Dear Mr. Sununu:
Re: Memorandum of Agreement (MOA) between the Environmental Protection Agency
(EPA) and the Department of the Army concerning the determination of
mitigation under the Clean Water Act, Section 404 (b) (1) guidelines.
As requested by Secretary of Transportation Samuel K. Skinner, the Nebraska
Department of Roads is pleased to comment on the above MOA. This letter
clarifies and replaces our January 24 letter to you on the same subject.
This is an important issue in Nebraska and while we don't argue, in
principle, with the "no net loss of wetlands" goal, we feel that the methodology
could be improved. With this in mind, there are two points in the MOA on. which
we wish to comment.
1. Section II (B) "This determination shall not be based upon
characteristics of the proposed project such as need, societal value, or
the nature or investment objectives of the project's sponsor. Comment:
The concept of weighing the public benefit and other project impacts in
arriving at mitigation strategies is excluded from consideration. We
believe that these points should be included.
2. Section III(D): "For projects to be permitted involving mitigation
with higher levels of scientific uncertainty, such as some forms of
compensatory mitigation, long-term monitoring, reporting, and
potential remedial action should be required." Comment: Monitoring
should normally be limited to the verification that the wetland
hydrology is present and that wetland vegetation takes hold. Natural
wetlands go through succession and man-made wetlands should be
expected to go through the same. Care should be taken to avoid the
over-use of monitoring.
Recently, Governor Orr corresponded with President Bush and it is her
position that the MOA should not be further delayed while the technical details
and objections of the states are being worked out. This letter should be viewed
as consistent with Governor Orr's prior communication and as a statement
regarding the substance of the 404 (b) (1) guidelines.

Dear John:
I understand that Joe Biden and Strom Thurmond have
written the President in support of the nomination of Michael
Gelacek to be a member of the United States Sentencing
Commission. I want to join the "chorus of approval" on that
one!
When I came to the Senate, Mike was a Staff Director of
the Criminal Law Subcommittee. He was one of those yeoman
staffers who quietly -- and in a fair, bi-partisan manner --
assisted in the crafting of some of the major anti-crime
legislation which was enacted in the early 1980's. From 1980
- 1983, during those halcyon days of Republican control of
the Senate, Mike was Minority Staff Director of the Senate
Judiciary Committee. Since 1985, Mike has been in private
practice in Washington with the McNair firm. He has had a
government relations practice and has represented various
business interests in matters pending before Congress,
including traditionally conservative clients like those in
the insurance and banking industries.
I am assured by folks whom I greatly trust that this guy
is no "partisan bomb thrower." He has also been a prosecutor
and a defense attorney. I believe he would be a fair and
balanced member of the Commission and would be a fine choice
for an available Democratic slot.
Furthermore, with the strong endorsement of the Chairman
and the Ranking Member, it would appear that his confirmation
would not cause problems.

COMMENTS ON THE MEMORANDUM OF AGREEMENT
CONCERNING THE WETLANDS PERMIT PROCESS
THE MOA, AS WRITTEN AND ADOPTED, IS BAD PUBLIC POLICY AND ILLEGAL
1.
The MOA is bad public policy because it will require the
Corps to reject permit applications for projects which
serve critical needs of local communities and provide
substantial benefits in terms of expanding our wetlands
resources.
As written, the MOA will prohibit construction of
badly needed roads, housing, and other facilities,
as well as eliminate jobs, simply because wetlands
permit review must focus only on whether there is a
practicable alternative nonwetland site (as the
term is ambiguously defined, but often broadly
applied). The nonwetland site may provide few
socio-economic benefits while construction on the
wetlands site may be absolutely essential to a
local community, and the wetlands may be
nonfunctional or of little value; yet, the
sequenced decisionmaking model could require permit
denial in such circumstances.
As written, the MOA eliminates or severely impairs
a "market" approach to expand our wetlands
resources and achieve "no net loss." Given the
great importance of replacing the enormous amount
of wetland acreage that has been destroyed (which
is widely known, but rarely stated, to be due
largely to agricultural activities), we cannot rely
primarily on governmental funds to buy and restore
wetlands. The private sector must do its share,
and the wetlands permit process should contain
incentives for developers to enhance our nation's
wetlands and help expand our wetlands resources.
The MOA removes the incentives contained in the
current permit process to promote private sector
participation in achieving the "no net loss" goal.
2.
The MOA is illegal. As has been described in detail in
a legal memorandum provided by us to a number of key
governmental officials, the MOA violates current
wetlands permit regulations, notice and comment
rulemaking requirements of the Administrative Procedure
Act, and other established principles of administrative
law. Indeed, the Section 404 (b) (1) Guidelines, issued
by the EPA and Corps, specifically provide that "[n]o
modification of the basic application, meaning, or
intent of the Guidelines will be made without rulemaking
by the Administrator under the Administrative Procedure
Act." 40 C.F.R. § 230.10(d). Adoption and
implementation of the MOA on January 31, 1990, without
rulemaking, clearly violates this provision.
A PIECEMEAL AND SECRETIVE APPROACH TO ADDRESS PROBLEMS IN THE
WETLANDS PERMIT PROCESS IS COUNTERPRODUCTIVE AND INAPPROPRIATE
1.
The wetlands permit process had long been recognized as
perhaps the most convoluted and uncertain of any federal
program. In a policy paper which will be available
shortly, we have identified some of the key changes
which should be made in the wetlands permit program.
Rather than acting precipitously, the government should
conduct a review of all problems in the wetlands permit
process, and at least attempt to find a comprehensive
and appropriate solution to them.
2.
We do not understand why the MOA, which may have such a
radical impact on wetlands permit decisionmaking, is
being issued before the President's Domestic Policy
Council Interagency Wetlands Task Force has had the
opportunity to consider changes to the wetlands permit
process.
3.
By affording interested members of the public an
opportunity to provide factual information and data on
the adverse environmental and economic impacts which
will result from the MOA as presently written, the
government is more apt to find more effective solutions
to the serious problems of curbing the losses of
wetlands acreage and establishing a more fair and
rational permit system.
AT A MINIMUM, THE MOA SHOULD BE MODIFIED so THAT IT CONTAINS
WORKABLE AND FAIR STANDARDS FOR WETLANDS PERMIT DECISIONMAKING
1.
The so-called "sequencing" approach, in which analysis
of practicable nonwetland alternative sites becomes the
initial and (in most cases) dispositive factor of
whether a project may go forward, should not be applied
in all circumstances.. When a permit applicant can show
that a project will provide significant socio-economic
benefits or offers to provide substantial environmental
benefits by virtue of compensatory mitigation (and
monitoring measures to ensure that mitigation measures
- 2 -
work), the Corps should not be required to deny a permit
simply because the sequenced decisionmaking model
ignores these factors and dictates this result. Rather,
in circumstances in which a permit applicant can make
such a showing, the Corps of Engineers should be
required to consider socio-economic benefits to a local
community, off-setting environmental benefits of the
project, and other public interest considerations
(including the value and function of the wetlands area)
in determining whether a wetlands permit should issue.
2.
The Corps should be given sole authority to make the
purely economic determination of whether an alternative
nonwetland site is available and feasible given project
purposes, and the Corps should be required to make this
economic determination at the outset of the permit
process within certain time constraints. The Corps has
the expertise to evaluate economic issues, and EPA could
then assist the Corps in assessing the comparative
environmental impacts at the proposed site and
practicable alternatives to it.
3.
The analysis of the availability of nonwetland
alternative sites should be determined as of the time
the applicant submitted its first application for a
permit or variance in connection with a proposed
project, rather than at the time of market entry. The
so-called "market entry" approach, in which all
potential nonwetland sites when the developer entered
the market are considered available, creates a nebulous
and unworkable standard.
4.
The Corps should be required to make wetlands permit
decisions in a timely manner, preferably within 120 days
after receipt of a standard permit application. The EPA
should be required to publish a notice of objection to
the issuance of a permit at least 30 days prior to the
Corps' deadline.
5.
The MOA should contain a mechanism to resolve disputes
between the Corps and EPA with respect to wetlands
permit issues.

Re: Memorandum of Agreement (MOA) between the Environmental Protection Agency
(EPA) and the Department of the Army concerning the determination of
mitigation under the Clean Water Act, Section 404 (b) (1) guidelines.
As requested by Secretary of Transportation Samuel K. Skinner, the Nebraska
Department of Roads is pleased to comment on the above MOA. This is an important
issue in Nebraska and while we don't argue, in principle, with the "no net loss of
wetlands" goal, we feel that the methodology being proposed appears less than
desirable and not in the best interest of our aggressive state highway program.
With this in mind, there are three main points in the MOA on which we wish to
comment.
1. Section II (B): "This determination shall not be based upon
characteristics of the proposed project such as need, societal value, or
the nature or investment objectives of the project's sponsor." Comment:
The concept of weighing the public benefit and other project impacts in
arriving at mitigation strategies is totally excluded from
consideration. We believe that this is unreasonable and unrealistic.
2. Section III (C): "Other reviews, such as NEPA (National Environmental
Policy Act of 1969) and the Corps' (of Engineers) public interest
review, cannot be used to nullify any guidelines requirements or to
justify less rigorous guidelines evaluations." Comment: This
contradicts the Interagency Task Force work concerning the need to
integrate the Section 404 and NEPA processes. If the NEPA review of
alternatives is to be thrown out under Section 404, and the only
consideration is relative to wetlands impacts, then a sham is being made
of the NEPA process.
3. Section III(D): "For projects to be permitted involving mitigation with
higher levels of scientific uncertainty, such as some forms of
compensatory mitigation, long-term monitoring, reporting, and potential
remedial action should be required. Comment: Monitoring should be
adequate to verify that the wetland hydrology is present and that
wetland vegetation takes hold. Natural wetlands go through succession
and man-made wetlands should be expected to go through the same.
Over-use of monitoring could result in years of fruitless data gathering
and commitments to actively manage mitigation areas, whereas they should
be allowed to go through natural succession.

Dear Governor Sununu:
The National Wetlands Coalition was established early last fall to work constructively
with the Administration and the Congress to implement the recommendations of the National
Wetlands Policy Forum, including the goal of "no overall net loss of wetlands". The Coalition
consists of public and private entities, including landowners, municipalities and Native
American groups, that pursue diverse business and governmental activities, some of which
occur in wetlands areas. A copy of our Coalition presentation document is attached.
We have reviewed the Memorandum of Agreement between the Corps of Engineers and
the Environmental Protection Agency regarding wetlands mitigation policy in light of the
overall effort to develop a national wetlands policy. We believe that several realities must be
addressed in the development of that policy.
First, the national goal of "no overall net loss" of wetlands must bei defined,
including the scope of lands and activities to be encompassed by that goal.
Second, with 74% of the nation's existing wetlands being privately owned, the
national wetlands policy must be developed with the active participation of the
private sector.
Third, because the ownership of wetlands is so highly concentrated in the private
sector and only a small portion of wetlands activities are currently subject to
regulation, national wetlands policy cannot rely primarily upon regulatory
restriction on wetlands use. Non-regulatory means, such as incentives for
conservation, restoration and enhancement activities must be critical elements of
the national program.
Fourth, because many jurisdictional wetlands areas in our nation exist in the very
areas where large portions of our population live and work, any land use
regulatory aspects of the national wetlands policy must be constructed carefully
to avoid unintended and unnecessary barriers to economic growth and the
development of our nation's infrastructure needs.
The National Wetlands Coalition supports the President's wetlands conservation
objectives, and believes that the InterAgency Task Force can develop a creative policy that
properly balances the objectives of wetlands protection and continued national economic
prosperity. We are concerned that the Memorandum of Agreement contains provisions that
may actually hinder the achievement of the President's wetlands goal and may unnecessarily

impede both economic growth and the development of services that are necessary for our
growing population. The attached comments on the MOA set forth our observations in this
regard more fully.
We respectfully request that the Memorandum of Agreement be withdrawn and made
part of the InterAgency Task Force effort to develop overall national wetlands policy. We
request further that the InterAgency Task Force immediately commence the process of
obtaining public comment and participation in the development of the national wetlands plan,
including the issues of wetlands mitigation policy and wetlands use regulation. One mechanism
that might be particularly useful in this process would be a series of regional hearings by the
InterAgency Task Force that could help to educate both the public and the Task Force on this
subject and identify various regional approaches to wetlands protection. Even if the judgment
is made that the Memorandum of Agreement should become effective in the near term, we
encourage the Task Force to begin a public dialogue on wetlands policy that would include the
issues addressed in the Memorandum of Agreement and regional public hearings.
Certain activities of both the private and public sector of our nation have been identified
as part of the wetlands problem. Thus, the private sector and those portions of the public
sector engaged in activities in wetlands must become part of the solution if the President's goal
is to be achieved. The National Wetlands Coalition would welcome the opportunity to
participate actively and constructively in the process of developing our national wetlands plan.

On January R, 1990, we met to discuss coordinated strategies for
the legislation that will be introduced by the civil rights
community to deal with the U.S. Supreme Court's decisions in
Patterson, Ward's Cove and Martin V. Wilkes.
Today I met with Minority Leader Bob Michel and Minority Whip Newt
Gingrich. Frustration was expressed over the secrecy surrounding
the proposed civil rights legislation. We will be sending a letter
to Ralph Neas of the Leadership Conference on Civil Rights to
express our disappointment over being unable to provide bipartisan
input into the proposed legislation and to invite him to sit down
with us and give his views on possible legislative solutions.
In addition, I stressed the need for coordinated efforts by the
leadership in responding to the proposed civil rights legislation.
We also discussed the possibilities of proposing alternative
"empowerment" legislation and other legislative solutions.
At this point, I would welcome your further input and look forward
to hearing the Administration's views.
In addition to the issues that we discussed at our earlier meeting,
it appears that the Freedom of Choice Act, H.R. 3700 which would
codify Roe V. Wade in a federal statute will be added to the
Subcommittee's agenda (see enclosed article).

wearing the hat of Chairman of the Hudson Institute.
I am writing to invite you to be a keynote luncheon speaker at the
annual Conference of the Asosciation for Investment Management and
Research (AIMR) on either Monday, May 21 or Tuesday, May 22, in New
York City. The audience would be somewhere between 1,000-2,000 people,
representing a cross section of money-managers and security analysts
from across the U.S. (with a sprinkling of foreign participants).
Press would be present. This audience, in my view, would represent
an influential cross section of the financial community.
We would, of course, leave the subject up to you. In my view, either
an update on the Administration (general) or a specific topic aimed

Enclosed is a letter from NEWSWEEK that just arrived last
week (!) -- finally, at long last, replying to my complaint that
the magazine had falsely stated that I opposed John Tower's
nomination. It took a long time for NEWSWEEK to admit its error,
didn't it?
The only reason this matters any more is that I want you and
the President to know that I loyally supported him on this issue
which split conservatives. When a group of conservatives
supporting the President on this issue were invited to the White
House, I was not included -- presumably because the persons making
up the list in the White House were misled by the press into
pigeon-holing me in the wrong slot.

weekend, and they have gone into orbit about Moynthan's Social
Security proposal. They see this as a way of making it look like
the President is against wage-earners. I believe that an aggres-
sive move by the President for a generous Child Tax Credit (in
line with my 4-page letter of January 16) would be the answer to:
(1) Moynihan, (2) ABC/Hawkins/Downey, (3) the "peace dividend,"
and (4) minimum wage increases.

Dear Mr. Sununu,
I am writing to express my concern regarding the direction in
which the Federal Regulatory Agencies are proceeding in wetland
protection. The Arkansas Highway and Transportation Department
is acknowledged nationally as a leader in the protection of the
environment. The Department has' received this reputation while
achieving its primary goal of providing an excellent transpor-
tation system for the citizens of Arkansas.
Strict adherence to the Memorandum of Agreement between the
Department of the Army and the Environmental Protection Agency
concerning mitigation could have a negative effect on protection
of the environment, including wetlands. Had this Memorandum
been in effect in 1979, the Department would not have acquired
175 acres of bottomland hardwood wetlands in conjunction with
the construction of U.S. 67 and would not have conducted a ten
year study of the effects of highway fill on bottomland hard-
woods. This monitoring program, a condition of the 404 permit,
will provide ten years of data and is expected to be the major
baseline research investigation on bottomland hardwoods wetlands
in the nation. Another project of significant environmental
consequence and benefit which would have been affected by the
proposed MOA is the Bayou Bartholomew Expressway in Jefferson
County. This project resulted in the destruction of 26 acres of
natural wetlands but through consultation and cooperation with
the resources and regulating agencies, approximately 100 acres
of wetlands will be created and enhanced and 158 acres of
existing bottomlands hardwood/wetlands will be purchased. The
mitigation plan to lessen the wetland and flooding impacts made
the selected alternative acceptable.

You a certainly aware of the long-standing controversy
surrounding the Delaney Clause and its application in the case
of Red Dye #3.
It is my understanding that the Administration, while
admitting that Red #3 poses absolutely no health problem, intends
to delist the color in an attempt to "pressure Congress to repeal
Delaney. " As a Member of Congress long involved in that very
effort, let me assure you the effect would be just the opposite.
By reason of demographics, or for some other reason, it just so
happens that nearly all of those Members who would be politically
damaged by a delisting of Red #3 are also those who are already
supportive of Delaney changes. By delisting the dye now, you
don't win a single vote in favor of Delaney changes, but you just
might lose a few.
Several Republicans in the Senate and House have expressed
an interest in meeting with you in the next day or two to discuss
this matter further. If you could accomodate such a meeting it
would be greatly appreciated.

I am writing in regard to the upcoming decision to be made
on the listing of the coloring FD&C Red No. 3.
It is my understanding that the Secretary of the
Department of Health and Human Services, Louis W. Sullivan,
M.D., may decide to discontinue the provisionally listed uses
of FD&C Red No. 3 coloring in drugs and cosmetics. I am
alarmed that this action will have far reaching implications
for the agricultural community, because this coloring is used
in the processing of a number of products, particularly canned
fruit. Thus, the loss of this coloring could be extremely
detrimental for cherry, peach, pear, grape, and pineapple
growers. Add to this recent events such as the Alar
controversy in apples, tampered Chilean grapes, as well as
other food safety issues, and it becomes increasingly apparent
that farmers are under growing pressure which unfairly impacts
their livelihood.
It is for these reasons that I am urging you to extend the
provisional listing of FD&C Red No. 3. This will ensure that
the public will remain confident in the already proven safe use
of this product.

Just a short note as a fellow American to express my deepest appreciation
to the President, you and your staff for a job well done in Panama.
In a swiftly executed military deployment aptly called "Operation Just
Cause", our American soldiers and Marines protected the lives of Americans,
defended the vital Panama Canal, restored a democratically elected goverment
in Panama and captured the Drug Lord Noriega so that he can be brought to
justice.

Technology development has become one of the most attractive
and popular elements of state economic development strategies.
Significant results may be hard to come by, however.
Therefore, on behalf of the Council I am pleased to send you
a copy of its latest report: State Technology Programs - A
eliminary Analysis of Lessons Learned by CSPA Associate
David Osborne.
The
enort looks at what we know and don't
know about the efficacy of state technology programs.
Michigan Governor James J. Blanchard points out in his
