Dear Mr. Prime Minister:
I very much appreciate your letter of March 30, with your
request that the United States withhold action imposing
countervailing duties on imports of beef from the European
Community. I agree that the circumstances are regrettable,
especially in view of the relatively small quantities of beef
involved, but the policy discretion available under our law
is limited and the Treasury Department has no choice but
to proceed with countervailing action.
Late in 1975, it became clear that under our Trade Act
countervailing duties would have to be imposed immediately
if beef which benefitted from restitution payments were
shipped to the United States in 1976. This was communicated
to officials of both the Irish Government and the European
Community on several occasions. It was also communicated
to domestic groups in the United States, and countervailing
duty action in 1975 was thereby forestalled. Early this year,
however, it was learned that a small amount of beef had been
exported again in 1976, and only with considerable difficulty
was the Treasury Department able to persuade the U.S.
domestic industry not to press for countervailing duties.
The Treasury Department has subsequently become aware
that substantially greater quantities of beef have in fact been
shipped, and it is no longer possible to avoid action.
With respect to your concern regarding beef quotas, it should
be pointed out that the United States has not imposed quotas
on imports of Irish beef. The four million pound figure to
which you refer represents a market estimate of likely imports

based on the total amount of beef received by the United
States thus far in 1976. Countervailing duty action, how-
ever, is likely to preclude further imports.
I hope you will understand that the Treasury Department's
decision to apply countervailing duties on beef from the
European Community has been taken as a result of firm
commitments, previously undertaken under our law and
communicated to all concerned parties, as to the manner
of dealing with continued restitution payments on meat
shipments.
I want to emphasize most strongly my hope that this should
not be interpreted in any way as a diminution of the resolve
I expressed during your most welcome visit to strengthen
even further the already excellent relations between the
United States and Ireland. I look forward to continuing
close consultations on all matters of concern to our
countries.

At Tab B is a letter to you from Prime Minister Cosgrave of Ireland
expressing concern over the imposition of countervailing duties on US
imports of Irish beef and the reduction of the 1976 Irish "quota
allocation."
At Tab A for your signature is a reply explaining that the United States
has made clear its intention to impose countervailing duties if beef
benefitting from government subsidies continued to be shipped to the
US in 1976. The response also makes clear that Ireland has no "quota
allocation" for beef and that the figure of 4 million pounds cited by
the Prime Minister represents an estimate of previously anticipated
imports. The letter emphasizes your hope that the action will not be
seen as a diminution of your resolve to strengthen even further the
excellent relations we have with Ireland.
State, Treasury and Seidman concur. The text has been cleared by
Bob Hartmann.

Letter from Irish Prime Minister on
Beef Imports
Prime Minister Cosgrave of Ireland has written the President
expressing his concern about the pending imposition of counter-
vailing duties on US imports of Irish beef.
At Tab I is a memorandum to the President recommending that he
sign the response at Tab A. The response notes that the Irish and
the EC have been fully informed that we would impose countervailing
duties if subsidized exports continued, and that the President has
little policy discretion in this matter.
Treasury will countervail once they have received a formal statement
from Customs, probably in about ten days.
State, Treasury, Seidman, and Hartmann concur.
Bob Hormats and Denis Clift concur.
RECOMMENDATION:
That you sign the memorandum to the President at Tab I.

I have been disturbed to learn that despite our
suspension of exports of beef for a period totalling two
months from 4th March, to provide for further discussions
between the EEC and the United States, a decision has been
taken to impose countervailing duties without further
negotiation and to publish this next Thursday.
We have also been very deeply concerned to be told by
another Embassy in Washington that our quota allocation
for the present year has been cut from eight million
pounds to four million pounds with a view to increasing
the allocations to Australia and New Zealand.
I should be grateful if you could arrange that no action
be taken on the countervailing duties pending further
discussions with the European Community and would also
welcome reassurance on the quota allocation situation.
You will appreciate my concern lest developments of this
kind, taking place so shortly after my successful - and
enjoyable - visit to your country, should affect the
excellent relations between Ireland and the United States
which I feel have been strengthened as a result of your
kind invitation to me to pay this official visit.

Dear Mr. Machonald,
I now enclose herewith full details of all shipments of
beef from Ireland to the United States during 1976.
Included are 6000 shipments made late in December 1975.
In fact these lists give details of all exports since
the middle of December, The total amount to 2,335,738
pounds.
An there obviously have been come misunderstandings in
the Administration in Washington about our boof exports,
I think it might be useful to avail myself of this
opportunity to record DOBO partinent points.
Your telephone call to do of February 26th, 1976, was
the first time any member of this Embassy discussed the
question of Irish beef exports with yourself or anybody
at the Treasury. There nother no oxchange whatseever written
or oral between tan prior co this date on this matter.
On February 26th you bold no that you had information that
500 tons of beef had been shipped this year and said you
would be glad to have confirmation of this. On Harch 1st
I received 4a message from our Department of Foreign Affairs,
Dublin, and relayed its contents to you on Narch 2nd by
telephone. The following is the procise wording:-
"Insofer as details of shipments are concerned
our Information is that shipments to the U.S.
for 1976 amount to 525 toma. We estimate that
all of this with the exception of approx. so tone
should have been Landed in the United States by
now."
I cannot of course state with certainty at this stage that
when conveying the above mossage to you T used the exact
words quoted. At that time it probably did not seen so
important. The emphasis was then on confirmation.
On the next day (Narch 3rd) T passed on to you the following
monsage exactly as received from Dublinr-
"Please inform United States authorities, both
State and Treasury, that -
1. We are now suspending exports of beef for
a month or so. There say be small quantities
at sea but we are checking up on that,

2. We are now looking into this whole question
(of our beef exports to the United States).
In the light of these undertakings we would hope that they
(United States authorities) would defer taking action with
regard to imposition of countervailing dubies. Grateful
if you could report United States reaction ASAP."
This vas a firm consitment whereas the figure of 525 tomos
received by us two days earlier was an estimate based on
details of shipments available at that time to our Department
of Agriculture officials. You will appreciate that there
must necessarily be a lag between the issuance of votorinary
certificates at local factory lowl and the receipt at
headquarters of copies of such certificates, It in understandable
if, because of the proximity of my messages of the 2nd and
3rd, they tended to become Hnlted am they did in your letter
to no of 4th March, However, our firm assurance was to
discontime shipments after March 4th. The final shipment as
you will see from the attached list was indeed on the 4th
Harch and this, as well as other recont shipments and shipments
made earlier for which returns to H.O. had not been made,
could not possibly have been included in the total sent to
us on March 1st. Vhen I received your letter I realised how
important it was to avoid any misumdorstandings and stressed
to our authorities in "ublin that an exact final figure
should be obtained at the earliest possible date. This vas
telexed to no on 12th March and immediately conveyed to
you. The figure was 1,113 tome. In fact that figure has
since been revised dowards as you can 800 and is nomewhat
less than 1,100 tom.
Copies of this letter and enclosures are being forwarded to
these listed below for the purpose of clarification also
in view of the misunderstandings surrousling this whole
matter.

Now that I have been home for a while I would like to confirm
the telegram I sent before leaving America. For Mrs. Cosgrave
and me - and indeed for the whole party - the visit was a magnificent
illustration of all that is best and most generous in American hospitality.
Its organisation demonstrated for every one of us the efficiency with
which you get things done.
I value highly the relationship we established in the White House on
17th March - and am particularly appreciative of the understanding
you and Dr. Kissinger showed on that day. I think that this
relationship was indeed reflected in a special way in the hospitality
which you and Mrs. Ford extended to us later in the evening and in
the presents which you so generously gave us. We will always value
these, not only for their intrinsic worth, but as reminders of a truly
memorable occasion.
You may be interested to know that on returning here I took steps to
ensure that our appreciation and an account of the matters dealt with
during our visit were placed on record in Dail Eireann. I think that
the reception in the House of my statement confirms my view that the
visit added a new dimension to relations between our two countries.
Mrs. Cosgrave and I look forward to meeting you and Mrs. Ford,
and your children, when you come to see us in Ireland and hope to be
able to reciprocate, in our own way, all the kindness you have shown us.
