C. 20500 Dear Mr. Sununu: Thank you for taking time to look over the "Cammax Engine" report sent to you by Lucille Lagasse. I appreciate the extra time you have taken to share the report with others in the White House. A healthy economy is the most prudent way to pay the environmental bills. I believe the "Environmental Engine" made in America, with worldwide proprietary rights "held" in America, can play an important role to insure continued U.S. economic health and growth. As you know positive economic growth can be accomplished if higher disposable income "and" increased state and federal tax revenues could occur at the same time. Yet, that is a difficult combination to find. Growth unu May 25 1990 pg. 2 would also be stimulated if a simultaneous increase in exports developed. Can these things be accomplished together? I believe they can. One other ingredient accelerates economic growth, and is perhaps the one which is the most needed, a "Positive National Attitude". This all important component has been eroding for 3 or 4 decades. It is-created in peacetime from things like Edison's "phonograph" and "electric lamp", the saga of Henry Ford and the "working-man's automobile" and Charles Lindbergh's "Spirit of St. Louis". These are things that working people can comprehend and sit around the dinner table or at the coffee shop and discuss with American pride. Lately, technology has been far above the level of daily thought. If the average high school graduate has difficulty pointing out Washington D.C. on a map of North America, he or she surely isn't talking detail to Mom and Dad about "Super Computers", "Super Conductors" or "Super Colliders". Not that these things are not important, quite the opposite. It's just that working America doesn't talk high tech. There's a "comprehension gap" and a "pride gap". I have the details of how to fill these gaps and help to accomplish the economic growth goals we all need and want. They are outlined in an executive summary. If you think it is something you would like to consider, play 25 1990 pg. 3 let me know and I will send you a copy. I am heartened by recent interest in this proposal by respected people around the nation and in Washington. Support continues to grow for this effort to develop a "Positive National Attitude". This "Positive National Attitude" excitement comes from the "Environmental Engine" an "American Engine", made only in America, having superior efficiency and emission quality, and exported around the world. As a political leader you can appreciate the effects of increased per capita disposable income, increased state and federal tax revenue and increased American exports. Having them simultaneously as a result of this new engine concept would have a positive effect on economic growth. As an engineer you can appreciate how this can be accomplished with the ability to independently manipulate small segments of the relationship of piston position to crank angle. This relationship is key to thermodynamic, volumetric and mechanical efficiency. The ability to control these cycle dynamics allow the "Environmental Engine" to have the potential for "High Efficiency" and "Clean Air". I hope my report sent to you by Lucille Lagasse has provided a good initial understanding of the invention sununu May 25 1990 pg. 4 and its merits. Now that "Clean Air" engine technology is on the table, implementation is the next step. I believe this concept can help you to improve economic growth, improve environmental conditions, reduce foreign oil dependence and inspire the "grass roots" national pride. Your leadership is needed to take that next step. On a recent trip to Washington I met with a number of people to ask for their support. Several Senators have taken an interest in this technology because of its potential for "Clean Air". The Chief Patent Counsel for Chrysler Corporation and a senior technical advisor at the Pentagon have the engine report under review. I have asked each of them to send a letter in support of continued development of this technology to Mr. George Lewett and Dr. Richard Bartholomew at the Office of Energy Related Inventions. I have been working to obtain a $50,000 grant through this agency. The solicitation (evaluation #25368) is in the second stage of evaluation and a final decision will be made in the near term. I would appreciate it very much if you would write a letter in support of continued development of the Environmental Engine to Mr. Lewett and Dr. Bartholomew. Their favorable response would allow Brackett Research to continue development and publish a technical paper on the engine's thermodynamic and mechanical relationship. I believe this would lead to further support in favor of building a well designed prototype with the integrity required for testing at I. sununu May 25 1990 pg. 5 the National Combustion Laboratory. These are crucial steps which need to be accomplished before widespread acceptance and commercialization of this technology can be realized. Because of the potential for a positive environmental impact, continued economic growth and a better sense of national pride, I believe this effort is in line with "National Interests". The Civil Rights Act, 1990 victimizes three groups in order to satisfy the greed of the plaintiffs' trial bar and has little or nothing to do with employment discrimination reform. We expect strong White House leadership to oppose the passage of this legislation (S.2104/H.B.4000). The three groups victimized are (1) employers but particularly small and medium sized employers, (2) employment discrimination claimants, and (3) the public. The design of the proposed legislation is to prolong the litigation process by lengthening the time for filing charges of discrimination and law suits. It imposes on employers virtually impossible burdens of proof which are placed on employers by non-causal statistical evidence. The net effect is plaintiffs are not expected to prove discrimination; only the suspicion of such. The burden then falls on the employer to prove that none of its employment practices contributes to discrimination. The burden of the legislation on the employer is the threat of jury trials, compensatory and punitive damages which have not been available to claimants under Title VII, CRA of 1964 as amended. The extorsive effect of the legislative design of CRA of 1990 upon smaller employers is obvious. Maybe larger companies can fund the process but not the smaller companies which make up the overwhelming majority of commercial and not-for-profit employing organizations. For 25 years their charges have been resolved through conciliation efforts of the Equal Employment Opportunity Commission or similar state agencies. With few exceptions, conciliation has served all interests well. Victims of discrimination have been made whole and extensive remedial employment procedures have been effected under court supervision. The CRA will sweep away conciliation, substituting litigation. The already clogged court system where plaintiffs wait for jury trials for as long as five to seven years will become totally grid-locked. These employees cannot wait that long. But with contingent fees driven by the greed of punitive damages, complainant-employees will be the ones to suffer. The third victim is the general public and consumers. These are the persons who will pay the cost of the CRA of 1990 in terms of higher prices for products, services and taxes to pay for court rooms and an expanded judiciary. Tort reform is already a major issue because of the adverse economic effects of punitive damages, it is not too smart for Congress to endorse an expanded role for punitive damages and litigation. Employer-employee relations need less, not more, adversarial conduct. By definition, punitive damages are vindictive and the antithesis of the healing, remedial process of conciliation and, indeed, the very purpose of the CRA of 1964. The CRA of 1990 will undo the successes of the CRA of 1964 and affirmative action under E. O. 11246 with greed driven compensatory and punitive damages and litigation. Crime statistics, crime information and crime reporting are not the colorful, gutsy stuff that gains headlines, but it is just the information that helps us do a better job in law enforcement administration. I am sure those persons within the beltway will raise the issue that the Bureau of Criminal Justice Statistics Victimization Survey provides better information of crimes than the UCR. The difficulty is you are comparing two different instruments. UCR has emerged over 60-years to provide a wealth of information for the guidance of law enforcement and the Criminal Justice System throughout the Nation. It needs to continue. To discontinue this expenditure in the F.B.I.'s budget would not make sense, nor would it make any sense to ask the F.B.I. to absorb this expense by reducing its budget in some other area. If we are going to hold crime in check, and continue our war on substance abuse, law enforcement requires information to assure sound administration for the support of the detectives and police officers who are making the arrests and handling crime and substance abuse problems. As a Chief of a small City and a small State, the UCR information provides vital statistical information upon which to justify our budget requirements, and to demonstrate the efficacy of our policing efforts. I hope you can support the continued funding of the UCR Program without reducing some other program within the Federal Bureau of Investigation budget. While I agree that we all must work to end the evils of discrimination, it is another thing altogether to give one group official recogni- tion, credibility and almost a kind of "preference." And when people see President Bush honoring the androgy- nous pop star Michael Jackson as "Entertainer of the Decade," it is no wonder they feel this way. The kind of message and role model this has presented to the teens of America is a sell-out and set-back to many groups trying to wean teens away from cheap values, empty show and toward high moral ground and noble values. It seems to me that Congress has consistently breached its fiduciary responsibility to all taxpayers and citizens. Until such time as Congress spends funds entrusted to it more wisely, equity alone dictates that we have every right to expect them to do with what they have. Many of our federal programs are counterproductive; many represent narrow interests and create a breeding ground for fraud and abuse. Our farm parity program is a fiscal disgrace. Pork barrel attachments to legitimate spending bills are far too numerous, and the management of Congress and the government is so bloated that only waste and inefficiency can result. I don't believe I am an economic Neanderthal, and I have always had reservations about those who prayed to the supply side as the ultimate solution to our fiscal problems. Over the years I have favored and proposed the adoption of the line item veto. However, in absence of same, it appears to me that the President has awesome power via the existing veto mechanism. He should simply go to the American people, itemize his specific reasons for vetoing a particular bill and, for emphasis, indicate its sponsors. In my opinion President Reagan should have vetoed far more legislation than he did. I am glad to see that President Bush is a little more active in that area. There is no question that our government income statement needs fixing. History has shown that pre-election promises are generally hollow. Unfortunately, many made after elections, particularly with regard to reducing deficits, also turn out to be empty. Addressing the issue of taxes in isolation, even with the best intent, is symptomatic of a larger problem: reassessing the long term role of government and the future of this country in a more competitive economic environment. In my opinion it would be shortsighted and counterproductive to address tax policy changes without comprehending their effect on our competitive status and our military and diplomatic commitments. Lastly, discussing taxes without addressing the issue of Social Security emphasizes the "hostage" effect our graying population has on this country. This came about as a result of my keen interest in history, political science and particularly the American culture as seen through the eyes of a lawyer of nearly thirty years' experience. Following the recent events in Eastern Europe, I prepared a program which was offered, on my behalf, to leaders of various groups in the fledgling democracies. Since our government will be sponsoring a similar enterprise, ("Citizens Democracy Corps"), I believe I can be of great help in its organization, administration and execution. I do not represent a constituency or any special interest group. My motivation is and has been the compelling desire to participate in an endeavor which will have historic significance. Through simple personal communication we can make great progress toward spreading and perpetuating our values. I am not a professor. I have not been active in partisan politics for nearly twenty years. I have the community background to outflank her on the environment and use other issues to put her on the defensive. I am a conservative Republican. However, one issue is a litmus test for the support of Northern California voters: off-shore drilling. No one can be elected without being for a ban. Apart from this political reality, I also recognize the fragile ecosystem in the two tracts off the Northern California Coast, where a year ago the President suspended drilling. I do not advocate a ban on both Coasts or even the California Coast. The North Coast, however, must be protected. Please recommend to the President that the suspension on drilling be made permanent. Otherwise, believe me, President Bush will not be able to establish credibility here as the "Environmental President." From Monterey, North to the Oregon border, the President lost all but one county in the 1988 election. That should not have to happen again, especially with as many as 52 electoral votes at stake next time. I well remember the period in the late sixties when you served as faculty advisor to the lota Tetarton Chapter of Phi Sigma Kappa at Tufts. I was a member at that time, although I must admit that my most vivid recollection is the excruciatingly embarrassing evening when you and your wife arrived in response to a dinner invitation that our chapter president had unaccountably failed to communicate to the rest of the Brotherhood. I am writing now in hope that you can be of assistance to three small Maine and New Hampshire towns. I am a member of the School Committee in Acton, Maine. Acton is a town of fewer than 2000 souls, but currently very active in the educational arena. Our School Volunteer program was recently the recipient of President Bush's 117th "Point of Light" recognition, and we have under construction an addition which will triple the size of our K-8 school. This was in response to explosive enrollment growth in the past few years, growth which will reach the high school level by the middle of the decade. We currently send our secondary students to Wells, 30 miles away on the coast, which has expressed reluctance to continue the arrangement in the face of a projected doubling of Acton students. For the last eighteen months we have been involved in discussions with our neighbors to the west, Wakefield and Milton, N. H., relative to establishing a new high school for the three communities. As you may be aware, a Maine-New Hampshire Interstate School Compact exists on the books of both states, having been enacted by the two legislatures and signed into law in the late 1960's. Unfortunately it was never submitted to the U.S. Congress for the required ratification until early this year. Senator Mitchell and Representative Snowe (curiously - we're not in her district) have been extremely supportive. It appears that Senator Rudman, however, is in receipt of an unknown number of letters in opposition to the ratification, and his support is essential. I would like to make two points. First, ratification of the Interstate Compact in no way commits anyone to any ultimate course of action. It merely establishes a legal framework for co-operation among the three communities. Actual establishment of an Intestate School District is at the pleasure of the voters of the three towns and the two State Boards of Education. Eventual construction of a high school would require further action by the voters to bond the project. Given the long road still ahead, I am sure you appreciate our need for early congressional action. Second, while actual support for building a high school is problematic at this time, there has been enormous support in all three towns for joint action. Wakefield and Milton have twice voted overwhelmingly to form a New Hampshire Co-operative School District, first in conjunction with Middleton, and again between themselves when Middleton withdrew. Acton has voted unanimously at two town meetings, first to seek approval of the Interstate Compact, and again to fund its share of the planning costs. Voters in the newly formed Branch River Co-operative School District have appropriated funds to continue the planning process. Perhaps most impressive, Mr. Carl Sieman of Milton has donated an ideal 80-acre site bordering the state line for the purpose of a district high school. At last night's meeting of the Branch River Board, the members authorized a major campaign of letters and petitions to attempt to communicate to Senator Rudman the wide support for the ratification. Unfortunately, the current session of Congress is slipping away. A delay into next January would add a full year to our most optimistic timetable for this badly needed project. I wonder if there is anything you could do to impart to Senator Rudman the concern and dismay of so many people in Wakefield, Milton and Acton over this delay. I realize that this falls rather far outside of your current scope, but I hope to take advantage of your longstanding commitment to the people of New Hampshire. We have found the Coalition is well staffed, dedicated and experienced in the banking and development fields. Although the media has focused most of the attention on debt-for-nature swaps, there have been over $106 million in "development" swaps, including education, compared to approximately $26 million in debt-for-nature. These swaps bring the dynamism of the private sector in this country into close working relationships with the private sectors in the developing nations. The Executive Director of the Debt-for- Development Coalition, Dr. John Ross, just returned from a trip to Brazil during which he met with senior officials of the new Collar Government. This trip culminated in a press conference given by the Ministry of Agriculture to announce the agreement to establish a debt swap program that will link Brazilian entities with U.S. Universities and other entities to modernize Brazilian agriculture. Additional swap programs are of interest to the President of Brazil to raise the standards of living in the 100 poorest communities in Brazil and planning is underway to assist the President in achieving his goals. The Coalition has formed an informal group of prestigious U.S. institutions interested in joining this effort. ( See attached) This is definitely an exciting initiative, one which the President may wish to encourage on his forthcoming trip. The initiative could become one of the international "points of light"; it could bring together the talents of the private sector to address one of the most pressing environmental issues of the day, the destruction of the rain forests in Brazil, in a collaborative linkage with the largest nation to our South, both in terms of population and size. Gentian violet has been shown to prevent the growth of aflatoxin, the most potent carcinogen known to man, about which there has been serious concern since the drought-affected corn crop of 1988 was found in some instances to contain unsafe levels of this form of mold. If gentian violet is removed from the market by FDA during the warm months ahead, considerable amounts of poultry feed will be found unusable, with resulting economic loss to poultry farmers. The FDA appears to believe that propionic acid can be substituted as a mold inhibitor in poultry feed. However actual experience has shown this not to be the case Only gentian violet provides adequate insurance against mold growth The FDA appears to be acting on the basis of theoretical concerns which are more than countered by recent data reviews by eminent toxicologists, who find that gentian violet is a very safe compound. We specifically ask that the Office of Management and Budget require that this proposal be considered a major rule change, requiring (by stature) an in-depth study of economic impact. BROWN EGGS ARE LOCAL EGGS AND LOCAL EGGS ARE FRESH conomists estimate that the banning of gentian violet would ease the production costs of eggs by at least 2 cents/dozen (ch will result in cost increases of 4-5 cents/dozen to onsumers and, when combined with similar increases for chicken and turkey producers and consumers, result in a cost of over- $3006 million to the U.S. economy.
