Updating FBI Investigations: White
House Staff and Presidential Appointees
If you will sign and forward the attached letter to the AG (Tab A), the
memo to Jane Dannenhauer (Tab B), and the memo to Bill Walker
(Tab C), the plan for updating the FBI investigations of White House
Staff and Presidential Appointees will be underway in accordance
with your views and those expressed by Messrs. Rumsfeld, Lowitz
and Walker.
These will authorize updates of full-field investigations by the FBI
for all White House personnel on a three-year basis and for Presidential
appointees on a five-year basis subject to the reservation excluding
those who have submitted resignations which have been accepted, or
who have indicated a definite departure date but have not yet submitted
resignations, provided that in both instances a notation to that effect
has become a part of their official personnel file.
It is clear that updates will not be necessary with respect to any personnel
currently on detail at San Clemente. All nine (9) people currently on
detail there are not due for updates until 1975, at which time they will
no longer be White House personnel (under the "Presidential Transition
Act", they will become "transition employees" as of February 9).
The only other employee currently at the White House who was
rumored to be going to San Clemente is Ken Khachigian, and I under-
stand that he is due for an update this year. However, Khachigian
will soon be going to Agriculture and therefore does not require an
update by us.

Also attached are the lists of White House staff and detailee updates
(Tab D) and those on the staff who have already left or are committed
ADMINISTRATIVELY CONFIDENTIAL

to leaving on a date certain (Tab E). Tab F shows the list of
Presidential appointee updates scheduled to be completed this year --
the list excludes the Departments of Defense, State and Justice as
there are no current Presidential appointees from 1969 in the
Defense Department, and State as well as Justice are responsible
for initiating security updates on Presidential appointees within their
respective departments.
The various forms which will be used for this purpose are also contained
in the appendix. Tab G shows the form memos (original and update)
which have been utilized in the past to request information from White
House staffers in order to facilitate their original investigation or up-
dates. Tab H shows the Standard Form 86 to be filled out by the
employee being investigated -- investigations of Presidential appointees
are done off of resumes. Tab I shows the form for communication of
information and request for update to the Bureau. Tab J shows a
proposed form letter to be used by the White House Security Officer
to the appropriate Department Security Officer regarding updates of
security checks on Presidential appointees. Tab K shows a proposed
form letter to be used by Counsel to the President to notify Presidential
appointees of a request for a security update. Tab L shows a proposed
form letter to the Special Prosecutor to be used by Counsel to the
President requesting any appropriate and available information on
appointees.
This should put our security program on track. However, I believe that
current policy should be changed to require advance security and conflicts
clearance for White House personnel as is the case with Presidential
appointees. Assuming the various senior staff members here would
abide by such a policy (I know that Don Rumsfeld favors such a change),
it would not be difficult to implement and, in the vast majority of cases,
would not be unduly burdensome. Do you want me to institute such a
change?
I have familiarized myself with the White House security program and
will be able to provide Jane Dannenhauer with any guidance that she
might need.

This is to request that you take such steps as are necessary to
institute a policy of updating the security checks of Presidential
appointees with FBI full-field investigations at five-year intervals
and advise the Civil Service Commission and Departmental Security
Officers accordingly. I have also requested the Attorney General
to continue the policy of updating security checks of the White House
staff every three years by FBI full-field investigations.
As you know, these investigations are subject to a reservation
excluding those who have submitted resignations which have been
accepted, or who have indicated a definite departure date but have
not yet submitted resignations, provided that in both instances a
notation to that effect has become a part of their official personnel
file. In order to carry forward this policy, it will, of course, be
necessary to keep abreast of the status of Presidential appointees
and members of the White House staff. Therefore, prior to any
request for an investigation and again prior to the actual initiation of
any investigation, you should check the status of the individual
under consideration with either Bill Walker's office or the Personnel
Office as appropriate. Additionally, prior to the grant of any final
security approval, the individual under consideration should be
cleared by Ken Lazarus of my office.
Kindly continue to refer any questions which you may have in this
regard to Mr. Lazarus.

understanding that you are reporting the resignations of regular White
House staffers and Presidential appointees to the office of the
Staff Secretary.

Ken Lazarus. This will allow us the opportunity to run the name by
the Special Prosecutor.

as Chairman, NLRB
On January 3, 1975, The President approved the nomination of
Betty Southard Murphy as Chairman of the National Labor
Relations Board.
Betty Murphy's most recent FBI full field investigation was
completed in April 1974; an up date is in process. A
special clearance was ordered on January 6. Her conflicts
of interest clearance is complete.
The decision memorandum to the President proposed prompt
announcement of the intention to nominate Mrs. Murphy in
order to prevent the labor-management consensus on her
nomination from unraveling.
This memorandum requests your approval of a waiver of
pending clearances only for the purpose of an early an-
nouncement of an intention to nominate. All clearances will
be final before the nomination is made.
I grant the waiver of final clearances for purposes of
announcement.

BETTY SOUTHARD MURPHY
ADMINISTRATOR, WAGE AND HOUR DIVISION
DEPARTMENT OF LABOR
Betty Southard Murphy, a labor lawyer with a nationwide
reputation, was sworn in as Administrator of the Wage and
Hour Division, on July 15, 1974.
As Administrator, Mrs. Murphy supervises the Department's
responsibilities under some 70 different labor laws including
the Fair Labor Standards Act, which includes minimum wage
provisions affecting 56 million workers, the Equal Pay Act,
which requires men and women receive equal pay for equal work,
the Age Discrimination in Employment Act, which prohibits
discriminatory employment practices based on age, the Walsh-
Healey Public Contracts Act, the Davis-Bacon Act, the Service
Contract Act, the Farm Labor Contractor Registration Act, and
a number of other labor laws. She oversees a $37 million
budget and over 1,500 employees.
Before accepting this appointment, Mrs. Murphy was a partner
in the Washington, D. C. law firm of Wilson, Woods and Villalon
where she specialized in labor, corporate and administrative
law. She is one of the few lawyers in the United States who
represented both international unions and employers.
In private practice, Mrs. Murphy was an active trial lawyer
and tried cases or appeared in Federal or State Courts in
19 different States and argued in 9 of the 11 United States
Courts of Appeals.
Mrs. Murphy began her career as a reporter--first as corre-
spondent and free lance journalist in Europe and Asia and
later with United Press (now UPI) After graduating from
law school, she was an enforcement attorney with the National
Labor Relations Board during 1958-1959.
Mrs. Murphy--the first woman to be named Administrator--is
a Trustee of the American University, is on the National
Board of the Medical College of Pennsylvania, and is Chair-
man of the Board of Visitors of Mary Baldwin College.

Her concern with civil rights and equal employment oppor-
tunity for workers is well established. She has been
active as Chairman of the District of Columbia Bar Associa-
tion's Civil Rights Committee, and the Fair Employment
Practices Committee; the Federal Bar Association's Committee
on Equal Employment Opportunity and Collective Bargaining;
the Women's Bar Association's Committee on the Status of
Women; and is also Vice Chairman of the Labor Law Committee,
Administrative Law Section, American Bar Association.
She received a B.A. degree (oriental studies) from the Ohio
State University and also studied in Paris at the Sorbonne
and the Alliance Francaise. She obtained her J.D. degree
in 1958 from the American University Washington College of
Law.
Mrs. Murphy and her husband, Dr. Cornelius F. Murphy, a
Radiologist, reside in Annandale, Virginia, with their two
children, Ann, 6, and Neil, 5.

REQUESTS FOR SECURITY INVESTIGATIONS,
INSPECTION OF INVESTIGATIVE FILES AND
USE OF INVESTIGATIVE INFORMATION
By virtue of the authority vested in me as President of the
United States, and in the interest of protecting the rights of
individuals to privacy and confidentiality regarding their affairs
consistent with proper internal management of the Government, it
is hereby ordered that:
(1) General Rule: Requests for law enforcement
investigations or investigative files by White House personnel on
behalf of the President shall be limited to security clearances for
Presidential appointees or candidates for Presidential appointment
to Federal office in accordance with the restrictions set forth below;
(2) Requests: Security investigations of candidates for
Presidential appointment to Federal office and requests for
subsequent updates of such security investigations shall be initiated
by the Federal Bureau of Investigation only through the White House
Security Office upon the request of Counsel to the President or
Associate Counsel to the President with the approval of the candidate
for appointment;
(3) Inspection: The inspection of investigative files resulting
from requests for security investigations of Presidential appointees or
candidates for Presidential appointment to Federal office, shall be
limited to Counsel to the President or Associate Counsel to the
President or his designate; and

In 1965 Gill was charged by Florida officials wit
ing more than $11,000 in worthless checks in com
with the purchase of a houseboat.
Judges in Miami, Fla., and the District of Co
later dismissed the charges against Gill, stating
no reason to believe the checks would bounce. ]
allegedly given one bad check as payment for inst
of a closed-circuit TV system on the houseboat.
GILL SAID he had bought the boat originally

Republican national convention as an unofficial ga

During the 1968 presidential campaign, Gill became

assistant national chairman of the Citizens for Nixon-
Agnew Committee.

Gill also had worked for a time in behalf of Senator
Barry M. Goldwater's 1964 presidential campaign.

Scripps-Howard Newspapers reported at that time that

Gill was responsible for hiring in the campaign a right-

wing extremist, Allen A. Zoll, who once headed a group
listed by the U.S. attorney general as "fascist."

IN 1969, GILL became involved in a communications
project for the Zambian government and in that connec-

tion was associated for some time with Marshall
(
Soghoian, later accused by federal authorities of being an
unregistered foreign agent.
In early June, 1969, Soghoian allegedly used Gill's

apartment to pack three large steamer trunks with crude
I
bugging devices. The trunks were shipped to Zambia
E
under diplomatic immunity.
Gill has acknowledged that the trunks were packed in
his apartment, but states that he can prove that he was
out of the country at the time.

Biographical Data
Philip W. Buchen has been Counsel to the President since August 15, 1974.
Prior to his appointment, Mr. Buchen was a senior partner in the law firm
of Law, Buchen, Weathers, Richardson and Dutcher of Grand Rapids,
Michigan, and served as Executive Director of the Domestic Council
Committee on the Right of Privacy. He is a former law partner of the
President. Mr. Buchen was a member of the United States Delegation to
the INTELSAT Conference which negotiated the definitive arrangements for
the International Telecommunications Satellite Organization between 1969
and 1972. From 1969 to 1974, he served on the Board of Directors of the
COMSAT Corporation.
He was born or February 27, 1915, in Sheboygan, Wisconsin. Mr. Buchen
received a B.A. degree from the University of Michigan in 1939 and a J.D.
degree from the University of Michigan Law School in 1941. He is a member
of the Michigan State Bar.
Mr. Buchen is married to the former Beatrice Loomis. They have a son,
Roderick, and 2 daughter, Mrs. Victoria Aler. They reside in Washington,
D. C.

Jane Dannenhauer advises that the background investigations on
three of the President's four nominees to the Public Documents
Commission (yourself, Herbert Brownell and Professor May)
will be completed as of this week. Jane has not yet received
the name of the remaining nominee although Congress is to
recess for the remainder of August after next week. If it is
planned to send all four names to the Hill prior to recess, the
time is extremely short for Jane to have the Bureau conduct
any sort of background investigation.
(of course, you do not require Senate confirmation
for your membership on the Commission, while
the remaining three candidates do).
