Sununu: Without any desire to divert the administration's attention from its management of the Middle East crisis (which management I applaud), I would like to call your personal attention to the attached recommendation of Dr. E. W. (Ted) Webster for a Presidential appointment to the Nuclear Regulatory Commission. I believe that you will remember the distinguished Dr. Webster by his service in Massachusetts, as well as in Washington. To me, the appointment of Dr. Webster would indeed be related in an important way to the events of the Middle East. With the kinds of technical judgements required by an NRC Commissioner, it is important to have Commissioners who have an understanding in depth not only of the physical, but also of the biological, aspects of safe regulation of nuclear energy and its important byproducts used in research and medicine. The safe, but reasonable, regulation of nuclear energy and its byproducts is important in re-establishing safe nuclear energy as an option to avoid not only dependence on oil, but also to eventually reduce the burning of fossile fuels that contaminate the environment and endanger our planet. It is also important to our children and future generations that we conserve fossile materials for their future value in producing chemicals of importance in medicine and industry. Dr. Webster has the ideal background of knowledge and understanding for making the right decisions about nuclear energy and byproducts, and for helping the administration and the public put biological risks from human activities in proper perspective. Sununu Chief of Staff to the President The White House 1600 Pennsylvania Avenue Washington, D.C. 20500 Dear Mr. Sununu: It would be presumptuous of me to assume that after breathing Montana air for three weeks I have a clear perspective of fast moving world events. However, it appears, now that we have entered the fray, we must accomplish the ultimate objective as swiftly as it is deemed we have sufficient aircraft presence commensurate with adequate land force deployment. We must destroy Hussein and his regime. The risks of doing so cuts both ways. Failure to do SQ cuts even deeper. If this objective is to be met, unlike the advice of so many experts, I believe time is not our ally. Whatever advantage we gain through a united but time consuming blockade will ultimately fade in the desert sun. Whatever fragile alliance President Bush has remarkably achieved will soon die of desert thirst. Our own media will, in time, become an additional burden now that we face another hostage ordeal. Granted, our nation's right to act in pursuit of its legitimate interests should not become hostage to hostage taking but it will and probably already has. Though initially we came as defenders, in time, our presence will be likened to that of an unwanted conqueror. Incongruous as it may be, Saudi Arabia is now de facto our 51st state. We must not indulge Hussein beyond our assured ability to take him out from above. As with Hitler, we have dire historical precedence of the consequences of appeasement. Furthermore, Hussein has given the world sufficient moral and legal provocation and basis. We wait at our peril, not only because the odds favor our becoming enmeshed in his spreading web of propaganda, deceit and cunning, but also because the likelihood increases that we cannot avoid being scorched by the searing cross winds of desert politics Mideast style. I have listened to the news reports, interviews and advice of our array of expert guests. By and large, they come across as left brain thinkers. I hope the Administration will take a chapter Sununu from TAO and go with the fluid thinking of whole brain advisors. Analytical overload far too often leads to paralysis. A peripheral benefit can also be the forging of a rational long term fiscal policy. If President Bush will hang tough in this area as well, he would have the backing and blessings of the American people. He sounded that way at last week's press conference. Past this ordeal will come a whole new set of thorny issues and problems, least of which will be the due bill from our Middle East supporters who no doubt will renew their arguing that we disavow our support for Israel. Washington, DC 20500 Dear Honorable Sununu: The membership of the Pennsylvania Thoracic Society strongly urges you to oppose any deficit reduction plan that would force pharmacists to switch Medicaid patients to different drugs than those prescribed by their physicians, or which is otherwise based on the erroneous premise that chemically different pharmaceutical products can be used interchangeably. Our concerns are prompted by the Office of Management and Budget plan, presented to the budget "summit" on June 20, that would attempt to save money in Medicaid through the practice of "therapeutic substitution"--the switching of a patient's prescription to a different chemical from the one prescribed, without the knowledge or consent of the patient's physician. Acknowledging the danger of this practice, the OMB proposal would actually hold pharmacists harmless for patient injury or death caused by a drug switch. Distinct pharmaceutical products, even though they may belong to the same therapeutic class, are not routinely interchangeable. Rather, such drugs are chemically different and are not equally safe and effective for each patient. We refer you to the recent position statement on "Therapeutic Substitution and Formulary Systems" published by the American College of Physicians (Annals of Internal Medicine, Volume 113, Number 2, pp 160-163, 15 July 1990). In summary, the statement concludes: 1. Therapeutic substitution is more complex than generic substitution. These differences may involve the mode and extent of action, adverse effects, and potential interactions with other drugs. 2. Determinations of therapeutic equivalence often depend on clinical studies that are of limited size and thus fail to pick up idiosyncratic drug reactions, that underrepresent certain racial or age groups, or that exclude patients with underlying conditions that make them more prone to adverse reactions. Therapeutic ineffectiveness and adverse effects among the elderly are numerous. 3. Therapeutic substitution is appropriate only in hospitals with an effectively functioning formulary system and Pharmacy and Therapeutics Committee. Physicians should recognize that on many occasions and in some institutions, therapeutic alternatives should not be used. The key determinants regarding the appropriateness of therapeutic substitution is the effectiveness of the formulary system and the Pharmacy and Therapeutics Committee. 4. Therapeutic substitution jeopardizes patient management when immediate prior consent is not obtained from the authorized prescriber and when documentation of substitutions is untimely or improper. Such practices must not be permitted. Physicians are ultimately responsible for the consequences of patient treatment. This necessitates immediate prior authorization from the prescribing physician before the administration of a therapeutic alternate. 5. The practice of therapeutic substitution may be acceptable in ambulatory settings that meet standards comparable to those of institutional settings. Presently, Illinois and Wisconsin explicitly prohibit therapeutic substitution outside of acute care settings. Other states vary in their restrictions on therapeutic substitution in nonacute care settings. The finding that immediate prior notification of therapeutic substitutions is not provided to physicians in most instances is disturbing. I want to express WMAL's strong objections to this tax proposal. Four percent of this station's gross revenue is a significant amount and would be imposed on us at a time when local stations are facing a stagnant advertising market. Economic projections do not suggest that this market will improve in the near future, and, as you know, advertising is our sole source of revenue. Radio stations provide news and public service programming to communities throughout this nation in exchange for govenment licenses to use the airwaves. We will continue to live up to these responsibilities to serve our local community, but we must voice our strong objections to a tax that singles out our industry with such Draconian results. I urge you to oppose this spectrum tax and to communicate that opposition to the Admininstration and to all those involved in the budget negotiations. As you may be aware, I became the Republican nominee for Congress by defeating the incumbent, Buz Lukens, and the former congressman, Tom Kindness, in a hard fought primary. The primary campaign left me with a debt of more than $155,000. After the primary election, I received many congratulations and many assurances that the 8th Congressional District of Ohio was a safe Republican seat and a November victory would come easily, even though this was now an open seat. However, no one gave my Democrat opponent that news. The state and local Democrat organizations see their first opportunity in a number of years to claim the 8th District seat and are going all out to provide my opponent with support. Additionally, my opponent has a very well known and well liked relative who happens to be a popular television actor on the NBC series "Cheers". Already this relative has arranged for thousands of Hollywood dollars to be given to my opponent's campaign. Recently, he also completed a one week tour of the district, raising money and earning media for my opponent. The potential for more Hollywood money coupled with the strong support my opponent is receiving from labor organizations is very bothersome to me. Which brings me to our perception problem. Through my own investigations and pursuit of payment (I have not received one formal piece of information from the Army explaining the delay) I was informed that the bill has been held up because of an error that was made by the Army. The officer in charge of planning the conference did not follow necessary procedures in obtaining a contract. The Fox Ridge Resort has been denied payment of $32,264.82 for eighteen months through no fault of ours. Bethlehem's reported net income of $22 million for the Second Quarter and $43 million for the First Half was 74% lower than our net income for Second Quarter 1989 and 71% lower than First Half 1989. The decline in net income results from lower steel shipments and prices and from higher operating costs principally due to planned outages at our Sparrows Point, Maryland plant. Bethlehem continues to be a company in transition and certain sections of the Report are marked to indicate areas of progress and concern. 1. Lower Shipments. Steel shipments were approximately 13% and 16% lower in the second quarter and first half of 1990 than in the year earlier periods, and our raw steel production declined to 65% and 67% of capacity from 81% and 82% last year, mainly due to the planned outages. 2. Competitive Pressures. Severe market and competitive pressures continue to affect our (a) Rail Products and Pipe Division, (b) Bar, Rod and Wire Division and (c) Structural Products Division. - 2 - Higher Costs. Production costs at steelmaking operations were reflecting planned outages for relining a blast furnace and Modernizing a hot strip mill, and for accelerated coke oven repairs. 4. Steel Related Operations. Operating results improved at our Baltimore Marine and BethForge Divisions during the second quarter and first half of 1990 as we continued to implement the restructuring actions that were initiated in 1989. Our Freight Car Division reported increased operating income during the second quarter and first half of this year compared to the year-ago periods. 5. Liquidity. Our cash and cash equivalents declined to $281 million at the end of the second quarter from $368 million at the end of the first quarter. The decline resulted from reduced cash provided from operating activities, higher levels of capital spending and continued pension funding. 6. Capital Expenditures. Capital expenditures were $124 million during the second quarter and $224 million for the first half of the year. We currently estimate that for 1990 capital spending will be about $500 million compared to $421 million last year. During the second quarter, we selected the suppliers for our two new hot-dip coating lines to be built at Sparrows Point and Burns Harbor, at an estimated $300 million in capital costs for the two lines. - 3 - 7. Pensions. We contributed an additional $70 million to our pension fund during the second quarter for a total of $162 million this year. Additional contributions during the remainder of the year will be considered as appropriate. 8. Clean Air Legislation. Legislation is currently pending in Congress that would impose more stringent environmental control requirements under the Clean Air Act. Certain features of the bill concerning air toxics are not based on sound scientific data and available technology and, if enacted, could impose significant, unwarranted costs on domestic steelmakers. We continue to work towards reasonable legislation that would not be a major obstacle to maintaining international competitiveness. 9. Outlook. We estimate that we will ship about the same amount of steel in the third quarter as in the second quarter. However, third quarter results will be adversely affected by the planned hot strip mill outage in August and continued coke oven repairs at Sparrows Point. The amendment would allow U.S. overseas military personnel and their dependents to obtain all reproductive health services permitted under U.S. law at military medical facilities. In the case of abortion services, the individual shall be required to pay for the full cost, including indirect costs of the service. Military facilities are clearly operated by federal funds. Current law dictates that no federal funds appropriated to the Department of Defense shall be used to pay for abortions. This law is elaborated in the June, 1988 DOD memorandum and states that performing "pre-paid" abortions in military treatment facilities would not be authorized after September 30, 1988. We also understand that there is an attempt underway to mute this issue before it reaches the Senate floor by nullifying the 1988 DOD directive, thus leaving it to the military hospitals and facilities to dictate their own policy. We find this contradictory to legislative history and an unwise reversal of an established pro- life policy clearly permissible under the principles established in Webster VS. Washington, D.C. 20500 Dear Mr. Sununu: The National Grange, this nation's oldest general farm organization which represents 325,000 members in 42 states and has 7,000 local chapters across the country, is deeply concerned about the size of the federal budget deficit. Enclosed please find a letter we sent to the President on May 10, 1990, in which we set forth the specific policies that were adopted at the National Grange's 123rd Annual Convention regarding the federal government's fiscal responsibilities and the federal deficit. As you, and the other members of the Budget Summit, are searching for ways to reduce the 1991 federal deficit in accordance with the Gramm- Rudman-Hollings' mandate of $74 billion, we respectfully request that you do not include an increase in the federal motor fuel excise tax in your recommendations. Unlike the current gas tax revenue, which is earmarked for the federal Highway Trust Fund, the new taxes would raise revenue for the general fund. The National Grange is strongly opposed to diverting highway user fees for reducing the federal deficit. We base our opposition on the following criteria: - A deficit reduction fuel tax will seriously endanger the funding mechanism for both federal and state highway programs. Once the "trust" is broken in our dedicated highway funding mechanisms, there is no going back. We already know that this country's highways need more funding. Many states are already raising fuel taxes to fund their current highway programs. If the federal government raises fuel taxes for deficit reduction, it will be even more difficult to generate support for future fuel taxes that are needed for highway programs, particularly at the state level. Gasoline use varies widely depending on the geographical location. Residents of rural and western states have to travel much farther to get to work, obtain needed services, or shop than do people who live in more urbanized areas. A deficit reduction fuel tax would make different people pay different amounts of taxes based on where they live rather than on their ability to pay. Like all excise taxes, a deficit reduction fuel tax would be regressive and would hit the poor much harder than would other forms July 24, 1990 Page 2 of taxation. According to the Congressional Budget Office, families who earn less than $5,000 annually pay more than 1.6% of their income in gasoline excise taxes compared to only 0.2% of those families who earn over $50,000 per year. Tourism is one of the major sources of state revenue throughout the nation. Eighty percent of vacation travel in the United States is by private vehicle. The travel industry has projected a $2 billion decline in tourism as a result of a 10 cents per gallon tax increase. The AAA commissioned Wharton Economic Forecasting Associates to study the economic impact of the major gasoline tax proposals. The study concluded that the near-term costs of such a gasoline tax are exceedingly negative. Thousands of people would lose their jobs, the amount of income tax revenues would be reduced by billions, auto production would be reduced, construction of new housing would decline, personal savings would be lowered and consumer prices would increase. We respectfully request that the Budget Summit not recommend an increase in the federal motor fuel excise tax as a way to reduce the federal deficit. Study after study has pointed out the negative impact that such an increase would have on this nation's economy. Please do not rely on a "quick fix" of "gas pump economics" to correct the more fundamental, underlying problems of our fiscal and monetary policies that have created the huge federal deficit. Justice Gonzalez is an experienced conservative jurist, affiliated with the Demo- cratic Party, but with strong electoral and Republican support in Texas. The following is a brief, but representative summary of his judicial philosophy. The opinions to which I refer have been attached for your convenience. Strict Constructionism Justice Gonzalez' dissenting opinion in Lucas V. United States speaks for itself. He begins by emphasizing that consti- tutional review of legislative enactments starts with a strong presumption of validity, then closes by decrying the "super legis- lature" activism of the majority as a violation of the separation of powers doctrine. 757 S.W.2d 687, 694, 701 (Tex. 1988). Further, Justice Gonzalez has taken to task his more liberal colleagues for their use of results-oriented jurisprudence to the exclusion of constitutionally binding principle. ALCOA V. Alm, 785 S.W.2d 137, 142-43 (Tex. 1990). Finally, and most recently, Justice Gonzalez hoisted his Republican brethren on their own "original intent" petard in construing the constitutional requirements for becoming a Texas Supreme Court justice. Sears V. Bayoud, 786 S.W.2d 248, 251-54 (Tex. 1990) ; see also Morrison v. Chan, 699 S.W.2d 205, 208 (Tex. 1985) (judge's duty "to construe statutes as written"). Abortion Justice Court openly criticized Roe V. V. Krusen, Wade for 678 S.W.2d 918, 935 a Gonzalez' first opinion as a member contributing of the Texas to Supreme society.' Nelson his words, (Tex. "disposable 1984) (concurring & dissenting). In own is hope that the courts and legislatures of this the meaning and the value of life, even that of those and yet nation, It my and our society, will continue to ponder unborn. Through this process of reflection discretion, hopefully the pendulum of public opinion will swing toward the recognition of the rights of the unborn. Id. The fact that Justice Gonzalez' first Supreme Court opinion dealt frankly with such a controversial subject speaks volumes for the confidence of his convictions. Crime and Punishment Unlike the U.S. Supreme Court, the Supreme Court of Texas does not exercise criminal jurisdiction. Over the last six years, Justice Gonzalez has issued only one opinion relating to criminal procedure. In L.G.R. V. State, a juvenile delinquency proceeding, he adhered to the "fatal variance" doctrine which requires that an accused be given sufficient notice of the charges against him in order to comply with the dictates of due process. 724 S.W.2d 775, 776 (Tex. 1987). Additionally, while Justice Gonzalez has apparently never written on the constitutionality of the death penalty, the opinions from his tenure on the Corpus Christi Court of Appeals indicate a conservative tendency on law and order issues. See, e.g., Williams v. State, 680 S.W.2d 570, 574-75 (Tex. App.--Corpus Christi 1984, pet. ref'd). (Miranda warnings not required). Business and Professions Justice Gonzalez has not been inclined to expand the civil liability of business, health care and manufacturing interests. ALCOA V. Alm, supra (manufacturing); Morisson v. Chan, supra (health care) ; Lucas V. United States, supra (health care). In Gaulding v. Celotex Corp., he held that various and sundry collective liability theories did not apply to the facts of an asbestos case. 772 S.W.2d 66 (Tex. 1989). First and Fourteenth Amendments Justice Gonzalez' opinions with regard to the rights guaran- teed by the First and Fourteenth Amendments are unremarkable. In he carefully followed established free speech Brasher, before deciding the case on a state procedural point. carredent 567, 569-70 (Tex. 1989). In the aforementioned Lucas 776 United States, his grasp of traditional equal protection and due V. process analysis is clear. 757 S.W.2d at 694-96. I am, how- ever, unaware of any Gonzalez opinion dealing with free exercise or establishment of religion. From a review of his opinions, Justice Gonzalez appears to have the conservative credentials and judicial philosophy publicly sought by The President. As a purely political matter, the Senate Judiciary Committee would have a difficult time advising against confirmation if properly presented to the media. Political Considerations Justice Gonzalez is the epitome of the Democratic majority's nightmare: a thinking, self-reliant, conservative minority. I believe he is the first Hispanic to sit on the Texas Supreme Court and he would certainly be the first on the U. S. Supreme Court if confirmed. Since Justice Gonzalez was recently popularly elected to the bench, hispanic organizations like MALDEF and LULAC would be hard pressed to oppose confirmation, setting up a possible schism in the civil rights lobby. Further, Senator DeConcini faces a large Mexican-American constituency in Arizona and if Senator Biden continues to harbor presidential aspirations, he will require support from that same constituency throughout the Southwest. Even Senator Kennedy may have to cool his rhetoric while shepherding Kennedy-Hawkins through conference committee. Finally, the stigma of vetoing a "civil rights" bill may be considerably lessened and the chance of sustaining a veto increased by elevating a member of the hispanic community to the highest court in the land. At a minimum, the Democratic members of the judiciary committee will have to proceed with caution. On abortion, the fact that Justice Gonzalez has clearly placed his views in writing may be viewed as a kiss of death. It should be noted, however, that a non-publishing, conservative, white male nominee, however qualified, will surely receive the same withering scrutiny from the Judiciary Committee on this issue. Another Justice Kennedy is not in the offing. If The President nominates a moderate comparable to former Justice Powell, he must hope that either the Court declines to hear a case prior to the '92 election or that the nominee declines to cast a vote identical to Powell's in Roe. Unfortunately, the Court has already agreed to hear at least one abortion case next term. Confrontation seems inevitable even if the nominee has expressed no written opinion, so Justice Gonzalez' opinion in Nelson v. Krusen may not be as significant a liability, especially in light of other qualifications that make rejection politically unpalatable. 3 cast the deciding vote Justice Gonzalez' party and affiliation. wrote the Republican candidate from running Sears v. Parallels to the Brennan Nomination Justice Gonzalez' background mirrors that of Justice Brennan in three important aspects. First, he is an experienced state supreme court justice (six years; forty-seven majority opinions). Second, I believe he shares the same Catholic faith as Justice Brennan. Finally, Gonzalez' nomination would repeat political history in that a Republican president would again nominate a Democrat to the court. Because I believe Justice Gonzalez is well qualified to sit on our highest bench and that he is a man of integrity and character that either party may support in good conscience, I respectfully urge his recommendation to The President for nomination to the position of Associate Justice of the Supreme Court of the United States. Patients experience different therapeutic effects, as well as differing adverse effects; therefore, any plan for substitution may have a significant impact on the health and well- being of the individuals receiving the drugs. However, there are other problems with the proposal. First, it would surely result in Medicaid patients receiving the oldest and least expensive versions of a drug. All of the research and development expended to make new, more efficient and effective drugs would not benefit the Medicaid population at all. Borut Dear Mr. Sununu: I am writing to you as a critical summit negotiator on behalf of the elected officials of the nation's cities and towns to support the federal deficit reduction objectives articulated by Chairman Dan Rostenkowski and to put the S&L bailout on a pay-as-you-go basis. On Saturday our Board of Directors unanimously adopted a resolution urging your leadership in setting a goal of eliminating the deficit and fundamentally restructuring federal budget priorities to meet our nation's changing security needs. We believe significant deficit reduction and conversion from a military to a civilian economy is critical to ensuring the nation's future prosperity. More importantly, we believe this issue is a test of leadership, accountability, and responsibility. For that reason, we are prepared to not only support a comprehensive effort, but also to participate in efforts to build broad public support for what must be done. With a majority of American cities confronting lower revenues and increased needs, we are only too understanding of the difficult choices which leadership requires. Specifically, we support setting a 5-year deficit reduction goal of $600 billion. We recommend that defense spending be cut $200 billion. We recommend a combination of cuts in non-needs tested entitlement programs and non-priority discretionary programs, and tax increases to make up the remaining $400 billion. Attached, for your information, are federal revenue increases we would be willing to support to eliminate the deficit and reinvest in priority municipal programs. To convert our economy to meet challenges to our economic security from global competitors, we urge you to devote $550 billion to deficit reduction and $50 billion to reinvest in our own country to insure that our human and physical infrastructure is competitive for the future. We believe that the consequences of long term borrowing to pay for past mistakes would significantly reduce the stock of capital investment at the federal, state, and municipal level - as well as with the private sector. We believe borrowing should be reserved for productive investment to make our economy stronger and more productive. Dear Mr. Sununu, Enclosed are some background materials regarding the 8th World Hydrogen Energy Conference being held in Honolulu, Hawaii, July 22-27th, 1990. An energy and industrial transition from the "oil economy" to a "hydrogen economy" could create an unprecedented economic boom for the U.S., while virtually eliminating many of the more serious global environmental problems related to global warming (hydrogen combustion emits no greenhouse gases), oil spills, acid rain, urban air pollution (smog), sewage and landfill accumulations, or the production of any additional nuclear reactors. Moreover, as the arms race continues to wind-down, the mass production of renewable solar-hydrogen systems will provide a private sector alternative to the deficit-financed defense spending. This is because the renewable resource technologies will provide a relatively low risk and renewable rate of return on their investment, which means it is really a question of oil companies evolving into solar-hydrogen companies. I have included a copy of Senate Bill 639, which specifically seeks to fund the development of hydrogen energy technologies in the U.S. (HR-2793 is the house-version of the bill), and two advance copies of a related book on the subject, The Phoenix Project: An Energy Transition to Renewable Resources, which identifies three types of solar technologies (i.e., Stirling dish gensets, ocean thermal energy conversion (OTEC) and wind energy conversion systems) that could be economically mass produced for large-scale hydrogen production. (Please refer to chapters 4, 5 and 6.) It is worth noting that Stirling dish gensets are similar to automobiles from a manufacturing and cost perspective, whereas OTEC plants are like ships, and wind energy conversion systems are like airplanes. As such, these technologies are not like the unproven "cold fusion" systems that were never published in peer-review scientific papers - much less proven in the field. Indeed, wind, OTEC and Stirling dish gensets have been in use or under development for over 100 years, which means that if the billions of dollars that have been spent on nuclear and fossil fuel systems since World War II had been directed towards these renewable solar-hydrogen technologies, a global hydrogen energy system would already be in place. This only underscores the importance of strategic planing with regards to which technologies we want to see developed. Mr. John Sununu Chief of Staff THE WHITE HOUSE July 12, 1990 Page 2 of 2 Hydrogen is an ideal medium to store the vast but intermittent supply of solar energy, and it is the only energy alternative that is non-toxic, essentially clean burning, and completely renewable. Hydrogen can be made from water, and when it is burned as a fuel, the water is returned in the form of steam. Our research, however, has shown that the most cost-effective source of hydrogen will initially come from microbes that will extract it from sewage sludge and landfill materials (i.e., garbage). This is no small considera- tion given the fact that the oceans are being poisoned by the billions of gallons of raw sewage that is being dumped daily, and that virtually all of the existing landfills in the U.S. will be full in about 8 years. Two other key points that few people realize is that hydrogen is generally rated safer than gasoline or other hydrocarbon fuels in the event of accidents, and an energy transition to a global hydrogen energy system is being advocated by over 2,500 distin- guished scientists and engineers from more than 80 countries who have formed the International Association for Hydrogen Energy (IAHE). The IAHE is also the primary organization that organizes the World Hydrogen Energy Conferences that are held every two years. In spite of the fact that a transition to hydrogen would solve so many global economic and environmental problems, the IAHE and the hydrogen economy concept are essentially unknown by the vast majority of the world's citizens and their elected officials. You and President Bush have the power to change all that. This is a win-win situation for almost everyone, but what is really required is presidential leadership. Just as President Roosevelt brought together the War Production Board in World War II, President Bush now needs to assemble a U.S. Hydrogen Production Board, and to help establish an international industrial effort as well. My initial suggestion is for you and/or any of your key staff members to attend as many days at the upcoming World Hydrogen Conference as possible. An appropriate follow-up briefing could be provided at Camp David to President Bush and the key members of his cabinet. An official administration policy statement could follow. In addition to the "Perverts Club," there are allegations here of insider trading, $118.5 million in overcharges, violations of the MFJ consent decree, misallocations of lobbying expenses, bid-rigging and other assorted difficulties. This story, about NYNEX, follows by a few days a finding by the Georgia Public Service Commission that Southern Bell has been overcharging its customers at the rate of $180 million a year. And that finding was preceded by revelations of misallocated expenses by Ameritech in Illinois, Michigan, Indiana, Wisconsin and Ohio. This is only the most recent news, along with the GTE-Contel insider trading suit brought last week by the Securities and Exchange Commission. Nearly every telco has had its turn in the spotlight. If these are the people who are supposed to save the consumer from the excesses of a few "bad actors" in the cable business, the consumer may not be all that grateful for his salvation. The administration wander has been successful in accomplishing many doable acts, but I believe whenever Republicans off their own intellectual reservation they ultimately do themselves and nation irreparable harm. I understand the need for trial balloons, but the the of sending up same tends to define the parameters of one's thinking. A trial process balloon taxing capital transactions is at best inconsistent with the long term essential needs on of this country and the direction this administration should take. If you want less of something, by all means tax it. Taxing capital transactions will assuredly result in a reduction of capital flows and increase the disparity of valuation between the growth and cyclical sectors of our economy, thereby making the latter more vulnerable to takeovers while increasing their capital costs and making them even less competitive. It is a bad idea which should be aborted before it takes on a life of its own and the economic anti-abortionists grab hold of it. More and more, government becomes irrelevant and even detrimental, and though people may maintain their physical beings in this country, their increasing lack of participation is the best evidence of where their intellectual spirit lies and how repelled they are by trends. I have never been a strict ideologue, but I do believe in certain eternal verities. The enclosed articles touch upon much of what I hold intellectually sacred. This administration must not embrace the bankrupt and flawed thinking of the Democratic Party. In doing so, it will justifiably lose the nucleus of its support. As we ultimately move toward the "one world" of which Wilkie spoke, I believe we will first settle on increasing geographic or continental competition. The sooner America better integrates its economic, social and political ties with South America and Canada, the better we can compete with the emerging European community and the Pacific rim nations. I was heartened when President Bush recently proposed this concept. The sooner we get at it, the better off we'll be. This should be our focus, not raising taxes in manners counterproductive to this goal. Even though the potential liability in Utah is not as great as Texas is experiencing, such "administrative rulings" by the Department of Labor have the potential effect of requiring Utah to tax its citizens to raise monies to cover FLSA declared liabilities. This option is not acceptable to me. I believe that new legislation is not needed. I believe, however, that the President can be helpful to all states by requesting that the Department of Labor revert from their recent administrative rulings affecting professional employees of state governments. I am aware that the National Association of State Personnel Executives has filed a brief with the Department of Labor regarding this topic. I believe this brief outlines a reasonable approach and request your assistance with the Department of Labor. I have attached this brief for your reference. It is curious to me that the Department of Labor would take such an entrenched position as they have, when many of the classifications they are studying, such as Social Workers, have 40-50% federal monies attached. Indeed, we were heartened by the strong language used in your recent letter on the subject to Congressman Bill Goodling. Just as the Goodling letter offered White House input on a number of key child care spending questions, we believe a letter offering White House input on key child care tax issues would also prove useful. Such a letter could call for the conferees to bring the new young child tax credit (adopted by both Houses) into full conformity with the President's FY90 and FY91 budget proposal by targeting this new credit to families who currently receive little or no benefit from the Dependent Care Tax Credit (DCTC). Underscoring the Administration's support for such a credit would make clear that a simple expansion of the Earned Income Tax Credit, while certainly not at odds with the Bush child care proposal, does not fulfill the President's interest in permitting families that care for their own children to claim as many tax credits as families with day care expenses. Instead, full conformity with the President's proposal requires a new young child credit available to families who do not claim the DCTC. We believe it is appropriate to raise this issue with the conferees since the House floor debate did not address the question of how the new young child credit would interact with the existing DCTC, much less a DCTC made refundable by Senate action. A Bush-style young child credit is less costly than a young child credit that permits "double dipping" -- especially if the Dependent Care Tax Credit is made partially or fully refundable. This is significant given the serious (and appropriate) budget constraints faced by the conference committee. While existing tax discrimination alone is enough to merit adoption of a Bush-style credit, the fact that Congress appears hell-bent on increasing government day care subsidies makes this attempt to level the tax playing field all the more important. A new tax credit targeted to families that care for their own children would significantly offset the increased subsidies to day care users adopted by the Congress. In addition, a Bush-style credit is the responsible answer to calls for paid parental leave. As the enclosed article makes clear, a Bush- style credit provides economic assistance to leave-taking parents without saddling business with burdensome labor costs. Apart from urging the conferees to bring the proposed new tax credit for young children into full conformity with the President's position, we believe that House provisions capping the Dependent Care Tax Credit and Dependent Care Assistance Plans must be included in final legislation. Indeed, proposals to cap -- or even eliminate one or both of these discriminatory and poorly-targeted tax provisions should be included among revenue-raising options in the ongoing budget negotiations. Again, thanks for digging in your heels on child care legislation. We hope that a precedent for a Bush-style tax credit can be set in the conference negotiations so that the bill that emerges in the post-veto environment is one that treats all families fairly.
