use the franked envelope for his suggestions to corporations that he will act as agent if desired. On the propriety of his so acting, - it must be said that his letters offering his services (so far as shown to me) are couched in proper terms, that is, without the least sug- gestion of compulsion or advantage operating upon the addressee; that precedents in Arizona and elsewhere, and respectable le- gal advice given him, appear to justify his action, and that the Interior Department found no objection to his acting as agent for the service of legal process only, "when requested. The phrase of Stoddard's letters is "when desired.' It is to be observed, on the general aspects of the case, that Stoddard asserts earnestly that he has been scrupulously careful in the conduct of his office (he took charge in June, 1901), has re- duced official fees and charges, which, he says, were excessive and extortionate under the previous regime; that, in refer- ence to one of the letters leading to this inquiry, and as to other letters in his official correspondence, he was intention ally misled and misrepresented by adherents of his predecessor whom he temporarily employed; and that he has carefully cor- rected the statements and implications of such letters to cor- poration correspondents. He showed evidence on these points from his official letter-press book. He states that the law requires the Secretary of the Territory to be the agent of certain corporations for service of process or other formal purposes; as to other corporations the law is permissive or silent. I have no reason to doubt his statement on this (2)
