The Act is due to expire on December 31, 1975, and this nine-month extension will allow the Congress additional time to consider the Administration's legislation to extend the Act for five years and to make a number of substantive changes in the Board's authorities. Additional information is provided in OMB's enrolled bill report at Tab A. OMB, Max Friedersdorf, Counsel's Office (Lazarus) and I recommend approval of the enrolled bill. Minish (D) New Jersey and 13 others Last Day for Action December 31, 1975 - Wednesday Purpose To extend the Renegotiation Act for nine months. Agency Recommendations Office of Management and Budget Approval Renegotiation Board Approval Discussion The Renegotiation Act of 1951 provides for the review by the Renegotiation Board of total profits derived from Federal defense and space-related contracts if a contractor's total renegotiable sales exceed $1 million annually. If the Board determines, in accordance with certain statutory criteria, that a contractor's profits are excessive, it is empowered to return those profits to the Federal Government. The Act is due to expire on December 31, 1975. The enrolled bill would extend the Act for nine months through September 30, 1976. The Administration has submitted legislation to the Congress to extend the Renegotiation Act for five years and to make a number of substantive changes in the Board's authorities. 2 No final action has yet been taken by the Congress on this proposal. The Renegotiation Act must be extended until action on the pending legislation has been completed since, under existing law, defense and space-related contracts entered into after December 31, 1975, are not subject to renegotiation.
