Constitution.
He said that it would be discredited on the basis that it promotes a
Presidential Dictatorship I am sure that he is right and that this
would be read into it. So I rewrote the end of the memo. It now points
out that worrying about a Presidential Dictatorship is "barking up the
wrong tree". We already have a Dictatorship. It is lodged in the hands
of the entrenched majority of Democrats in Congress. It will take popu-
lar education to spread this fact and a strong President to correct this.
President Bush is being criticized for the mishandling of the Pana-
ma "coup". I wonder if this demerit could be turned into an asset. This
could be done by pointing out that this is the unavoidable result of the
Congressional encroachment on the Presidential powers and by having the
President demanding and taking control over the executive functions.

The last time we talked was the evening of your first
election victory to the Governor's Office, November, 1982.
Regretfully, I could not participate in your second campaign as
in July, 1983 I was sworn in as an FBI Special Agent.
I am writing to you on behalf of the FBI Agents
Association. Briefly, HR 215 addresses an overtime pay issue
which would assist all FBI agents but more specifically, would
help retain the senior Grade 13 Agents who are now receiving
overtime at a Grade 10 level.
This may be the least of significant issues facing
President Bush and yourself however, I am told that HR 215 is in
danger of "stalling in Committe" and that the Administration's
support for this bill may provide the necessary "momentum" that
is needed to pass this legislation in the House.
The Senate version was passed in Senator Dole's Drug
Bill.
Ed Bethune, former Republican Representative from
Arkansas, and former FBI Agent, has discussed the issue in depth
with Bobbie Kilberg and Constance Newman.

PRESIDENTIAL GALA LEADERSHIP MEETINGS
Per our conversation, I'd like to outline our requests
for a "phone day" meeting with the President in January, and
a White House pre-event reception on the day of the Gala
(January 29, 1990).
January phone day
Our leadership group consists of 25 top Republican
leaders, many of whom you know, who have agreed to take 2
days out of their schedules to come to Washington to phone
for prospects. Clearly, a meeting with the President at
each day will provide motivation for these men and women to
attend these working sessions, and a meeting with the
President will also let them know that he will be aware of
their efforts to help the national party.
Gala Reception, White House
We have already received confirmation for the first
phone day of December 12 at 3:45 p.m. and would like
confirmation of a second date in the first or second week of
January.
Secondly, we would like to have a White House reception
in the late morning (11:00 - 12:00) on January 29 to reward
those members of the leadership committee who performed
well. We would also like to include the stars who will
perform for President and Mrs. Bush that evening as a thank
you for donating their time to the Gala. This event is
important as it will incorporate many committee members who
may not have participated in the phone day but who rose to
the occasion and raised substantial amounts for the RNC.

1,200 union members in the Washington area.
Like everyone else, we are aware of the extremely heavy demands on the
President, both because of his office and his popularity. With this

On behalf of the lumber and building material industry in New
York and New England, I would like to extend an invitation to
yourself or President Bush to be a principal speaker at the 96th
Annual Convention of the Northeastern Retail Lumber Association.
This meeting which attracts between ten and twelve thousand
people to the Hynes Convention Center in Boston each year, will
be held January 12-14, 1990. Specifically, we would like you to
be our luncheon speaker on Friday, January 12, 1990 at 12:15 p.m.
in the mail ballroom of the Hynes Center.
Our annual convention acts as a bellwether for the building
materials and housing industry as to business conditions for the
coming year and is recognized by our industry nationwide as one
of the most significant meetings of its kind in the country.
Prior speakers at our convention were former Presidents Gerald
Ford and Jimmy Carter, former Secretary of State Henry Kissinger,
anchor newsmen Peter Jennings and Tom Brokaw and many other
prominent leaders in industry and government.
Already speaking at our convention is Mr. Dan Rather on Friday
morning, and Mr. Bryant Gumbel on Sunday afternoon.
If you are able to accept our invitation on behalf of yourself or
the President, I will be delighted to discuss time schedules and

Dear John:
Hospital Corporation of America (HCA) is a well-respected
company, which, through wholly owned subsidiary, owns and
operates a hospital in Panama. In recent months it has become
increasingly difficult for HCA to comply with the regulations
implementing our sanctions against the Noreiga regime and they
have asked for my assistance in obtaining an exemption from
certain provisions of those regulations.
The hospital not only provides a humanitarian service to
the Panamanian people, it is also the most sophisticated
health care available in Panama to American citizens, military
personnel and dependents. Ironically, the hospital's
compliance with the regulations has resulted in an economic
benefit to the regime. It has also placed the hospital in
jeopardy of being taken over by the government, which would
not only work an even greater economic benefit to the
government but also jeopardize the health care to those
Americans remaining in Panama.
Attached is the application we filed with the Office of
Foreign Assets Control seeking the exemption. Although I find
the case compelling on the merits, as I hope you do, I am of
course aware of the politically sensitive questions involved
and that Treasury will seek the views of the White House.

Many conservatives believe it is imperative
President Bush raise Nicaragua as a top priority
item during his upcoming talks with Mikhail
Gorbachey. Though recent events in Europe are
certainly encouraging, the continuing flow of
hundreds of millions of dollars in military supplies
to the Sandinistas is cause for deep concern.
Can I recommend that, in advance of the non-
summit, the President convene a delegation of
conservatives to confirm his intention to do so?
It would mobilize conservative support for his
policies in this area. Moreover, it would provide
the administration with an excellent forum in which
to frame the debate.

As a small investor I have been increasingly concerned with the
gyrations of the stock market.
In everything I have read or heard about the causes for these
dramatic market abberations there seems to be one major factor
at the bottom of the problem. The existence of computer program
trading appears to exaggerate market moves upwards or downwards.
Most of the time these moves are unrelated to market fundamentals
or any other logical reason. They are certainly not good for
small investors who can only sit on the sidelines powerless while
the large investors manipulate the market.
It is a healthy sign that many large corporations and investment
institutions have decided on their own against further use of
program trading as part of their investment technique. I hope
the investment community as a whole will take a firm and thorough
position to eliminate this onerous practice. Hopefully , the
voluntary route will be taken by all involved. However, it is
important that the federal government leadership and all
appropriate agencies take a leadership role in encouraging
the dropping of program trading.
