As an MTN Vice Chairman, I was pleased to be invited to
participate in the President's recent briefing on fast track
extension. I thought you might like a brief follow-up on
Brown-Forman's efforts in this endeavor.
Recognizing the enormously important consequences which this
issue will have on the long-term economic health of
business, the economy, and ultimately the U.S. standard of
living, we have marshalled the company's resources to urge
Congressional support, especially among legislators with
whom we have strong business or personal relationships.
We have written directly to 75 Senators and Congressmen, in
states where Brown-Forman has a major presence, to encourage
them to preserve fast track negotiating authority. In
addition, we have written to each of the company's
advertising agencies, and over 300 distributors and
suppliers with whom we do business, to ask them to consider
writing to their respective representatives to solicit
support as well. A copy of both letters is attached for
your reference.

When I opened our local Sunday newspaper yesterday morning and saw that
the lead article was an attack on W & J because the College is purchasing old
houses and razing them in order to expand the campus, I thought of you and the
vicious attack the press has been making on you because of your use of
government transportation. It seems to me that the media should be paying
more attention to the tremendous job you have been doing as Chief of Staff for
the President of the United States.
You deserve coverage by the media for all of the successes that our
government has achieved since you have been in office--the Cold War is no
more, Operation Desert Storm was successful beyond anyone's imagination, the
effectiveness and efficiency of the White House staff has been unparalleled,
the President has overwhelming favorable support from the people and much
legislation has been passed implementing the President's policies. I could go
on extolling the remarkable achievements of this administration with you as
Chief of Staff. Any one of these achievements would merit more publicity than
has been given any of them. And yet, the media seems more interested in how
many trips you have taken. This interest can only be interpreted as an effort
to attack you because you have been so successful.
Please know that you have a great many friends and supporters and that
we are all proud of all that you have done for our President and our country.

Dear Governor Sununu,
I am writing to convey our deep concern over
provisions that were passed April 23, 1991 during mark-up of
S. 341 in the Senate Energy Committee.
Title X of S. 341 would require the Federal Energy
Regulatory Commission "to redress any anti-competitive
impacts" on pipeline imports of natural gas. As a practical
matter, this provision is intended to reduce imports of
Canadian natural gas. The Commission would not be required
to redress anti-competitive factors in respect of domestic
gas. This provision is discriminatory and clearly contrary
to the obligations of the United States under the Free Trade
Agreement.
In a letter to the Committee on April 18, 1991,
Admiral Watkins stated that the Department of Energy could
not support legislation which restricted imports of Canadian
gas contrary to the Free Trade Agreement. He noted
specifically proposals which could threaten or delay the
continuous flow of (Canadian) gas. Nonetheless subsequent
statements to the Committee by Energy officials indicated
that the Administration, including the White House, "could
not decide" if these provisions were contrary to the Free
Trade Agreement.

I would urge the Administration to resolve the
ambiguity and express unequivocally that it will not support
this provision or any legislation which violates the
obligations of the United States to the Free Trade Agreement.
Given pressures on other elements of this agreement, it is
highly desirable that we see firm support from the
Administration for the energy provisions.

Dear Governor Sununu:
On behalf of the 290,000 members of People For the American Way, a nonpartisan
constitutional liberties organization, I would like to call your attention to the need for further
efforts by the National Education Goals resource groups to implement the citizenship
education elements of the National Education Goals.
Its ironic that during the current celebration of the bicentennial of the Bill of Rights,
our nation is confronted by an astounding lack of citizen participation, especially by young
Americans. A recent study commissioned by People For the American Way surveyed over
1000 young people and 400 social studies teachers about young American's attitudes and
values concerning citizenship and participation. The results argue clearly and urgently for
renewed attention to citizenship development by our national leaders and our schools.
Briefly, the survey found:
Young people have a stunted concept of what a good citizen is, equating being
a good citizen with being a good person and ignoring the social and political
dimensions of citizenship.
They fail to connect their own well-being with that of the country, expressing
optimism about their individual future prospects but pessimism about
America's future.
They are preoccupied with career success and rank involvement in making their
community a better place dead last in a list of important life goals.
Responding to this and other data, Governors sought the inclusion of citizenship
education in the National Education Goals. In Goal Three, "Student Achievement and
Citizenship," the challenge went out to "ensure that all students learn to use their minds well,
so they may be prepared for responsible citizenship." Goal Five, "Adult Literacy and
Lifelong Learning," urges every adult American to "exercise the rights and responsibilities of
citizenship."

But the resource groups for Goals Three and Five have thus far failed to define or
suggest programmatic, measurable indicators for citizenship education. Even the title of Goal
Three in the material circulated at the National Education Goals panel meeting on March 25
was reduced from "Student Achievement and Citizenship" to simply "Student Achievement"!
After consultation with a number of citizenship education advocates, I would like to
propose three indicators of responsible citizenship that would assist the resource group for
Goal Three:
(1) The number of students who participate in school-supported and
-encouraged community service projects as an integrated component of civic
education;
(2) The number of eligible 12th grade students who are registered to vote;
(3) The number of schools that provide a structure for students to gain
familiarity and practice with electoral or issue campaigns and for student
representation in school decision-making.
The 1980s witnessed an expansion of school-based, higher education and conservation
corps community service programs. Since the National Education Goals were developed,
President Bush and the Congress worked together to enact legislation, the National and
Community Service Act of 1990, to empower millions of young Americans to engage in
community service. The service-learning approach to citizenship education that was
developed in the community service legislation is, I believe, the right approach. Service-
learning means a method under which students learn and develop through active participation
in thoughtfully organized service experiences and that is integrated into the students'
academic curriculum or provides structured time for students to think, talk, or write about the
activity. Most importantly, service-learning enhances what is taught in school by extending
student learning beyond the classroom into the community and helps to foster the
development of a sense of caring for others. Baseline data on the number of students
participating in community service programs are available and because of the National and
Community Service Act, future data are very likely to measure an increase in participation.
Voting is perhaps the single best indicator of citizen participation; without it our
democratic form of self-government would be a sham. Voter registration of high school
seniors is an important rite of passage supported by a growing number of school districts.
For example, People For the American Way has developed "First Vote" to be used in
classrooms to inform young people about the importance of learning about public issues and
voting. The Dade County, Florida school district has already proven that such a program can
be highly effective. In March, the state of Minnesota announced it will implement First Vote
in all its high schools. San Francisco and New York City will soon implement school-based
voter registration programs.
Optimally, campaigns and voting should be familiar experiences for high school
seniors. Schools with student councils encourage students to take positions on issues
important to the school, run campaigns and vote. School boards with student representatives
further enhance young people's understanding of the importance of participation in decision-
making processes. Students who participate in these citizenship-enhancing activities often say
that their experience helped shape their lives. They learn first-hand that their time is well
spent tackling the important issues facing their community and country.
Community service, voter registration and student government campaigns are
programmatic, measurable manifestations of citizenship education. Classroom teaching, from
kindergarten through college, although less amenable to measurement, is just as crucial. The
original mandate of the public schools was the induction of young people into responsible
citizenship. The high office of citizen deserves to be promoted in textbooks, projects and
discussions to demonstrate that much is expected of democracy's next generation. Our
nation's youth must be taught, through academic and non-academic learning opportunities,
that it is their right and responsibility to make an investment in democracy and the future of
our nation. The education and practice in citizenship Americans experience in their youth
will serve them well as adults.
I urge you to help remedy the omission of citizenship education in the Goals panels'
work and ask that these programs be included as measurable standards to implement the
citizenship goal as originally endorsed by the Governors and the White House. I would be
happy to assist you in this important endeavor.

Dear Mr. Sununu:
Enclosed for your review and retention is a copy of
Bethlehem's Report for First Quarter 1991. Bethlehem had a net
loss of $39 million for the first quarter compared to a net
income of $21 million for first quarter 1990. The loss was
attributable to the continuing effects of the recession on steel
shipments and prices, and to higher costs. Bethlehem continues
to be a company in transition and certain sections of the Report
are marked to indicate areas of progress and concern.
1. Lower Shipments.
Steel shipments were approximately 7% lower in the
first quarter of 1991 than in the year earlier period, and our
raw steel production declined to 67% of capability.
2. Higher Costs.
Production costs at steelmaking operations were
higher, reflecting increased iron ore costs, lower operating
rates at our sheet finishing facilities, and increased employment
costs pursuant to our labor agreement.

Most steel markets usually lag the economy in both
recession and recovery. Domestic industry steel shipments for
1991 are now expected to be about 76 million tons, down 10% from
the 85 million tons shipped last year. In addition, our near-
term concern is heightened by an upward trend in imports. At our
Annual Meeting of Stockholders on April 23, 1991, our chairman,
Walter F. Williams said, "We'll be watching this trend very
carefully and be prepared to take whatever action is necessary.
In that respect, we are relying on the commitments of the
Administration to preserve and, hopefully, strengthen our trade
laws, so that we have the proper tools to protect our interests."
We do currently expect to report a loss for the second
quarter.

Center's review of Hollywood's political activism, will begin
monthly publication as of May 1991.
When TV, etc. was launched back in 1989, the entertainment
community had just begun to flex its political muscle. Now,
Hollywood is one of the most powerful forces in politics today.
The Media Research Center has expanded its research facility to
keep pace with the increased celebrity activism, initiating

I am aware that you are having the opportunity to appoint two seats to the Board of
Directors of the Corporation of Public Broadcasting. This letter is to respectfully
Television. request you consider Terry Rakolta, Founder and Director of Americans for Responsible
Terry is a mother of 4, with a deep concern for the effects of television on
children. She not only has a concern, but is giving valuable time to validate her
concerns with statistics. A recent study done by Dr. Brandon S. Centerwall,
Professor of Epidemiology at the University of Washington, has reported that
following the introduction of television in the 1950's, United States homicide rates
doubled over the next 10-15 years, as the children exposed to violence on television
on a regular basis grew to maturity - - and too many of them to murder or be murdered.
Honorable Sununu, your concern for children is well known through concerns of Mrs.
Bush and her volunteer efforts for literacy. Television is another area where great
harm is being done to latch-key children, children having access to VCR's and playing
tapes intended for adults only, busy parents not having the time to monitor every
program their child watches, and with devastating statistical results to the
effects. Terry Rakolta speaks for many parents through her concerns. I believe it
is essential that she be a part of this Board of Directors to bring a very necessary
perspective and vital statistical information in order for the Corporation of Public
Broadcasting to have all the facts in the decisions they will be making.

The 1991 President's Dinner is fast approaching, and I am pleased
to report that we have had a very positive response so far this
year.
When we secured the date for this year's Dinner, June 13th, we
were in the height of the Persian Gulf Crisis. Understandably,
the Political Office could only commit the President to a 45
minute appearance. However, I would like to now request that the
President and Mrs. Bush attend The Dinner as in year's past by
arriving at 7:15 p.m., and departing immediately after The Dinner
program no later than 10:00 p.m.
The President's Dinner has consistently broken all records in
raising money for the Republican House and Senate. One of our
strongest fundraising tools is that those people who give year
after year feel they are supporting a goal that is vitally
important to the President. His presence confirms this and
serves as the foundation for next year's effort.

It gives me great pleasure to report to you on the activities of
the American-Arab Affairs Council over the past three months (see
enclosed "Highlights"). During this time of leadership transition,
the Council's principal efforts have been the publication of our
quarterly journal and the implementation of a major conference in
Atlanta marking the tenth anniversary of the organization. This
meeting was very well-attended and received wide media coverage--the
banquet speech by Under Secretary of State Paul Wolfowitz was
excerpted in The Washington Post. The proceedings will be published
in the next issue of American-Arab Affairs.
The participation of well-known policy makers and analysts
ensured an enthusiastic audience in Atlanta. It was a particular
pleasure for me to have as the keynote speaker the Hon. Frank C.
Carlucci, whom I served under during his term as Secretary of Defense.
Other speakers included David Mack of the State Department's Near East
and South Asia bureau, William Quandt, Robert Neumann, Clovis Maksoud,
and Ambassadors Nassib Lahoud of Lebanon and Abderrahmane Bensid of
Algeria. Fortuitous timing--the fighting had ceased the day before--
enlivened the event for those on the dais and in the audience.
I want to assure you of my commitment to the Council's major
projects, conceived and established by its founder, George Naifeh:
the journal American-Arab Affairs, the major conferences, and, as
funding permits, other efforts directed to the public-opinion leaders
identified at the Council's inception. There is heightened interest
right now in the subject matter this organization provides forums for.
With your support the Council can become secure and flourish.

Dear John:
On our December 1989 codel to Latin America, I had the
privilege of renewing an old friendship with Tim Towell, who is now
our Ambassador to Paraguay. I was most impressed with the
excellent job he was doing there.
As you well know, Paraguay has moved from a dictatorship and a
controlled economy towards a democracy and free enterprise system.
This change was so exciting that I worked with Ambassador Towell to
try to develop business contacts for the State of Missouri in
Paraguay. In addition, he and I have been discussing, but have
never been able to put together a fishing trip for the magnigicent
dorado on the river there.
In the course of a recent discussion in a futile effort to
establish a date for that fishing trip I learned that he will be
leaving his assignment in Paraguay in August. Although he is a
career ambassador I know that in his private life he has been an
active, hard working Republican and one who has served the
Republican Administration as well in a career position. I urge you
to give Tim Towell an opportunity to be interviewed by the
appropriate people in the White House or State Department when he
is in town in May. Also, I think you and the President might be
interested in hearing about some of the exciting news going on in
Latin American while all of us understandably are focused on the
Mideast and Central Europe.

I am pleased to inform you that the 1991 meeting of the
Midwestern Governors Conference will be held in Sioux City,
Iowa on October 20-22. We expect to have at least eight
governors attend all or part of the meetings. The event will be
hosted by Governors Nelson and Mickelson in addition to myself.
It is our hope that President Bush will be able to serve as the
keynote speaker during the October 21 State Dinner. We expect
that up to 2000 regional leaders and conference participants
will be at this event. It would be an excellent opportunity
for the President to address the Midwest.
I realize that committing the President this far in advance is
difficult. However, if it is not possible for him to attend,
we would like to have a senior member of the Administration
serve as keynote speaker.
Next to the President, our first choices would include you,
Secretary Cheney, General Powell or Secretary Alexander. This
conference will be an important opportunity for the
Administration to reach a significant part of the nation with
your message.

It is my pleasure, as Honorary Chairman of the 1991 Bush-Quayle
Schedule C Association Golf Tournament, to invite you to join in
the fun at the Shannon Green Golf Course in Fredericksburg,
Virginia on Saturday, June 15.
The tournament serves as a relaxed way for association members to
get together with senior level officials of the Administration
and others involved in the political process in Washington. Last
year's tournament was a big success and all indications are that
this year's will be even better.
Joining me in serving the tournament in an honorary capacity are
Secretary Brady, Secretary Mosbacher, Secretary Skinner,
Congressman Sundquist, Deputy Secretary Moore, Charlie Black,
Rich Bond, Frank Donatelli, and Ron Kaufman. We are all pleased
that the proceeds from the day will go to the American Red Cross
to benefit families who suffered a loss due to Operation Desert
Storm.
The Bush-Quayle Schedule C Association was established in 1990 as
a private, non-profit organization of Schedule C appointees to
the Bush-Quayle Administration. Its purpose is to promote the
policies of the Administration and to strengthen relationships
between members through professional and social functions. It
currently has about 650 appointees as active members.
I have enclosed a flier that further explains the details of the
tournament. I hope you are able to join us for the afternoon.

Dear John,
I am writing to ask whether you might be able to join us here
on the evening of Thursday, June 27, for an evening dialogue on the
current debates over federalism and the Administration's attempts
to return greater authority and responsibility in various areas of
public policy to state and local units of government.
I know that this area of policy has long been of special
interest to you, and that you were very active in it during your
years as Governor. As perhaps you know, a former colleague of
yours on the Advisory Commission on Intergovernmental Relations
(ACIR), Dr. Robert Hawkins, was once a Fellow here at the Wilson
Center and director of a Center program on state and local
government. Bob is currently the President of the Institute for
Contemporary Studies in San Francisco, and he continues his public
service as Chairman of the ACIR. Bob has agreed to participate in
the dinner and evening dialogue on the 27th, and suggested that we
try to get you to join with us for the event.
The 27th will be the evening before the next meeting of the
ACIR, and the thought was that this would be a good opportunity to
get together in a relatively informal setting with governors and
others to discuss some of the issues of federalism and attempts to
reform the system. Given your special experience in this area,
together with your current responsibilities, you are plainly an
ideal speaker for such an occasion, and your position as a member
of the Center's Board of Trustees made the idea seem all the more
appropriate. We think it would be an interesting and important
gathering in connection with a rather neglected area of public
policy.
If you can accept our invitation, we would hope that you would
be willing to speak for 15-20 minutes on the Administration's goals
in the area of federalism and the devolution of authority, together
with your personal assessment of the obstacles to progress in this
area. Bob Hawkins would follow with 20 minutes of remarks on the
fate of previous attempts at devolution in the past two decades and
comment on the underlying reasons why more has not been
accomplished. At that point we would open the meeting to questions
and comments from the floor.

I am happy to send you (a month ahead of the usual
schedule, I am told) a quasi-final list of next year's
Fellows. I say "quasi-final" because experience suggests
that there are likely to be a few changes as a result of
deaths, births, career changes, etc., between now and
September; if we learn of these soon enough, we still have
some excellent Alternates in the wings.
I am also happy to report that, in marked contrast to
last year, only four of those to whom we offered Fellowships
declined; each of these seemed to have a good reason for
doing so, none of which reflects unfavorably upon the Center.
I hope you will agree with me that this is a very strong
and impressively varied list. I am most grateful to our
hundreds of outside reviewers, to our external Selection
Committee, to the Board's Fellowship Committee, and to Ann
Sheffield and her staff for their help in producing this
impressive result.

Dear Governor Sununu:
I am writing to request that you call EPA Administrator
William Reilly to direct EPA to continue discussions with the
wood preserving industry on a regulation affecting it. I hope
that these discussions will achieve a more cost effective
regulation that meets the President's FY '92 Budget goals and
provide adequate compliance time.
On December 6, 1990, EPA promulgated a final rule for the
industry which the President's Budget has identified as the least
cost effective regulation in over 20 years. The regulation's
cost per premature death averted, according to the Budget, is
$5.7 trillion. EPA and the industry are currently discussing
implementation issues raised by the final rule including
unreasonable compliance deadlines. It will simply be impossible
for most wood preserving facilities to meet a June 6, 1991
deadline.
In 1989 and 1990, I was among 150 Members of Congress who
strongly urged EPA to regulate the wood preserving industry using
an integrated, multi-statute approach. Despite these
Congressional requests, EPA promulgated a RCRA-only regulation
that is no more protective of human health and the environment
than alternatives proposed by the industry and rejected by EPA.
Industry-wide capital expenditures for the EPA regulation
could be as high as $5 billion, easily exceeding more than twice
the estimated net value of the industry. Most wood preserving
companies have insufficient capital to meet the EPA regualtion's
costs. EPA's final rule will force a significant number of plant
closings within the industry.
EPA has been told of the potential economic harm that could
result from its actions and has acknowledged that some of the
rule's negative effects were not intended. In this vein, EPA
should work diligently to address the industry's legitimate
concerns.

Dear Governor:
We met at the Metropolitan Washington Chapter of the ARCS at their
annual gala to provide funds for scholarships for worthy young American
students who are in need of financial support to complete their higher
education in the science and education fields at George Washington University,
John Hopkins University, Georgetown University and the University of Virginia.
My wife Ann was a founder and past President of that chapter.
Your address was fabulous as you could note from the interrupting
applause. The nation is well aware of your service to our President and the
nation. We've known the President and Barbara Bush for many years. The world
and history will record his finest hours in turning the Persian Gulf War
crisis into a triumph of American leadership.
It was a fast moving receiving line and I did not indicate my
identity. For your information, my political relationship with New Hampshire
goes back to the days of Styles Bridges, a good friend and at the Republican
National Convention in 1936 which nominated Governor Landon for President. I
was from New York State and was the youngest delegate at the convention and
was chosen to nominate Styles for Vice President. On my way to rostrum, he
ran out of his delegation which was in front of us and nominated Frank Knox
for Vice President. Knox, you may know, had left the convention earlier and
angry as he felt he did not expect to get the nomination. What happened, was
a song was going around Cleveland, "Landon Bridges" falling down to the music
of "London Bridge is Falling Down." This bothered him so he did not want the
nomination. The radio brought Frank Knox back.
It is my information you had the photograph of Sherman Adams on
you wall. He was a close friend of mine and so was Rachel. I worked for
Eisenhower, pre-Convention, at the Convention and post-Convention during the
successful election. After the election he offered me a position in Norris
Cotton's office where he was holding forth. But I could not afford it, as at
that time we had four children. I talked with him on the phone until a few
months before his death.
From my point of view, he was the Rock of Gibraltar who carried
out his duties as chief of staff, in the manner which appealed to Ike. He
played an important key role in the genesis of The Kennedy Center. At that
time in 1958 it was named the National Cultural Center.
I am enclosing a book which I wrote, Miracle on the Potomac, The
Kennedy Center from the Beginning. A Tribute to President Eisenhower
autographed to you and Nancy. You will find Sherm's name played the central
role in the genesis of the Natural Cultural Center. The dividends of the site
controversy which continued for several years, was the Theodore Roosevelt
Bridge and the Air and Space Museum. All institutions were signed into law by

President Eisenhower in 1958. Without Governor Adams' leadership, dedication
and interest, neither of the organizations would have been established.
You have a very busy, hectic schedule, but you may have a few

Gettysburg and the Eisenhower Theater.

Thank you for your prompt response to my letter of March 28. Both
letters are attached for easy reference.
We very much hope to find a sympathetic ear for our concerns. The result
produced by the Customs proposal -- tripling the duty rate on a boot by the
simple act of adding in an American Made component -- cannot be the
Administration's intention.
Efforts to resolve this in the normal channels have not been effective.
We need some help to get the Service to take another look at this matter, and
work with us to meet their intended goals without crushing our business.

It is my understanding that David Kirker in the Office of
Economic Development in the Small Business Administration in
Washington is being terminated without cause.
I have known Dave Kirker for well over fifteen years through
our mutual association with Northern Community Investment
Corporation, a local community development group covering
Grafton, Coos, and Carroll Counties and Essex, Orleans and
Caledonia Counties in the State of Vermont. He was known as
a very hard worker making just and fair decisions as to the
utilization of federal money and local resources. All of the
work that Dave Kirker laid down years ago has resulted in the
creation and preservation of over 1,200 jobs in these
counties, and over 325 housing units for qualified
individuals.
It would be my strong recommendation the Bush Administration
retain Dave Kirker and keep a good man working for this
country and the State of New Hampshire

This letter is an unsolicited, and hopefully belated,
letter of recommendation for Ann Veneman, now Deputy Under
Secretary of Agriculture, who I understand may be considered for
the No. 2 position in the United States Department of
Agriculture. I have been a close personal friend of Ann's
parents, John G. Veneman, Jr., and Nita Veneman and their three
children for all of my life. As you may know, John G. Veneman,
Jr., a peach rancher from Empire, California, was a Supervisor of
Stanislaus County for many years before becoming a Republican
California Assemblyman from this District, and eventually,
Chairman of the California Assembly Revenue and Taxation
Committee. Jack went to Washington, and served as Under
Secretary of Health, Education and Welfare for Bob Finch from
1969 until several years before Jack's death in 1982. Jack
always kept a solid homebase in the local community of Modesto
and Stanislaus County in California, like his father before him,
John G. Veneman, Sr., Ann's grandfather, a peach rancher and
Supervisor of Stanislaus County for many years.
Ann is a graduate of the University of California at
Davis, (B.A.), the University of California at Berkeley, (M.A.)
and the College of Hastings, University of California, (J.D.).
She served in the local District Attorney's office as prosecuting
attorney, and was a member of a local law firm for several years
before going to Washington, DC, to serve under Richard Lyng,
Modesto, California, United States Secretary of Agriculture.
Ann has shown an outstanding dedication to her community
and to her Country. In my opinion, President George Bush would
make a strong addition to his cabinet structure by her
appointment; and indeed it would be his loss not to take the
opportunity to appoint a person such as Ann to serve her Country
in the highest available position. I hesitate to add too much to
her demonstrated qualifications, but you would have a loyal,
hard-working and experienced person in any appointment of Ann
Veneman, such as that being considered.

Dear Governor Sununu:
The Management Association of Illinois has 2000 employer members in the State of Illinois.
The greatest number are small or medium sized with 70 to 250 employees. Our highest
concentration is in the Chicago area where diversity in the population is greatest and the
concern with H.R.1 is intense. In general our members support the Administration Bill
(H.R. 1375) but we have some reservations.
One. Employment discrimination charges are best resolved by conciliation. Litigation
delays settlement, is too costly and is divisive. The President should take a stronger
position favoring conciliation and alternative dispute resolution.
Two. The remedies for employment discrimination should be exactly the same under Title
VII and 42 U.S.C. Sec. 1981; i.e., equitable remedies and, except for a very narrow
allowance for harassment as indicated below, not to include unlimited compensatory and
punitive damages.
Three. We believe there to be a serious flaw in the Administration's proposal. Section 3
will permit a black female alleging egregious racial harassment to recover unlimited
damages under 42 U.S.C. 1981 while Section 8 limits all other claimants of harassment to
$150,000 under Title VII.
The Administration Bill (H.R. 1375) properly recognizes that the nature of employment is
a continuous relationship and therefore remedies for employment discrimination are
equitable remedies to (1) ensure elimination of discriminatory barriers in the selection of
employees, (2) promote equal employment opportunities for all employees but particularly
for protected group persons and (3) eliminate from the work place all forms of harassment
that tend to make a hostile environment for all employees but particularly protected group
persons. Conciliation is the best method to achieve these objectives. Therefore we support
the proposal providing for appropriate compensation and other relief not to exceed
$150,000, in addition to the established remedies available under Title VII, where

intentional, egregious harassment has been established by the Complainant that the EEOC,
during conciliation, or a judge, in a trial to the Court, may assess. Indeed special
counseling for women and African-Americans to overcome the affects of intentional,
egregious and outrageous harassment may be required.
H.R.1's provision for unlimited compensatory and punitive damages, though condemned
by President Bush as a lawyers' bonanza, results in a very certain injury to the claimants
of employment discrimination by denying them access to the courts because the 94 federal
district courts are now inundated with a case load they cannot manage. The pending
litigation of asbestos claims now numbers 30,400 and will reach 50,000 in 3 years. In
addition there exists the infamous, crippling drug case load together with all other pending
litigation. Tens of the thousands of additional employment cases, driven by unlimited
compensatory and punitive damages, surely will overwhelm the courts, denying access to
justice for all claimants for a decade or more. Yes, such benefits only the plaintiffs' trial
bar.
But worst of all is the prospect of a breakdown of the justice system because of the greed
of the trial bar. H.R.1, does not expand the coverage of equal employment opportunity one
whit (nor does any other pending "civil rights" bill). H.R.1 is nothing less than a patently
employer-punitive and litigation-prone legislative proposal and is destructive to the person
nominally to be benefitted.
Title VII, if amended by H.R.1, automatically applies to the ADA, 1990. This will
compound the potential for a flood of additional litigation, all driven by the lawyers' greed
for unlimited damages. Truly, this will collapse the judicial system.
Two very recent Supreme Court decisions add to our concerns: Johnson Controls, Inc. and
Pacific Mutual Life Ins. The former reads out of Title VII the business necessity defense
in a BFOQ case and the latter leaves punitive damages as a "wild card" for plaintiffs.
Since a BFOQ admits to an intentional policy of discrimination and business necessity is not
a defense, plaintiffs are thereby assured of punitive damages. Thus, for some employers,
there is complete vulnerability especially where the disabled file suits.
H.R.1 resurrects the long discredited and judicially denied comparable worth theory in pay
practices. H.R.1 virtually deprives employers of a defense in disparate treatment cases.
Setting wage rates by reference to the market place will cease to be a viable defense.

In summary it seems to us that the President should fight H.R.1 at least for these reasons:
(1)
H.R.1 destroys conciliation.
(2)
H.R.1 promotes an explosion of litigation by providing compensatory and
punitive damages - a lawyers' bonanza bill - that will inundate the judicial
system and deny to all civil claimants, including employment discrimination
claimants, their day in court for many years to come.
(3)
There should be one set of remedies under Title VII; ADA, 1990; and Section
1981 including recognition of compensation for egregious, outrageous and
intentional harassment.
(4)
The net result is employers will be forced into quota hirings and promotions.
(5)
H.R.1 resurrects the discredited comparable worth pay practices theory.

As you know, BCI is an 18 year old company with advanced proprietary and
proven methodology for mapping and developing groundwater supplies in arid, complex
geologic terrains. BCI has always approached water as a valuable economic mineral.
Our only business is finding and delivering it, often in very tough, arid, remote places of
the world where little baseline data exist. We map water development targets in context
with the actual regional boandary conditions which control the resource. This means,
when we do start drilling, every well we drill fits into an existing map we have developed
of the resource base.

Dear Governor Sununu:
I am writing to request that you call EPA
Administrator William Reilly to direct EPA to continue
discussions with the wood preserving industry on a
regulation affecting it. I hope that these discussions
will achieve a more cost effective regulation that meets
the President's FY 1992 Budget goals and provides adequate
compliance time.
On December 6, 1990, EPA promulgated a final rule for
the industry which the President's Budget has identified as
the least cost effective regulation in over 20 years. The
regulation's cost per premature death averted, according to
the Budget, is $5.7 trillion. EPA and the industry are
currently discussing implementation issues raised by the
final rule including unreasonable compliance deadlines. It
will simply be impossible for most wood preserving
facilities to meet a June 6, 1991 deadline.
EPA has ignored these Congressional requests and has
promulgated a cost-ineffective, RCRA-only regulation that
is no more protective of human health and the environment
than alternatives proposed by the industry and rejected by
EPA.
Industry-wide capital expenditures for the EPA
regulation could be as high as $5 billion, easily exceeding
more than twice the estimated net value of the industry.
Most wood preserving companies have insufficient capital to
meet the EPA regulation's costs. EPA's final rule will
force a significant number of plant closings within the
industry.
EPA has been told of the potential economic harm that
could result from its actions and has acknowledged that
some of the rule's negative effects were not intended. In
this vein, EPA should work diligently to address industry's
