He was admitted to the U.S. for permanent residence in June 1967, and his wife and two minor children are also lawful permanent residents of the U.S. Since July 1969, Mr. Massara and his family have been residing in Beirut, Lebanon, where he is employed as a foreign sales representative by Raytheon Company at an annual salary of $24,000. On June 26, 1972, the beneficiary filed a petition for naturali- zation and was found ineligible for U.S. citizenship under the residence and physical presence requirements of the Immigration and Nationality Act ("the Act"). However, the beneficiary's employment as a foreign sales representative with Raytheon Company has required him to travel extensively abroad and has prevented him from accumulating this presence in the proper continuity. The beneficiary's wife and two minor children are also lawful permanent residents of the United States. Mr. Aldo Massara, a married male, native of Egypt and citizen of Italy, was born on March 13, 1935, in Cairo. He, as well as his spouse and two minor children, are lawful permanent resident aliens of the United States cur- rently residing in Beirut, Lebanon, in pursuit of his calling as the Middle East and North African areas representative of a large United States firm engaged in international trade and commerce. Subsequent to the beneficiary's acquisition of lawful per- manent resident alien status on June 27, 1967, he filed an application to Preserve Residence for Naturalization Pur- poses which was approved on June 30, 1969. With the ex- ception of a brief visit to the United States in 1966, he had no prior residence in the United States. With the exception of several brief business trips abroad, he resided continuously in the United States after acquiring permanent resident status up until July 17, 1969, when he assumed his duties abroad as the representative of his United States employer. Since July of 1969 the beneficiary has made approximately fifteen busi- ress trips to the United States of from several weeks to several months duration. On June 26, 1972, he filed a petition for naturalization on which occasion he was found not to be eligible to qualify for United States citizenship because of insufficient residence and physical presence requirements of the Immigration and Nationality Act. On this occasion, it was estimated that should no further absences occur, he would have been eligible to file a petition for naturalization on June 8, 1974. However, since that time he has departed from the United States and this date would no longer apply. The beneficiary is considered by his employer to be an ex- tremely valuable employee and as such receives an annual salary of $24,000, plus an additional overseas allowance of $11,000. He has assets totalling $21,000 consisting of $15,000 in personal effects and $6,000 in cash. His indebtedness totals 3 $4,500. By waiving the referenced provisions of the Act toward expediting the acquisition of United States citizen- ship, the beneficiary, as well as his employer, believe it will facilitate their overseas operations and inure to the benefit of the United States in the furtherance of its foreign trade and commerce. Congressman Paul W. Cronin, the author of the bill, submitted the following statement in support of his bill: STATEMENT OF HON PAUL W. CRONIN, M.C., 5TH MASSACHU- SETTS DISTRICT, RELATIVE TO H.R. 9654, A BILL FOR THE RELIEF OF MR. ALDO MASSARA Mr. Chairman, your committee is considering H.R. 9654 which would grant relief to Mr. Aldo Massara who appeared for naturalization at the Boston Office of the Immigration and Naturalization Service on June 23, 1972. Although Mr. Massara today has thirty months physical presence in the United States as is required by the Naturali- zation law. On June 23, 1972, through a miscalculation he lacked approximately 44 days of this 30 months physical presence. Mr. Massara first entered the United States on June 23, 1967, as an Italian National carrying Italian pass- port No. 837944/P entering for permanent residence. Mr. Massara resided in the United States from June 23, 1967, to July 17, 1969, except for the brief absences on business trips. Since June 15, 1970, Mr. Massara has spent additional time in the United States SO that he has accumulated the required 30 months physical presence in the United States. Since June 1969 Mr. Massara has served as Manager of the Beirut office of Raytheon Overseas Ltd. He presently resides at 192 Ave- nue Spears IMM, Union National Beirut, Lebanon. Raytheon Company is a large international company with its executive office and many of its plants and laboratories in the 5th Congressional District. Raytheon's annual sales vol- ume is in excess of $1,600,000,000. Approximately 25% of this volume is derived from foreign sales. These foreign sales are heavily concentrated in Europe and Middle Eastern areas. As Raytheon's representative in Beirut, Lebanon, Mr. Mas- sara is charged with developing Raytheon markets in the Near and Middle East and Eastern African territories. He has linguistic abilities and marketing capabilities which make his contribution to his employer a substantial factor in their foreign sales. Raytheon Company markets in his terri- tory in the fields of energy development, education, air traffic control, undersea exploration, computers and electronics. Mr. Aldo Massara wishes to become a United States citizen and H.R. 9654 will permit this, overcoming a technical handi- cap which his repeated absences in the Middle East has cre- ated. He now has both the 5 years of United States residence plus the 30 months of physical presence as required by the Naturalization laws. The intent of this bill is to excuse Mr. Massara from the requirement that the 30 months of physical 4 presence in the United States occur within a continuous 5- year period. Actually it has taken him a little bit more than 5 years to accumulate the required 30 months presence because of his very important position as the Beirut manager of Ravtheon Company. I hope that the Judiciary Committee will see fit to give a favorable report to H.R. 9654. These foreign sales are heavily concentrated in the European and Middle Eastern theatres. As our representative, based in Beirut. Mr. Massara materially and substantially contributes to the funda- mental soundness and expansion of this sales base. His linguistic and marketing capabilities, coupled with his intimate knowledge of the customs and psychology of the ethnic groups which populate the de- veloping nations of the Near and Middle East and Eastern Africa make him not only very valuable, but as close to indispensable as any of our foreign representatives may become. He has proven himself an admirable representative of the American way of life and, in addition to contributing to an improved U.S. balance of payments, has con- ducted himself in a manner which has enhanced the American presence in that area of the world. His responsibilities include amplification of our efforts in the fields of energy development, elucation, air traffic control. undersea exploration. computers, and electronics. Mr. Massara appeared for interview for naturalization at the Boston Office of the Immigration and Naturalization on June 23, 1972. Through a miscalculation on his part he lacked 44 days of the required 30 months physical presence in the United States. Since that time he has spent about 20 additional days in the United States on business. On this oc- casion, it was estimated that should no further absences occur, he would have been eligible to file a petition for naturaliza- tion on June 8, 1974. However, since that time he has de- parted from the United States and this date would no longer apply. The beneficiary is considered by his employer to be an ex- tremely valuable employee and as such receives an annual salary of $24,000, plus an additional overseas allowance of H.R. 1329 3 $11,000. He has assets totalling $21,000 consisting of $15,000 in personal effects and $6,000 in cash. His indebtedness totals $4,500. By waiving the referenced provisions of the Act towards expediting the acquisition of United States citizen- ship, the beneficiary, as well as his employer, believe it will facilitate their overseas operations and inure to the benefit of the United States in the furtherance of its foreign trade and commerce. STATEMENT OF HON. PAUL W. CRONIN, M.C., 5TH MASSACHU- SETTS DISTRICT, RELATIVE TO H.R. 9654, A BILL FOR THE RELIEF OF MR. ALDO MASSARA Mr. Chairman, your subcommittee is considering H.R. 9654 which would grant relief to Mr. Aldo Massara who ap- peared for naturalization at the Boston Office of the Immigra- tion and Naturalization Service on June 23, 1972. Although Mr. Massara today has thirty months physical presence in the United States as is required by the Naturali- zation law. On June 23, 1972 through a miscalculation he lacked approximately 44 days on this 30 months physical presence. Mr. Massara first entered the United States on June 23, 1967 as an Italian National carrying Italian passport No. 837944/P entering for permanent residence. Mr. Mas- sara resided in the United States from June 23, 1967 to July 17, 1969 except for the brief absences on business trips. Since June 15, 1970 Mr. Massara has spent additional time in the United States SO that he has accumulated the required 30 months physical presence in the United States. Since June 1969 Mr. Massara has served as Manager of the Beirut office of Raytheon Overseas Ltd. He presently resides at 192 Avenue Spears IMM, Union National Beirut, Lebanon. Raytheon Company is a large international company with its executive office and many of its plants and labora- tories in the 5th Congressional District. Raytheon's annual sales volume is in excess of $1,600,000,000. Approximately 25% of this volume is derived from foreign sales. These foreign sales are heavily concentrated in Europe and Middle Eastern areas. As Raytheon's representative in Beirut, Lebanon, Mr. Massara is charged with developing Raytheon markets in the Near and Middle East and Eastern African territories. He has linguistic abilities and marketing capa- bilities which make his contribution to his employer a substantial factor in their foreign sales. Raytheon Company markets in his territory in the fields of energy development, education, air traffic control, undersea exploration, computers and eléctronics. Mr. Aldo Massara wishes to become a United States citizen and H.R. 9654 will permit this, overcoming a techni- cal handicap which his repeated absences in the Middle East has created. He now has both the 5 years of United States residence plus the 30 months of physical presence as required by the Naturalization laws. The intent of this bill is to excuse Mr. Massara from the requirement that the 30 H.R. 1329 4 months of physical presence in the United States occur within a continuous 5 year period. Actually it has taken him a little bit more than 5 years to accumulate the required 30 months presence because of his very important position as the Beirut manager of Raytheon Company. I hope that the Judiciary Committee will see fit to give a favorable report to H.R. 9654.
