DISPUTED IRAN COMPUTER CASES
(s) The following proposed computer exports to Iran were
considered by the SNEC agencies December 13, 1991 and by the ACEP
on December 17, 1991. These cases have been escalated to the
EARB, which must meet no later than January 21, 1992 unless the
cases are otherwise resolved. (See attached letter from
Defense).

(e) The ACEP voted unanimously to approve these cases with the
following license conditions: 1. No nuclear end-users/uses; and
2. No retransfer without prior USG authorization. In reaching
this recommendation, the agencies approved the majority (4-1)
recommendation by the SNEC, which took into account the
provisions in "Export Licensing Policy for Iran" which provides
for a presumption of denial of computers between the levels of
12.5 CTP and 41 CTP to Iran, "except if prior business

(e) After the ACEP meeting, Defense indicated it wanted to
change its recommendation to denial.
(FOUO) The following information was used by Commerce in voting
at the ACEP meeting to reaffirm the SNEC recommendation. This
information was NOT presented at the ACEP meeting, as doing so
would have been superfluous given the 5-0 vote.
(FOUO) Prior to the ACEP meeting Commerce contacted each one of
the applicants regarding the proposed export to compare the facts
of each case to the tests in "Export Licensing Policy for Iran."
