point. It seems that the fee charged by him for acting as
agent is $20 in some cases and $10 in others. For this pure-
ly formal service $20 certainly appears too high a charge, and
the official offer or solicitation makes it smack of an ex-
action.
On this branch of the subject I think it rests with
the President or the Secretary of the Interior, 072 the Pre-
sident's direction, to determine whether, notwithstanding pre-
cedents, this practice of acting as corporation agent should
not cease or be restrained within stricter limits. No doubt
there are certain advantages in the custom to all parties, and
little or no objection exists if a small fee is charged and
scrupulous propriety and decorum in methods are observed.
In any case, on this aspect of the matter also, it seems to me
that Mr. Stoddard is to be cautioned or directed for the fu-
ture rather than seriously blamed for the past. I believe
that in all essential respects his record is clear. he seems
to have been at some disadvantage as a new official with his
office force, to have exercised personal care in the correction
of errors and doubtful action as soon as discovered, to have
been free from intention to offend, and to have consulted his
superiors and other proper guides before following the pre-
cedents in either matter involved.
I add for your personal notice my belief from docu-
mentary evidence that Akers has played worse than a doubtful
part in this business.
