We understand that the PCAST will not be called upon to determine any particular controversies in which the legal rights of specific parties are at stake, nor to deliberate on measures that would be targeted to specific companies or industry segments, though if such instances did arise, the members would recuse themselves from participation, despite a $208 (b) (3) waiver. Given this limited nature of the members' responsibilities, as well as their outstanding qualifications, it appears that a decision to grant the proposed waivers would be fully supported by the facts.
