Mr. Gates: Bob, do you want to lay out the issues? (U)
Mr. Kimmitt: Thank you. First, I might note that there seems to
be a fundamental difference between the IAG and Jack as to where
we stand on Vietnam. The different perceptions on this subject
shape how the issues are raised. We appreciate the efforts of
Jack's participation. We hope there is no personalization of the
issues -- certainly there is none felt at the senior levels of
State. (Q)
We need to bring the question of normalization of relations with
Vietnam into sharper focus. There is only one precondition to
normalization -- that is a satisfactory resolution of the
Cambodian conflict. Of course, we continue to stress that the
pace and scope of that normalization will depend on their
progress on the POW/MIA issue. We need to give an assessment of
where Vietnamese performance on this issue. Despite assurances,
accountability has fallen to a trickle; return of remains have
decreased significantly. (Q)
The question is how we signal to the Vietnamese our displeasure,
and how we go forward with POW/MIA progress in the context of

normalization. In this respect, we don't want to be seen to be
changing the goal-posts. Our research back to the time Paul was
at State is that normalization was to be in the context of a
comprehensive settlement of the Cambodian situation. We can't put
down further preconditions, but they have to understand that in
the context of normalization there must be satisfactory progress
on the POW/MIA front. (e)
General Vessey: We don't have any difference of position on
Vietnam. They are dragging their feet, and we don't know why.
However, they are keeping their commitments on other humanitarian
issues -- why the difference on our issue? There is some
difference between me and the IAG on the longer paper. The
intelligence folks are on my side. The paper alleges some things
we know, but we don't; i.e, it says we have reliable intelligence
and scientific data on the warehousing of remains. We do not
have reliable intelligence on warehousing. (8)
Mr. Gates: What the intelligence paper said was less firm. It
stated that it was their judgement that the Vietnamese had
several hundred remains. (8)
General Vessey: We really don't know. We need to know where we
go from here. We need to use our leverage to force the pace.
The best leverage we have is to go ahead with the Joint
Investigations, and prepare as completely as we can, because they
are dragging their feet, not us. Prior to the Joint
Investigations we need good intelligence and guidance--instead of
last minute instructions. We can also use other levers i.e. now
is the time for a letter to Thach before the next technical
talks. To suggest that we tell them we are going to stop
cooperating on POW/MIA with them is cutting off our own noses. (e)
Mr. Gates: I want to lay out the issues before us: (U)
-- On the technical team to go to Cambodia to pick up the
remains, this is O.K., and we can accept it taking a couple
of days or trips; but the rules remain the same--there are
to be no policy officials participating. (e)
-- As to "going public" with our dissatisfaction, we don't seem
to be at that point presently. But we have to be up-front
with Congress, and if it becomes public from there, SO be
it. But we have to be forthright with the Hill. (e)
-- On the categories list, we should go with the list put
together by the IAG. (C)

recently extended them a gesture by authorizing the shipment of
surplus V.A. equipment, and we got no response. We made a
significant gesture, and received nothing in return. There
should be no menu of other benefits, even if symbolic. The
Vietnamese play this like a political game, turning the tap on
and off as they please -- just like the Soviets do on the
emigration of Soviet jews. We cannot let them play the game like
that. (e)
General Vessey: I agree that the Vietnamese have used this issue
in a political way. But I also agree that it would be a mistake
to say that we will not work with them on POW/MIA issues. On the
excess equipment, we have yet to ship them anything. (e)
Mr. Gates: The political decision was taken, and the President
took some real heat for it. (e)
General Vessey: On the categories, it is unwise to move to the
IAG list. Categories were a creation to measure an increase in
solving the discrepancy cases. Now the IAG has raised the idea
of remaking the categories, in order to advise the Vietnamese
that when the discrepancy cases are finished that this is not the
end of the list. But the Vietnamese have no doubt of what
performance is expected of them. We will lose three months if we
do this. This will open a pandora's box that we do not need. (e)
Mr. Gates: Are different categories being proposed than
previously exist? (e)
General Vessey: Yes, and this is unnecessary. I would have had
another list, but we can stay with the existing one. We should
push for progress and make no bones about it. (C)
Mr. Kimmitt: We all agree on a possible Cambodian repatriation
on the terms suggested. (e)
-- On the categories, we do have an existing set, but they are
pressing us on the basis of them to close cases without
sufficient evidence. The new categories are an attempt by
the IAG to set out on what terms we are or are not accepting
resolution of cases. (C)
-- On "going public", there is no affirmative campaign to do
this, but we should be prepared to do SO if necessary.
However, I agree we need to be straight-forward with
Congress. (e)
-- We are positively inclined on showing our willingness to
take some politically symbolic action -- if the Vietnamese
show progress first. We don't want to take these actions

now, but we should let the Vietnamese know what we will do
if they first took some action. (e)
(Addressing General Vessey) The overall message of your letter
is a little at variance with the message we need to send (refers
to language in the draft Vessey/Thach letter). Nowhere in your
draft letter do you say that the Vietnamese are not performing as
they should. It stops short of saying that their performance is
an obstacle to progress, or that they should start performing.
With correct wording, we should tell them they cannot treat this
issue like a spigot -- they need to know they can't jerk us
around. We need to be very straightforward with them about their
lack of results. (e)
Mr. Gates: It doesn't talk about policy consequences, about the
results of not performing. (e)
General Vessey: I don't want to get into a debate as to where
they are not performing. We need just to tell them where they
need to be performing better. (e)
Mr. Gates: Let's come back to that. (U)

both to our own community, as well as to the Vietnamese. We

any issues still in dispute after that, the Principals can
resolve them -- these issues should not need to go to the

issue is whether these proceed two weeks after these talks --
JCRC says that they need four weeks to proceed. The IAG wants
the teams out before the League's Annual Meeting. But we need
proper preparation, we don't want to get in and out of Vietnam in
a half-baked fashion. We need to settle this SO JCRC understands
what they need to do. (e)
Mr. Gates: What is this issue of timing? (e)
Mr. Wolfowitz: Perhaps Carl Ford can assist us. (e)

Mr. Ford (DAS/ISA) : We have sent a cable to JCRC. They have
indicated that they want to hold the Tech Talks on June 4-5, and
we want to move the date forward. This really concerns me. My
sense is that we are increasingly at risk of loosing the League.
There has been a running battle between Ann Mills Griffiths and
General Vessey on a number of issues. At the same time, the
League is being accused of being too close to the Administration.
They may be close to taking a leap. They have the real
perception that we are not pushing the Vietnamese hard enough.

Mr. Gates: This feeds into the question of ensuring the letter
is strong enough. What the letter should say is that while there
has been some modest effort in certain areas, overall performance
is unsatisfactory, there is great room for improvement, and that,
in the absence of improvement, cooperation with them on this

General Vessey: I see no problems in changing the letter in that

Mr. Gates: In terms of getting the Summary of Conclusions to
you, how long are you going to be in town for Jack? (U)

pressing us on the basis of them to close cases without

(Addressing General Vessey) The overall message of your letter
is a little at variance with the message we need to send (refers
to language in the draft Vessey/thach letter). Nowhere in your
draft letter do you say that the Vietnamese are not performing as
they should. It stops short of saying that their performance is
an obstacle to progress, or that they should start performing.
With correct wording, we should tell them they cannot treat this
issue like a spigot -- they need to know they can't jerk us
around. We need to be very straightforward with them about their
lack of results. (&)
Mr. Gates: It doesn't talk about policy consequences, about the
results of not performing. (C)
General Vessey: I don't want to get into a debate as to where
they are not performing. We need just to tell them where they
need to be performing better. (&)

There has been a running battle between Ann Mills Griffiths and
General Vessey on a number of issues. At the same time, the
League is being accused of being too close to the Administration.
They may be close to taking a leap. They have the real
perception that we are not pushing the Vietnamese hard enough.

Mr. Gates: This feeds into the question of ensuring the letter
is strong enough. What the letter should say is that while there
has been some modest effort in certain areas, overall performance
is unsatisfactory, there is great room for improvement, and that,
in the absence of improvement, cooperation with them on this
issue may be jeopardized. (8)
General Vessey: I see no problems in changing the letter in that
way. (U)
Mr. Gates: In terms of getting the Summary of Conclusions to
you, how long are you going to be in town for Jack? (U)
General Vessey: I will be leaving this evening at 6:30 pm, SO
getting them to me later will be fine. (U)
Mr. Gates: In that case, I want to concentrate on the categories
list. At the least, we should get a clearer statement of
principles behind any remaining points of disagreement. Also,
the IAG should take a look at Jack's letter.
