Working with the Gallup Organization and other public opinion firms in Europe, we intend to conduct in-depth personal interviews with 13,000 people: a thousand each in the United Kingdom, France, Spain, Italy, Norway, West Germany, East Germany, Poland, Hungary, Czechoslovakia, Yugoslavia, Romania and the Soviet Union. We hope to explore such issues as: -- how much political and economic integration of Europe is really possible, given the continent's nationalist and ethnic rivalries; -- what the enduring effects of 40 years of Communist rule may be on the countries of eastern Europe; -- what such concepts as "free enterprise," "democracy," "security," "success, " "fair trade, and "freedom of the press" really mean in the European context; -- and what the people of Europe think of America and Americans today. Washington, D.C. 20500 Dear Governor Sununu: I'm writing to suggest a specific course of action with regard to Child Care legislation for 1990. This letter is a supplement to the excellent meeting held in your office two weeks ago, and is not intended to contradict the conclusions of that meeting. This letter reflects my opinions only, prepared at the request of Newt Gingrich, the House Minority Whip, and is not intended to speak for the House Child Care Task Force. My goal is to identify a plan that is both justifiable on policy grounds, and able to obtain a majority vote in the House. Essentially, I believe that the White House should draft a bipartisan, conservative child care bill, in consultation with House members. Since the President has the absolute ability to either sustain a veto of a bad bill, or actively support and pass a good bill, the President should be quite hard-line on what he will and will not accept. Giving too much on the liberal side will drive away support for the bill by conservatives who have been working on child care for two years, on and off the Hill. A White House-sponsored bill should begin with the understanding that President Bush and House conservatives have won the debate: a majority of both Congress and the American people supports child care legislation that contains refundable tax credits to parents, block grants to states with no restrictions, maximum use of vouchers, religious freedom based on parental choice, and no federal standards. Therefore, I urge a simplified, streamlined child care proposal that includes tax credits and Title XX block grants only. A number of formulas have been suggested that will work; the John H. Sununu 7, 1990 following represents several fundamentals which are essential to a successful bill: 1. Tax Credits for Families A. A basic tax credit to adjust the EITC for family size is important although not directly related to child care. The Downey proposal to increase the EITC to up to 25% for families with three or more children is acceptable but could be trimmed down. B. The tax credit for pre-school children (up to age 6) should be the principal focus, and the bulk of the money in the bill should be directed to this credit. It should: - be up to $1000 per pre-school child per the President's early position; - be available for families with incomes up to $35,000 (beginning to phase down at $25,000). This is more expensive than prior proposals, but it does get the attention of the public for the first time. C. It is essential that you retain the President's prohibition against a double dip of both the pre-school tax credit and the dependent care tax credit. The proposal should permit a family to claim one or the other. This is the essence of "anti-discrimination" policy for several conservative groups. D. Both the family-size EITC and the pre-school tax credit must be immediately refundable, in each week's paycheck. 2. Block Grant Provisions A. Increase Title XX funds by $400 million. The additional funds could be earmarked for child care, although conservatives will object to this. Any increase in Title XX block grants must: - include Domenici voucher language to require states to make vouchers available; - not include model standards or other requirements; - not add exhortations to Title XX which raise other issues. Specifically, a successful bill will include the following: - a provision that vouchers may be used in sectarian care without triggering additional federal or state requirements; - no new requirement that states regulate religious- based care; - no prohibition of Title XX grants to day care facilities which display religious symbols; - explicit permission for religious tenets in hiring provisions for facilities receiving vouchers. 3. Other Issues All other issues - Head Start, model standards, business incentive grants, school-based care, home work provisions, liability risk pool, senior citizen earnings exemption - should be dealt with in separate legislation, not as part of this child care bill. Sununu Chief of Staff to President 1600 Pennsylvania Avenue Washington, DC 20500 WETLAND MEMORANDUM OF AGREEMENT BETWEEN EPA AND US ARMY CORPS OF ENGINEERS The proposed MOA between EPA and the Corps of Engineers for mitigation of wetlands does not recognize the entire NEPA process. Throughout the text of the MOA, it is implied that decisions are to be based solely on impacts and mitigation of wetlands. The NEPA process requires that consideration be given not only to environmental impacts but also social and economic factors. In paragraph II C 1, it is stated "allows permit issuance for only the least environmentally damaging practicable alternative." This is further footnoted to indicate that if alternatives are not available and impacts are so significant permits may not be issued, regardless of mitigation proposed. This would create a situation where it could be impossible to go forward with a project. What this implies is that wetlands will be saved regardless of the costs or other benefits that may be received from a project. Paragraph II C 3, discusses compensatory mitigation. Included in this discussion is mitigation banking. We have established a working relationship with Fish and Wildlife regarding banking of wetlands. These regulations now require EPA and the Corps of Engineers to approve mitigation banking. Since Fish and Wildlife are primarily concerned with wetlands, this would result in having three federal agencies involved in mitigation banking. This seems to be an excessive federal involvement and there should only be one federal agency involved in this process. Mr. John H. Sununu January 25, 1990 Page 2 In paragraph III C, it is stated "other reviews such as NEPA and Corps public interest review cannot be used to nullify any guidelines requirements or to justify less rigorous guidelines. " This is totally contradictory to the NEPA environmental process. A single issue is being given all the weight in the decision making. The intent of the NEPA process was that consideration would be given to environmental, economic and social aspects of projects before making the decisions. The Section 404 wetland permit process should take its place along with the overall consideration of environmental, economic and social issues. It is requested that the proposed MOA be put on hold indefinitely. If it is determined that an MOA is needed, then it should conform to the NEPA policy and process and give appropriate consideration to all environmental, economic and social aspects. Clouding this opportunity, and perhaps distorting our view of the future, is the continuing budget deficit. Recent statements attributed to the Office of Management and Budget suggest that the undistrib- uted balance in the Highway Trust Fund will not be used to augment current program levels as long as a significant budget deficit exists. California continues to strongly oppose any national gas tax increase for deficit reduction purposes. While we recognize the need for augmenting transportation funding at all levels of government, we continue to oppose a gas tax for transportation purposes until the Highway Trust Fund balance is reduced, current gas tax diversions are restored, and evasion of gas tax is stopped. These actions will help prevent the use of the Highway Trust Fund as a masking device for deficit spending in the same manner as is occurring with the Social Security Trust Fund. In the near future, California will make available its assessment of the past program accomplishments and recommendations for future policy directions. While California's basic proposal for new directions in transportation are considered essential regardless of program funding levels, the proposal will prove to be more beneficial to the economic well-being if current funding levels were augmented by modest yearly reductions of the Highway Trust Fund balance. the Honorable John Sununu January 24, 1990 Page 2 of 2 In this regard, we ask that you keep open the option to gradually spend down the undistributed balance when the Administration's Fiscal Year 1991 budget debate draws to a close. Sununu Chief of Staff to the President Office of the President Washington, D. subject: Memorandum 01 Agreement Between the Environmental Protection Agency and the Department of Army Concerning Mitigation This office has recently completed an in-house review of the subject MOA as it pertains to mitigation on individual permits under the Section 404 Regulatory Program of the Clean Water Act. The "key" introductory state- ment is the third sentence of the first paragraph, " is written to provide clarification for agency field personnel on the type and level of mitigation required to demonstrate compliance " The remainder of the MOA states in regulatory format what the Clean Water Act Section 404(b) (1) Guidelines have contained since the early 1980s. This MOA reflects the intent and goals of the Clean Water Act; unfortu- nately, it is subject to human interpretation and therein lies the potential for adversarial situations and inherent project delays. There are two aspects of the MOA with which we must take issue. First, on page 2, Section II.B., it states that a determination of appropriate mitigation shall be based on the values and functions of the aquatic resource impacted and shall disregard such factors as project need, societal value or the investment objectives of the project sponsor. In addition to being unconscionable and blatantly in conflict with the National Environ- mental Policy Act (NEPA) and the Corps' public interest review process, it is also completely contradictory to the second paragraph on page 3, Section II.C., of the MOA. This paragraph states that appropriate and practicable measures to offset unavoidable impacts (i.e., appropriate mitigation) should be appropriate and practicable in terms of cost, existing technology, and in light of overall project purposes (emphasis added). This obvious contradiction should be clarified in favor of the latter approach. Public works decisions simply cannot be made based on single issues. The balancing of all relevant factors, as mandated by NEPA, must be the responsible process. Our second issue of concern relates to the timing of the issuance of this MOA. The Corps and EPA have wholly disregarded the request of the "AN EQUAL OPPORTUNITY EMPLOYER M/F/H" Mr. John H. Sununu Page 2 January 19, 1990 Office of Management and Budget to withhold setting policies relating to the "No Net Loss" concept until the President's Domestic Policy Council Wetland Task Force has published appropriate guidance. I suspect the President is too wise and experienced to become complacent over opinion polls. There are some clouds on the horizon, and I suggest the Administration begin to take some trade and investment initiatives to shore up the economies of our neighbors to the south and the struggling democracies in Eastern Europe. These initiatives do not involve new Marshall plans or grandiose spending, but merely tap the greatest resource the United States still has in abundance -- a people with generous talents and good hearts. The brief paper I attach may provide a few ideas. There is no necessary law of gravity that a President must become less popular as the term of office extends. Yet, it is often the case that a failure to seize well thought out initiatives or an internal crisis badly handled, will create an atmosphere of drift and the appearance of mismanagement. Army Corps of Engineers and the Environmental Protection Agency now before the White House. I write from the perspective as Mayor of the third largest city in South Carolina and one who is presently serving on Governor Campbell's Wetlands Forum. Serving with very active environmentalists, developers, foresters, and elected officials, has been a very meaningful experience for me. As we have gone through a very exhausted process, I believe we have reached several distinct conclusions. First of all, I believe all of us would qualify as environmentalists in that we are not despoilers of all that is good and we recognize the value of wetlands. We also recognize the fact that "all wetlands are not created equally". That is to say that while many and in fact most wetlands are valuable, there are many that have virtually no value and the federal agencies, especially the EPA, have not been able to understand that. Summing it up, I would say that because of the federal agencies' reckless and high-handed manner in which they have tried to impose the regulations, are there own worst enemy and that is the reason there is SO much skepticism over this joint agreement. We applaud that attention; however, we are writing to express our opposition to mandated health insurance. The federal government should not be dictating what every employer should be doing. Small businesses would be especially hard hit because they can least afford the high costs. Mandates would force many small business employers to shift the costs of health care back to employees in the form of lower wages or reduced employment. Mandated health insurance will end up hurting those it is intended to help. There is no question that action needs to be taken to reform our health care system. There are many changes that could be made, such as giving self-employed people and unincorporated firms the same 100 percent tax deduction for health care premiums now given to incorporated businesses. Our association represents nearly 500 small, independent telephone companies in over 45 states and mandated health benefits would certainly have an adverse affect on these businesses. The business community's opposition to mandated health insurance is virtually unanimous. Transportation Secretary Skinner proposes new user fees and increased taxes for aviation users. The Administration has a dilemma. The critical question however is, can America adequately modernize the airport and airway system without raising taxes or imposing new user fees (read: "taxes") ? In AOPA's opinion, you bet it can. This year, Congress will reauthorize the Airport and Airway Trust Fund and the taxes to pay for federal aviation programs. In preparation for the upcoming debate, Aircraft Owners and Pilots Association--which represents more than 300,000 general aviation users nationwide--published Aviation: The Future is Now. This is the result of an intensive, two-year review by AOPA of the nation's air transportation system. The underpinning of AOPA's recommendations is (1) rapid development and deployment of the next generation air traffic system, (2) realistic prioritization of other FAA projects, and (3) sound financial management of the nation's aviation tax dollars. The result of our proposal would be an annual savings of approximately one billion dollars a year over the budget requirements forecast by the FAA through the decade of the 90s-and an estimated long-term savings to the country of more than $250 billion. This family photograph has also served as an extremely valuable tool for him because he has a slight speech problem and his therapist has allowed him to use this photograph during his speech sessions as an incentive to speak fluently. On March 5, 1990, the Littleton and Bethlehem elementary schools will be having a joint graduation for the first ever D.A.R.E. class north of Concord, New Hampshire. Needless to say, it would be out of the question to ask either our president, his wife or even yourself to attend especially in light of what's been going on lately in the world. Being a member of the executive board on the New Hamp- shire Drug Task Force, I'm aware that money will be sent our way in order to help us fight our war on drugs. Honorable John H. These 140 students who will have completed this excellent program will be the pioneers of Drug Abuse Resistance. I feel these youngsters will be playing an extremely important and valuable role in years to come as it pertains to our fight against drugs. This type of education will not cost us millions of dollars but it will require that we continue to encourage these students and remind them that we care and that they are in fact making the right decision by saying NO. At our graduation I was hoping that we might be able to read a short letter from President Bush as it relates to D.A.R.E. since he has supported this program for many years now. I am 61 years old and moved from Andover, MA a year ago to the No. Conway area a year ago. Though I live alone and never married I am blessed with many friends. In High School I was priveleged to study German and years later to add to my knowlege by traveling to Europe and visiting in Germany Austria and Switer land. Each of the 3 years during the the 60/s I was able to add to my knowlege of German I was able to spend 3 weeks perfecting my skiing tecnique and learning more Cerman. In the Air Force T learned to navigate the aircraft with percision. In night flying without the aid of the Radio Compass by dead reconing Iwas abble to predict our ETA to with in 30 seconds of the exact time. Even today I am confident that I could navigate to any exact point on the earth. God gave me the confidence and the U.S. Air Force provided the training and opportunity to do this, I learned some Russian by attend- Baylor University at night paid for and encouraged by the U.S. Air Force. I worked and studied as ayouth and became an Eagle Scout. I hope that I have not bored you any make mention of these things because God granted me the strenth and will to presevere and the proverbs of Soloman was reputed to be wise aided me. I was further blessed by having aLebanese College friend teach me some Lebanese. From some French speaking friends I have learned some french. I have learned some Spanish and some Italian from some friends BY inquiring I have learned hou to greet an Indian in Hindu. I constantly add to my knowledge. I have subscribed to Time magazine since I was 17 years old. I have learned from awise man to learn even from c uneducated man. Though a Protestant for th past 14 years Ihave been aregular attendant of Catholic Charismatic Servi ces I have read the bible almost completely and still continue to comit to memory cogent vereses of Christ, theaposle le the apostles, and the Phrofets.
