Relief of Jan Sejna
Attached for your consideration is S. 2594, sponsored by
Senator Eastland.
The beneficiary, Jan Sejna, is a native and citizen of
Czechoslovakia who was admitted to the United States in
1968. In Czechoslovakia Sejana was a Major General and
a member of the Communist Party from 1946 until he defected
to the United States in 1968.
S. 2594 would waive certain provisions of the Immigration
and Nationality Act which prohibits the naturalization of
aliens who were within subversive classes within ten years
of their filing of a petition of naturalization.
OMB recommends approval and provides additional information
in its enrolled bill report (Tab A).
Max Friedersdorf, Phil Areeda and the NSC recommend approval.

Discussion
Beneficiary is a 46 year old native and citizen of Czechoslovakia.
He was admitted to the United States on February 28, 1968, with
his 23 year old son for permanent residence. He is employed by
the U.S. Government.
Beneficiary was born in Czechoslovakia and enlisted in the army
in Czechoslovakia in 1949. He rose to the rank of Major General
and defected to the United States in 1968. From 1946 to 1968 he
was a member of the Czechoslovakian Communist Party.
The Immigration Act prohibits naturalization of aliens who were
within subversive classes within ten years of their filing of
a petition for naturalization.

Mr. Sejna's wife and two adopted children, a father, and a
married sister are still in Czechoslovakia. He has had no
personal contact with them since his defection.
The report of the Senate Committee on the Judiciary states
that the Committee:
"after consideration of all the facts in the case,
is of the opinion that the bill (S. 2594) should
be enacted."

Dear Mr. Ash:
This is in response to your request for the views and
recommendations of the Central Intelligence Agency on Enrolled
Bill, S. 2594, "An Act for the relief of Jan Sejna. "
The bill would waive the provisions of the Immigration
and Nationality Act which prohibit the naturalization of aliens
who were within the subversive classes during a period of ten
years immediately preceding the filing of a petition for
naturalization.
The Central Intelligence Agency actively supports this
bill and gave testimony in executive session before the House
Judiciary Committee in support of the measure. Future activities
of General Sejna in support and assistance to the United States
Government and its allies will be enhanced by waiver of the
limitation on his ability to gain United States citizenship.
I strongly recommend approval of S. 2594 by the President.

The Committee on the Judiciary, to which was referred the bill
(S. 2594) for the relief of Jan Sejna, having considered the same,
reports favorably thereon without amendment and recommends that
the bill do pass.
PURPOSE OF THE BILL
The purpose of the bill is to enable Jan Sejna to file a petition for
naturalization, notwithstanding the provisions of section 313 of the
Immigration and Nationality Act relating to one who was formerly
a member of a proscribed organization.
STATEMENT OF FACTS
The beneficiary of the bill is a 46-year-old native and citizen of
Czechoslovakia who was admitted to the United States, together with
his 23-year-old son, for permanent residence on February 28, 1968.
He is presently employed by the United States Government.
A letter, with attached memorandum, dated January 14, 1974, to the
chairman of the Senate Committee on the Judiciary from the Com-
missioner of Immigration and Naturalization with reference to the

tion and Naturalization Service files relative to the bene-
ficiary.
The beneficiary, Jan Sejna, is a native and citizen of
Czechoslovakia, born on May 13, 1927. He lives with his
twenty-three year old son. The beneficiary enlisted in the
Czechoslovakian Army in 1949; and following the attain-
ment of officer's rank in 1951, he rose to the rank of Major
General before defecting to the United States in 1968. He
was a member of the Czechoslovakian Communist Party
from 1946 to 1968. He is presently employed by the United
States Government at an annual salary in excess of $19,000.
He values his equity in real estate holdings in this country
at $30,000.
The beneficiary is married to a native of the Ukraine,
USSR, who lives in Czechoslovakia with his two adopted,
adult children. His father and one married sister are still
living in their native Czechoslovakia. He has had no per-
sonal contact with his wife, adopted children, father or sister
since his defection to this country.
The beneficiary and his son were lawfully admitted to the
United States for permanent residence on February 28, 1968.
The committee, after consideration of all the facts in the case, is
