Import quota limitations have been imposed on certain .21 22. dairy products, including dried milk, pursuant to the pro- .22 23. visions of Section 22 of the Agricultural Adjustment Act, .23 24 as amended (7 U.S.C. 624). Those limitations are set forth 24 25 in Part 3 of the Appendix to the Tariff Schedules of the 25 26. United States, which schedules are hereinafter referred to _26 27. 28. as TSUS, under items 950.01, 950.02, and 950,03, and relate _27 29. to products classified for tariff purposes under items 115.45, _28 115.50, 115.55, 115.60, and 118.05 of Schedule 1 of the TSUS. _29 30 30 31. The Secretary of Agriculture advised me that he had L31 32. 33. reason to believe that dried milk, containing not over 5.5 .32 percent butterfat by weight, mixed with other ingredients .33 34. (hereinafter referred to as .dried milk mixtures) and thus _34 35. classified for tariff purposes under items of the TSUS other .35 36 than the items referenced above, are being, or are practically _36 37. certain to be, imported under such conditions and in such .37 38. 39. quantities as to render or tend to render ineffective, or .38 40. materially interfere with, the price support program now .39 41. conducted by the Department of Agriculture for milk, or to _40 reduce substantially the amount of products processed in _41 42 the United States from domestic milk. _42 43. .43 44 45. The Secretary of Agriculture also recommended that there .44 be an increase in the monetary limitation in headnote 2(b) of _45 46. Part 3 of the Appendix to the TSUS, which makes the quota _46 47. restrictions provided for in Part 3 inapplicable to articles _47 48 49 (except cotton and cotton waste) with an aggregate value of _48 50. not over $10 in any shipment, if imported as samples for 149 51. taking orders, for the personal use of the importer, or for .50 research. L51 52. .52 53. The Secretary of Agriculture further determined and .53 54 _54 55. reported to me that a condition existed with respect to dried .55 56. milk mixtures which required emergency treatment and, as a .56 57. result, Presidential Proclamation No. 4423 of March 26, 1976, _57 58. was issued placing import restrictions upon certain dried .58 59. milk mixtures without awaiting the recommendations of the United States International Trade Commission, hereinafter -59 60 _60 61. referred to as the Commission, such restrictions to continue in effect pending the report and recommendations of the .61 62. 63. Commission and action thereon by the President. .62 .63 64 .64 65. Under the authority of said Section 22, I requested the Commission to make an investigation with respect to these .65 66 _66 67. matters. (a) The dried milk mixtures, upon which a limitation _8 9. is hereinafter imposed, are being imported or are practically _9 10. certain to be imported into the United States under such con- .10 11. ditions and in such quantities|as to render or tend to render _11 12 ineffective, or materially interfere with, the price support 12 13. program now conducted by the Department of Agriculture for milk, .13 14. or to reduce substantially the amount of products processed in .14 15. the United States from domestic milk; .15 16. .16 17. (b) for the purpose of the first proviso of Section 22(b) _17 18 of the Agricultural Adjustment Act, as amended, there is no 18 19. representative period for imports of the said dried milk .19 20. mixtures; .20 21. _21 22. (c) the imposition of the import limitation hereinafter _22 23. proclaimed is necessary in order that the entry, or withdrawal .23 24 from warehouse, for consumption of such driedamilk mixtures _24 25. will not render or tend to render ineffective or materially _25 26. interfere with, the price support program now conducted by .26 27. the Department pf Agriculture for milk, or reduce substantially _27 28. the amount of products processed in the United States from _28 29. domestic milk; and .29 30_ _30 31. (d) the monetary- limitation- in headnote 2(b) of Part 3 _31 32. of the Appendix to the TSUS, which makes the quota restrictions .32 33. provided for in Part 3 inapplicable to articles (except cotton _33 34. 35. and cotton waste) with an aggregate value of $10 in any ship- _34 ment, if imported as samples for taking orders, for the personal .35 36 use of the importer, or for research, should be increased to 36 37. $25 and that such increase will not result in imports which 37 38. will tend to render ineffective, or materially interfere with, .38 39. any price support program now conducted by the Department of _39 40. 41. Agriculture, or to reduce substantially the amount of any _40 product processed in the United States from any agricultural _41 42 43. commodity or product thereof with respect to any price support _42 program which is being undertaken. _43 44. .44 45. 46. NOW, THEREFORE, I, GERALD R. FORD, President of the 45 47 United States of America, by virtue of the authority vested 46 in me by Section 22 of the Agricultural Adjustment Act, as 47 48 amended, and Section 604 of the Trade Act of 1974 (88 Stat. 2073, _48 49. 19 U.S.C. 2483), do hereby proclaim as follows: _49 50. .50 51. 52. 1.
