Dear Mr. McElwee:
On behalf of the President, thank you for your letter of July 19,
outlining the Church of Brethren's concerns about the
humanitarian situation in Iraq. I regret the delay in
responding; unfortunatley your letter was misdirected in the
White House. The Administration has taken note of the strong
support expressed by your members for Congressman Penny's House
Concurrent Resolution 168.
As you are probably aware, the U.S. Security Council has since
taken decisive action to bring humanitarian relief to the people
of Iraq. Security Council Resolution 706 and 712 establish a
procedure whereby Iraq will be allowed to export oil valued at
$1.6 billion over a six month period. Most of the proceeds will
be available for Iraqi purchases of food, medical supplies, and
other essential civilian needs. A key element of this plan is
its provision for U.N. control and oversight to ensure that
relief supplies reach all vulnerable groups in Iraq, including
those deliberately deprived in the past by the Saddam Hussein
regime. For you information, a fact sheet on the two resolutions
is enclosed.
It is now up to Saddam Hussein to respond to the United Nations.
We encourage your organization to speak out and call on Iraq to
act.

U.N. SECURITY COUNCIL RESOLUTIONS 706 AND 712

Documentation
1. U.N. Security Council Resolution 706 (1991), adopted on August 15,
1991. Sets out the broad elements of the program.
2. Report by the Secretary-General Pursuant to Paragraph 5 of
Security Council Resolution 706 (1991). Submitted September 4,
1991. Provides detailed recommendations on implementation of the
program.
3. U.N. Security Council Resolution 712 (1991), adopted on September
19, 1991. Approves the recommendations in the Secretary-General's
report.
KEY ELEMENTS OF THE PROGRAM
Sale of Iraqi Qil
o
Iraq will be permitted to export petroleum and petroleum products
up to a value of $1.6 billion over a six-month period beginning
September 19, 1991.
Oil will be marketed and sold by the Iraqi state oil company,
SOMO, under the control of the U.N. Sanctions Committee. Each
contract will be reviewed by U.N. inspection agents, and approved
by the Sanctions Committee under a 24-hour "no objection"
procedure.
o
The full amount of each purchase price will be deposited by the
purchaser into an escrow account set up and administered by the
United Nations.
o
All oil will be exported via the Kirkuk-Yumurtalik pipeline which
runs through Turkey. U.N. inspectors, reporting regularly to the
Sanctions Committee, will be posted at points of Iraqi access to the
pipeline, at the loading terminal in Turkey, and at the Iraq-Turkey
border to monitor the flow of oil and to ensure compliance with the
resolution.

Iraq will compensate Turkey for use of the pipeline at a negotiated
price. Iraq will be permitted to export an additional quantity of oil
to pay Turkey in kind for this service.
Disbursements from the U.N. Escrow Account
Disbursements will be made from the escrow account for the
following purposes (Secretary-General's cost estimates in
parentheses):
--30 pct deduction as a contribution to the Compensation Fund,
towards settlement of claims arising from Iraq's invasion and
occupation of Kuwait ($480 million);
--deductions to help pay for the activities of the Special Commission
and IAEA, boundary demarkation, and the return of Kuwaiti
property ($96 million);
--U.N. administrative costs in implementing the resolution ($25.3
million);
--assistance to be provided by the U.N. directly to vulnerable groups
in Iraq outside the reach of the official government distribution
system ($65 million);
--purchase and transportation of food, medical supplies, and other
essential civilian needs for the Iraqi people to be distributed through
normal Iraqi channels ($933.7 million).
The amount of $1.6 billion in the escrow account will be released by
successive decisions of the U.N. Sanctions Committee in three equal
tranches. Release of the first tranche was authorized on September
19, 1991, subject to controls over actual disbursements as described
below.
Purchase and Deliveries of Humanitarian Goods
o
The Government of Iraq will prepare a list of its specific needs in the
way of foodstuffs, medical supplies, and other essential civilian
goods. This list will be reviewed by the Executive Delegate of the
Secretary-General, revised as necessary, and submitted to the U.N.
Sanctions Committee for approval under a "no objection"
procedure.

After the list has been approved, the Iraqi Government (under U.N.
supervision) will arrange for the purchase and delivery of
humanitarian goods. In accordance with Resolution 687, goods
other than food and medical supplies must be approved individually
by the Sanctions Committee, under the "no objection" procedure,
upon the request of the exporting country's government.

The Secretary-General will approve disbursements from the escrow
account for approved purchases to the extent that funds are
available in the current authorized tranche.
o
U.N. inspection agents will be stationed at the relevant ports of
unloading and at the border entry points into Iraq. U.N. personnel
will monitor the arrival of the supplies at border entry points, and
their transportation to designated distribution centers.
o
U.N. personnel in Iraq, assisted to the extent possible by
non-governmental organizations (NGOs), will continue to monitor
the movement and impact of these supplies as they are distributed,
through normal Iraqi channels, to all segments of the Iraqi
population.

Dear Mr. President:
During the week of July 2-7, 1991, the Church of the Brethren held
its Annual Conference in Portland, Oregon. During that week,
members of our church had the opportunity to consider endorsing
Congressman Timothy J. Penny's House Concurrent Resolution 168, a
copy of which is enclosed for your reference. H.C.R. 168 proposes
to release some frozen Iraqi assets to appropriate United Nation
agencies for the purpose of responding to the worsening medical
crises afflicting the civilian population of Iraq.
As you can see from the enclosed photocopy of the petition, nearly
three hundred members of our Church made the effort to read through
H.C.R. 168 and sign their names and addresses as a statement of
their support.
I am certain that you are well aware of the deteriorating medical
and sanitary conditions in Iraq. We have appreciated your
conviction and public statements indicating that the United States
has no quarrel with the people of Iraq. As I am sure you are
aware, both from reports from various officials of the United
Nations, as well as medical delegations from this and other
countries, the need for humanitarian assistance for the people of
Iraq is indeed quite urgent. Estimates are that by the end of the
summer, over 170,000 Iraqi children will have died from the
worsening malnutrition and medical epidemics in Iraq.
As indicated by the petition, many members of the Church of the
Brethren believe that Congressman Penny's legislation offers a
positive response to this tragic situation and provides an
effective means of response through the use of appropriate UN
agencies.

We will continue to follow H.C.R. 168 in hopes that it receives a
favorable review from the House Foreign Affairs Committee and finds
its way to your desk. If so, we would greatly appreciate your
serious consideration of Congressman Penny's legislation when it

remembering the endorsement of many members of the Church of the
Brethren regarding this important piece of legislation.

IN THE HOUSE OF REPRESENTATIVES

Mr. PENNY submitted the following concurrent resolution; which was referred
to the Committee on Foreign Affairs
CONCURRENT RESOLUTION
Expressing the sense of the Congress that a portion of Iraq's
frozen assets be released to UNICEF for the sole pur-
pose of providing medical and humanitarian assistance
to Iraqi citizens.
Whereas medical teams from the United States have reported
conditions in Iraq to be a "public health catastrophe";
Whereas widespread and severe malnutrition currently exist
in Iraq due to an acute food shortage that, if not re-
lieved, could become a famine;
Whereas infant and child mortality are expected to double,
and if conditions remain unchanged, at least another
170,000 Iraqi children under age five will die this year
in addition to the 55,000 who have already died;

Whereas cholera, dysentery, typhoid and gastroenteritis are
at epidemic proportions and incidence of all forms. of
water-borne diseases will increase during the summer
months;
Whereas the Iraqi health care system is operating at a frac-
tion of its former capacity;
Whereas basic infrastructure necessary to meet public health
needs-water purification, sewage treatment and electri-
cal power-has been substantially reduced; and
Whereas the condition of the children of Iraq are an interna-
tional humanitarian concern that must be addressed im-
mediately: Now, therefore, be it

Resolved by the House of Representatives (the Senate
2 concurring), That it is the sense of the Congress that the
3 United States should ask the United Nations to release
4 through UNICEF a portion of Iraq's frozen assets for the
5 sole purpose of providing medical and humanitarian as-

U.N. Security Council Resolution 706 (1991), adopted on August 15,
1991. Sets out the broad elements of the program.
2. Report by the Secretary-General Pursuant to Paragraph 5 of
Security Council Resolution 706 (1991). Submitted September 4,
1991. Provides detailed recommendations on implementation of the
program.

U.N. Security Council Resolution 712 (1991), adopted on September
19, 1991. Approves the recommendations in the Secretary-General's
report.
KEY ELEMENTS OF THE PROGRAM
Sale of Iraqi Oil
Iraq will be permitted to export petroleum and petroleum products
up to a value of $1.6 billion over a six-month period beginning
September 19, 1991.
Oil will be marketed and sold by the Iraqi state oil company,
SOMO, under the control of the U.N. Sanctions Committee. Each
contract will be reviewed by U.N. inspection agents, and approved
by the Sanctions Committee under a 24-hour "no objection"
procedure.
The full amount of each purchase price will be deposited by the
purchaser into an escrow account set up and administered by the
United Nations.
All oil will be exported via the Kirkuk-Yumurtalik pipeline which
runs through Turkey. U.N. inspectors, reporting regularly to the
Sanctions Committee, will be posted at points of Iraqi access to the
pipeline, at the loading terminal in Turkey, and at the Iraq-Turkey
border to monitor the flow of oil and to ensure compliance with the
resolution.

Iraq will compensate Turkey for use of the pipeline at a negotiated
price. Iraq will be permitted to export an additional quantity of oil
to pay Turkey in kind for this service.
Disbursements from the U.N. Escrow Account
Disbursements will be made from the escrow account for the
following purposes (Secretary-General's cost estimates in
parentheses):
--30 pct deduction as a contribution to the Compensation Fund,
towards settlement of claims arising from Iraq's invasion and
occupation of Kuwait ($480 million);
--deductions to help pay for the activities of the Special Commission
and IAEA, boundary demarkation, and the return of Kuwaiti
property ($96 million);
--U.N. administrative costs in implementing the resolution ($25.3
million);
--assistance to be provided by the U.N. directly to vulnerable groups
in Iraq outside the reach of the official government distribution
system ($65 million);
--purchase and transportation of food, medical supplies, and other
essential civilian needs for the Iraqi people to be distributed through
normal Iraqi channels ($933.7 million).

The amount of $1.6 billion in the escrow account will be released by
successive decisions of the U.N. Sanctions Committee in three equal
tranches. Release of the first tranche was authorized on September
19, 1991, subject to controls over actual disbursements as described
below.

The Government of Iraq will prepare a list of its specific needs in the
way of foodstuffs, medical supplies, and other essential civilian
goods. This list will be reviewed by the Executive Delegate of the
Secretary-General, revised as necessary, and submitted to the U.N.
Sanctions Committee for approval under a "no objection"
procedure.

After the list has been approved, the Iraqi Government (under U.N.
supervision) will arrange for the purchase and delivery of
humanitarian goods. In accordance with Resolution 687, goods
other than food and medical supplies must be approved individually
by the Sanctions Committee, under the "no objection" procedure,
upon the request of the exporting country's government.

The Secretary-General will approve disbursements from the escrow
account for approved purchases to the extent that funds are
available in the current authorized tranche.
o
U.N. inspection agents will be stationed at the relevant ports of
unloading and at the border entry points into Iraq. U.N. personnel
will monitor the arrival of the supplies at border entry points, and
their transportation to designated distribution centers.
o
U.N. personnel in Iraq, assisted to the extent possible by
non-governmental organizations (NGOs), will continue to monitor
the movement and impact of these supplies as they are distributed,
through normal Iraqi channels, to all segments of the Iraqi
population.

Dear Mr. President:
During the week of July 2-7, 1991, the Church of the Brethren held
its Annual Conference in Portland, Oregon. During that week,
members of our church had the opportunity to consider endorsing
Congressman Timothy J. Penny's House Concurrent Resolution 168, a
copy of which is enclosed for your reference. H.C.R. 168 proposes
to release some frozen Iraqi assets to appropriate United Nation
agencies for the purpose of responding to the worsening medical
crises afflicting the civilian population of Iraq.
As you can see from the enclosed photocopy of the petition, nearly
three hundred members of our Church made the effort to read through
H.C.R. 168 and sign their names and addresses as a statement of
their support.
I am certain that you are well aware of the deteriorating medical
and sanitary conditions in Iraq. We have appreciated your
conviction and public statements indicating that the United States
has no quarrel with the people of Iraq. As I am sure you are
aware, both from reports from various officials of the United
Nations, as well as medical delegations from this and other
countries, the need for humanitarian assistance for the people of
Iraq is indeed quite urgent. Estimates are that by the end of the
summer, over 170,000 Iraqi children will have died from the
worsening malnutrition and medical epidemics in Iraq.
As indicated by the petition, many members of the Church of the
Brethren believe that Congressman Penny's legislation offers a
positive response to this tragic situation and provides an
effective means of response through the use of appropriate UN
agencies.

CONCURRENT RESOLUTION
Expressing the sense of the Congress that a portion of Iraq's
frozen assets be released to UNICEF for the sole pur-
pose of providing medical and humanitarian assistance
to Iraqi citizens.
Whereas medical teams from the United States have reported
conditions in Iraq to be a "public health catastrophe";
Whereas widespread and severe malnutrition currently exist
in Iraq due to an acute food shortage that, if not re-
lieved, could become a famine;
Whereas infant and child mortality are expected to double,
and if conditions remain unchanged, at least another
170,000 Iraqi children under age five will die this year
in addition to the 55,000 who have already died;

Whereas cholera, dysentery, typhoid and gastroenteritis are
at epidemic proportions and incidence of all forms of
water-borne diseases will increase during the summer
months;
Whereas the Iraqi health care system is operating at a frac-
tion of its former capacity;
Whereas basic infrastructure necessary to meet public health
needs-water purification, sewage treatment and electri-
cal power-has been substantially reduced; and
Whereas the condition of the children of Iraq are an interna-
tional humanitarian concern that must be addressed im-
mediately: Now, therefore, be it
