May I suggest a move which might further the cause? So far as I have read or heard, you did not explain the reasons for slamming on the brakes to slow this joyride at the taxpayer's expense. I have taken the liberty of enclosing two sources with which you are probably familiar, an article in the February Reader's Digest and the comments of that marvellous basher of fake scientists, Dr. Petr Beckmann, in his monthly newsletter, Access To Energy. Dr Beckmann's graph of the earth's temperature for the last hundred years, published in the January 1990 issue, copy enclosed, knocks Global Warming into a cocked hat. Whether the media will pay any attention to statements of scientifically verified facts is of course another question, but coming from you, it would be difficult for them to entirely dodge. Another suggestion: since the Navy has had an almost perfect record of safety with its nuclear - powered vessels, how about turning over the operation of all nuclear plants to it? It would put an end to carelessness and accidents, (30 days in the brig for a boo-boo instead of, "oh, please be more careful"), and it would rock the Naderites to about 9 on the Richter scale. Operation by the Navy would have the further advantage of making it a lot more difficult for the anti-nuclear crowd to sabotage the construction and running of the plants. As for justification: what is the difference between protecting our energy source at the nuclear plants and protecting it at the Straits of Hormuz? For anyone with enough sense to come in out of a hard hail storm, there is none. We might as well face the fact that ultimately, nuclear is the ONLY possible route to go. Incidentally, I believe the Swedes are on line about 93% of the time, while we are nearer 67%, an outrage. LBEST. Sununu Chief of Staff to the President 1600 Independence Avenue, SW Washington, DC 20500 Dear Governor Sununu: I write to bring to your attention a policy of the Food and Drug Administration that is costing the lives of untold numbers of Americans each year. The FDA has effectively banned home blood collection kits designed to facilitate voluntary, anonymous testing for the presence of human immunodeficiency virus ("HIV") antibody. Over two years ago, my client, University Hospital Laboratories ("UHL"), submitted its application for premarket approval of "AIDS CHECK.' Users of AIDS CHECK would simply draw a blood specimen through a simple and harmless finger prick, collect the specimen onto special filter paper, and send the specimen by pre-paid mailer to UHL's laboratory for testing. UHL's laboratory would test the specimen using the identical tests that doctors and hospitals use -- the ELISA screening test and the Western Blot confirmation test, both according to the protocol of the American Association of Blood Banks. The test user would then call a toll-free telephone number and identify himself by the coded identification number provided in the kit. The test results, counseling, and follow-up referrals would be provided anonymously over the telephone by UHL's medical staff trained in AIDS counseling, crisis intervention, and telephone counseling. Pretest counseling would also be provided through printed educational materials included in the kit and through a toll-free hotline. FDA has neither approved nor denied UHL's premarket application for AIDS CHECK. It has simply refused to consider UHL's application, or any other premarket approval application for an AIDS home blood collection kit. The FDA's refusal to accept UHL's (or any other company's) premarket approval John H. Sununu February 18, 1990 Page 2 application is based upon its decision¹ to accept such applications only for AIDS home blood collection kits that (1) a. are "marketed for professional use only within a comprehensive health care environment," (2) provide for collection of a validated blood sample "by one who is recognized by a state or local authority to perform such procedures," and (3) provide that a health care professional communicate the test results and counsel the requestor in a face-to-face setting rather than by telephone. FDA's policy thus reduces to this: it will accept premarket approval applications for all AIDS home blood collection kits, except those designed for use in the home. FDA's policy plainly limits HIV testing options to those currently available -- private physicians, hospitals, medical clinics, and the like -- and forecloses development of an equally reliable option that guarantees anonymity and is performed in the privacy and conveniency of one's own home. FDA's policy of refusing to file premarket approval applications for AIDS home blood collection kits is allegedly based on its concerns regarding (1) the ability of lay persons safely and adequately to collect and package blood samples for shipment, and (2) the ability of health care professionals trained in AIDS counseling to provide effective pre- and post- test counseling over the telephone rather than in a face-to-face setting. In a lengthy comment submitted to FDA at an April 6 hearing on the subject of AIDS home test kits, UHL's Chairman, Mr. Elliott Millenson, responded to these concerns. A copy of that comment is attached, and I will not elongate this letter by repeating the responses contained therein. Two points, however, warrant your special consideration. First, the premarket approval application submitted by UHL contains data from clinical trials using a large number of volunteers from all socioeconomic groups. These data provide valuable information about precisely the concerns that allegedly form the basis of FDA's policy of refusing to accept and study premarket approval applications for AIDS home test kits. In other words, because of FDA's concerns about such things as lay collection of blood samples, it has adopted a policy of refusing to consider premarket approval applications containing clinical trial data addressing (and allaying) precisely those concerns. That the FDA's policy is arbitrary and capricious is obvious. Second, FDA's superficially legitimate concerns about the relative effectiveness of telephone counseling, as opposed to 1 54 Fed Reg. 7280 (Feb. 19, 1989). John H. Sununu February 18, 1990 Page 3 face-to-face counseling, of persons with positive test results are overwhelmed by three indisputable facts. First, many people who should be tested for the HIV antibody (e.g., those who are in high-risk categories for HIV infection) are not taking advantage of existing HIV testing options. Indeed, the experts in this field agree that the vast majority (some say over 90 percent) of HIV-infected persons in the United States are not aware of their infection. Second, some individuals who are not taking advantage of existing testing options would use an equally reliable option that provided the privacy, anonymity, and convenience of an AIDS home blood collection kit such as AIDS CHECK. Finally, and most importantly, some of the individuals who have rejected existing testing options but would use an AIDS home blood collection kit such as AIDS CHECK will, upon receiving a positive test result, seek potentially life-prolonging medical treatment and alter their sexual behavior to protect against transmitting the virus to others. Thus, the FDA's de facto ban on AIDS home blood collection kits constitutes a de facto death sentence for untold numbers of individuals who would not have become infected with the virus had such kits been available to the public. Moreover, implicit in the FDA's policy is the patronizing notion that individuals who would use an AIDS home blood collection kit cannot be trusted, and should not be permitted, to decide for themselves whether telephone reporting and counseling concerning HIV antibody test results is adequate to their individual needs. In light of these facts, FDA's insistence on face-to-face reporting and counseling concerning, HIV antibody test results simply cannot reasonably be sustained. In sum, FDA's policy requiring face-to-face reporting and counseling concerning HIV antibody test results is an example of a governmental agency allowing the "perfect," which is unattainable, to become the enemy of the good, which is. And it will result in the unnecessary and entirely avoidable infection and ultimate death of innocent individuals. FDA's refusal to consider UHL's premarket approval application is inconsistent with the requirements of the Medical Device Amendments to the Food, Drug, and Cosmetic Act, and I am confident that it will not withstand judicial scrutiny. Accordingly, UHL earnestly requests that the appropriate policy- making officials in the Administration inquire into and reverse FDA's policy regarding accepting premarket approval applications for AIDS home blood collection kits. I certainly recognize the need for a cleaner environment and, in fact, applaud the current administration's focus on environmental issues. In particular, I commend the efforts being made to reduce sulfur dioxide (S02) emissions. However, I would like to apprise you of our situation in Arkansas. I am proud of the fact that the 1987 SO2 emission rate for the entire state of Arkansas was only .65 lbs/mmbtu, which is slightly more than half the rate of 1.2 lbs/mmbtu being proposed as a national standard for SO2 emissions in this pending legislation. In 1987, the five coal-fired generating units in Arkansas emitted only .45 percent of the total U.S. S02 power plant emissions while consuming 1.64 percent of the coal used in electric plants. The 1989 emissions rates for these five units are also below the proposed SO2 emissions rate. Additionally, Arkansas is one of only two states within the continental United States that has met the National Ambient Air Quality Standards - another indication of the air quality in Arkansas. Yet, in spite of the low emissions rates achieved by our coal-fired plants through the burning of low-sulfur coal, we are being asked in the pending clean air legislation to incur further costs to clean further our air, which is already some of the cleanest in the country. Under the provisions of H.R. 3030, those plants with a current SO2 emissions rate of less than 1.2 lbs/mmbtu would be required to maintain their 1985 emissions rate. As a result, all five units in Arkansas would be required to install scrubbers to meet or exceed their 1985 emissions rates at a cost of approximately $220 per kilowatt (current dollars). Why? When our utilities entered into the long-term contracts for low-sulfur coal for these plants, the quality of the coal delivered was allowed to vary as long as it met or exceeded the EPA permit rate for each unit. Now the proposed legislation would impose an arbitrary standard of 1985 emissions rates which would override the EPA permit level our utilities used to negotiate their coal supplies. Under the provisions of S. 1630, the 1985 baseline tons of SO2 would be increased by 20 percent. However, in the case of three of the five units, scrubbers would still be required under this bill because they were running at low capacity factors in 1985. So, this particular change will not solve the problem of using a 1985 baseline either. This phenomenon is not unique to the State of Arkansas. There are about 175 other coal-fired units which have opted for meeting emissions standards by burning low-sulfur coal without the use of scrubbers. If the majority of these plants install scrubbers, then the number of tons of S02 emissions reduced may very well exceed the proposed goal of 10 million tons. However, the cost will be enormous. For the state of Arkansas, the total cost for the five units has been estimated at $700 million (current dollars), with an annual revenue requirement increase of $135 million (current dollars). For the ratepayers of Arkansas, this will mean a rate increase of 5-10 percent (current dollars). This is especially disturbing in light of Arkansas relatively poor economic situation, ranking 49th in per capita income. Because the costs to comply with the pending legislation are substantial and because the installation of scrubbers in the case of units like those in Arkansas could result in "overcontrol" of SO2 emissions, the Arkansas Public Service Commission (APSC) has been quite active throughout this legislative process. Specifically, the APSC has worked with the National Association of Regulatory Utility Commissioners to present testimony to the affected Committees and with the Arkansas Congressional delegation to communicate and to bolster support for Arkansas' position. Additionally, the APSC has sent letters to Senate and House Committee members to inform them of our views. Now, I am asking that the administration act to avoid a gross inequity to the ratepayers of Arkansas. Specifically, I propose an alternative to the imposition of the 1985 SO2 emissions rate or tonnage level. I would suggest that those plants currently emitting less than 1.2 lbs/mmbtu of S02 be allowed to emit at that rate or their EPA permit level, whichever is lower. This amendment would be consistent with the fact that all of the Arkansas units and many of those elsewhere were issued EPA permits under New Source Performance Standards for S02 emissions. If the pending legislation were amended to allow for this provision, there is no reason why the concept of an emissions cap would have to be compromised; on the other hand, those units meeting or exceeding the proposed SO2 emissions standard would not be penalized by having to incur further costs for further clean-up. Of additional concern to me is the fact that the emissions trading program as proposed in the pending legislation pertains only to "affected sources, that is, those plants designated in the legislation itself. While no one would deny that the clean-up of these "affected sources" will be expensive and that the affected utilities should, therefore, receive emissions allowances to sell to help offset that expense, it does seem unreasonable that utilities like those in Arkansas, which have already made the investment in long-term low-sulfur coal contracts for their units, will receive no emissions allowances, even though their emissions rates already are below the proposed national standard of 1.2 lbs/mmbtu of S02. In fact, after the year 2000, the utilities in Arkansas will have to purchase emissions allowances either from utilities owning "affected sources" or from EPA (under S. 1630) in order to build coal-fired generation to accommodate load growth due to economic growth. The cost of these allowances, whether market-based or the proposed EPA set price of $1500 per ton (S. 1630), will be borne by Arkansas ratepayers in addition to the compliance costs outlined above. What I would like to propose as an amendment to the emissions trading program in the pending legislation is that emissions allowances be granted to all units currently emitting at a rate lower than 1.2 lbs/mmbtu for S02, as well as the granting of allowances to the "affected sources" designated in the legislation. What this would insure is that utilities like those in Arkansas would receive credit for steps they have already taken to achieve compliance with their current EPA permit level for S02. This amendment would create a level playing field for emissions trading which would not favor those utilities complying with clean air standards in the future, rather than those which have already complied. Furthermore, it would be reasonable to grant allowances to those units currently in compliance at a lower rate than those on the "affected sources" list, so that the so-called "dirty" units would have more allowances to trade in the future to offset their compliance costs. I hope that you will consider and give your support to the changes I have suggested to the pending clean air legislation. I consider these changes to be of the utmost importance to insure that the costs of creating a cleaner environment are shared as equitably as possible and to insure that undue financial burdens are not placed on states like Arkansas which have already done their share for clean air. We firmly believe that any form of management of our National Forest will cost the government more than it returns. However, Forest Service timber sales have a high impact on the communities in the areas where they are located. Schools, Roads, Tax struct- ures and Jobs are just a few. I know it is hard for some Congressmen from other states to understand the impact that these Forest Service timber sales have on our communities, our families and our state. We do not believe that the Montana Wilderness Society has been truth- full in their lobbying effort in Washington. We 'are willing to help prove that Montana forests are being managed improperly, if management plans do not include timber sales. Remember the forest fires of 1988, over 90% of the areas burned were not timber harvest areas. They were areas of other management description, Wilderness. National Parks, Wildlife Management etc. We all love the diversity our National Forest provides. However, we are able to enjoy these things because of our jobs and some of these jobs are narvest- ing timber and manufacturing various wood products from National Forest timber sales. To assist you with telling our very important message to other Congress- men, we will provide tours of our job sites and manufacturing facilities at your request. If we work together our families can plan for the future, which will provide strong communities and a stable economy. As it stands today we are very uncertain. In exercising this authority, the Secretary is required to consult with the Director of the Fish and Wildlife Service. I understand that a Memorandum of Understanding between the Secretary of Agriculture and the Director of Fish and Wildlife Service has been drafted and is currently under review at the White House. I am writing to invite your assistance in two regards. First, I want to assure that the costs of protecting wetlands do not fall unduly upon the agricultural community. Secondly, as the plant- ing season fast approaches, it is critical that an inter-agency understanding is reached in a timely manner. I fully endorse the President's initiatives to protect our valuable wetland resources. In enacting this initiative, however, I am concerned with the needs and fair treatment of the farmers of Maine. Wetlands protection is an important objective with wide public support. It would be unfair, however, to expect farmers to bear a disproportionate burden in achieving this goal. Accordingly, I would like to stress the need to effect a Memorandum of Understanding that is equitable to farmers. Also, until a final Memorandum of Understanding is adopted, FmHA-inventoried land will continue to be an economic drain to the federal government as well as a source of frustration to Maine farmers who hope to acquire FmHA-inventoried land for this growing season. Docket #A-89-01 Room M 1500 Air Docket (LE-131) Dear Mr. Sununu: Our town is one of fifteen similar communities in New Hampshire that has a small incinerator which is used to dispose of household trash. The incinerator generates less than one ton of ash from approximately four tons of trash per day. Present regulations apply to two categories: Incinerators that handle under 50 tons of trash per day and those that handle over 50 tons per day. The proposed changes in the regulations call incinerators handling under 250 tons per day "small" but would affect all incinerators no matter how much trash they handle. We can understand the need to apply stricter air emission standards to the larger incinerators, but there must be a cutoff point below which small incinerators such as ours and the majority of the other small incinerators in our state would be exempt from the proposed standards. Perhaps a cutoff point of less that 25 tons per day (or even 10 tons per day) would be appropriate. Ours and most other incinerators in this state already have afterburners that cleanse the smoke before it reaches the atmosphere. If you combine this with the low trash-per-day tonnage, it is not possible that our incinerators are contributing to air pollution any more than wood stoves, automobile exhaust, forest fires, volcanic eruptions, etc. The proposed air emission standards and controls will pose such a financial burden to our taxpayers that it might well end our local solid waste management capability. The only people that will be able to comply with the new regulations are the mass-burn waste-to-energy facilities who can afford it. It appears that the Environmental Protection Agency is pursuing a policy of forcing small communities such as ours to shut down and ship our trash to the mass-burn facilities. Just who is the EPA trying to protect, anyway? In conclusion, we ask that you question the need for these new regulations as they would apply to our small incinerators and support an exemption status for incinerators that handle less than 25 tons per day.
