Ford Presidential Library\nAcceing peccone\nSiB\nDRAFT\nDear Mr. Sampson:\ncitaten\nIn keeping with the tradition established by other\nformer Presidents, it is my desire to donate to the United\nStates, at a future date, certain of my Presidential\npapsic\nwhich are of historical value to our Country. In donating\nthese Presidential papers to the United States, it will be\nmy desire that they be made available, with appropriate\nrestrictions, for research and study.\nIn the interim, so that my papers mAt may be preserved,\nI offer to transfer to the Administrator of General Services\n(the \"Administrator\"), for deposit, pursuant to 44 U.S.C. §\n2101, et seq., all of the papers, documents, manuscripts,\nbooks and other materials Coertaining to my Presidency (the\n\"Materials\"), subject to the following:\n1. The Administrator agrees to accept solely\nfor the purpose of deposit the transfer of\nthe Materials, and in so accepting the\nprem and orter who Willine Upit wothing\nMaterials agrees to abide by each of the\ndeta\nterms and conditions contained herein.\n2. This agreement for deposit of the Materials\nshall terminate at the time of my death or\nat such earlier time as provided in paragraph\n9, hereof\nmy entire\n3. I retain al legal and equitable title to the\nMaterials, including all literary property\nrights.\nIm the coent of my death with\nthe contrastual obligations and rights\nstall more to the benefit upon\nGERALD R. FORD LIBRARY\nmy speciator\nDRAFT\n-2-\non ecosting\n4. The Materials shall, upon acceptance of this\noffer by the Administrator, be deposited tem-\nporarily in a (fac lity belonging to the United\nStates, located within the State of California\nnear my present residence. The Materials shall\nremain deposited in the temporary California\nfacility until such time as there may be\nestablished, with my approval, a permanent\nPresidential archival depository as provided\nfor in 44 U.S.C. $ 2108.\n5. The Administrator shall provide in such\ntemporary depository and in any permanent\nPresidential archival depository reasonable\noffice space for my personal use in accordance\nwith 44 U.S.C. § 2108 (f) The Materials in their\nentirety shall be deposited within such office\n- space in the manner described in paragraph 6\n= hereof.\nspears\n6. Within both the temporary and any permanent\nPresidential archival depository, all of the\nMaterials areas shall be placed within sealed storage\nto which access can be gained only by\nuse OI two keys. One key, essential for access,\nshall be given to me alone as custodian of the\nMaterials. The other key may be duplicated and\nentrusted by you to the Archivist of the United\nStates or to members of his staff.\n4.\nService area\n7. Access to the Materials within the sealed con\ntainero shall be restricted as follows:\nA. Except as provided in subparagraph B7 below\naccess shall be limited to myself, and to\nsuch persons as I may authorize from time to\ntime in writing the scope of such access to\nbe set forth by me in each said written\nauthorization. Any request for access to the\nMaterials made to the Administrator, the\nArchivist of the United States or any member\nof their staffs shall be referred to me. In\nAt\naddition to access, I shall have the right to\nwithdraw from deposit without formality any\nor all of the Materials to which this lottond\nGERALD LIBRARY\nDRAFT\n- 3 -\napplies and to letain such thdrawn\nMaterials for any personal use, reproduc-\ntion, examination, publication or display\nby myself or by anyone else I may approve.\nHowever, for a period of two years from the\ndate of the creation of the deposit, I\nagree not to withdraw from deposit any\noriginals of the Materials, except those\nportions of the Materials which relate to\nthe\nthe personal and business affairs of myself\nEduminston\nor my family. During said two year period\nI may make reproductions of any originals\nenview\nof the Materials and withdraw from deposit\ngive\nsuch reproductions for any use I deem\nappropriate.\nB. In the event that production of the Materials\nor any portion thereof is demanded by a sub-\npoena or SMOUYAR other order directed to the Adminis OFFICIAL\nB\ntrator, the Archivist the 05 vs the United States, or\nany memb of their staffs, the recipient of\nthe subpoena or order shall immediately notify\nme so that I may respond thereto, as the owner\nand custodian of the documents, materials with sole\nright and power of access thereto and, if ap-\npropriate, assert any privilege or defense I\n1\nmay have. Prior to any such production, I shall\nand determine whether it chooses to object to\nsha inform the United States so that it may IN perso\nreasonable\nthe production on grounds of national security\nor any other privilege.\n8. The Administrator shall arrange and be responsible\nfor the protection of the Materials from loss,\ndestruction or access by unauthorized persons.\ntotal\n9. In the event that any provision of this offer and,\nif accepted by you agreement for deposit of the\nMaterials is held by a court of law to be unlawful\nor unenforceable or in the event the Administrator\nFORD LIBR RW\nor any other person acting on behalf of the United\nStates fails to abide by any of the terms and\nR.\nconditions of this depository agreement, I may, in\nGERALD\nmy sole discretion, terminate the deposit provided\nfor herein.\n10. At the time of my death, any or all of the Materials\nwhich remain on deposit as provided herein shall be\nthe property of my estate to be disposed of as I\nDRAFT\n-4-\nof Sath\nhamfwill\n11. From time to time as I deem appropria :e, I\nintend to donate to the United States certain\nportions of the Materials deposited with the\nAdministrator pursuant to this agreement, such\ndonations to be accompanied by aporopriate\nrestrictions as authorized by 44 U.S.C. § 2107.\nHowever, prior to such donation, it will be\nnecessary to review he Materials to determine\nwhich of them should be subject to restrictic and\nthe nature of the restriction to be imposed. This\nreview will require a meticulous, thorough,\ntime-consuming analysis. If necessary to fulfill\nthis task, I will request that you designate\ncertain members of the Archivist's staff to\nassist in this review under my direction.\nIf you determine that the terms and conditions\nset forth-above are acceptable for the purpose of governing\nthe establishment and maintenance of a depository of the\nMaterials in S hedule A, pursuant to 44 U.S.C. § 2101,\nplease indicate your acceptance by signing the enclosed\ncopy of this letter and returning it to me.\nthe to be board\nUpon your acceptance we shall bo the\nbe bound by this agreement\nFORD A LIBRARY GERALD"
