1903
This contract was afterwards submitted to the Secretary of the
Interior for approval. The Eastern Cherokees protested against
it showing that Chief Buffington was forbidden by the Cherokee
law to involve the Nation in a law suit or contract except when
expressly authorized by the National Council, also showing that
the authority to bring suit in this particular case or to contract
with ett torneys in relation thereto had been refused by the Nation-
al Council. We showed moreover that Chief Buffington had in April,
hearing
1901, made a contract in this very case after President McKinley
had disapproved an Act proposing to give the Chief such authority.
n Upon your request given General M. .C. Butler in December last

the Secretary of the Interior permitted us to present to him our
the
protest against the Springer contract and he declined to approve
the Springer contract. At that hearing, on or about December the
18th. 1902, we advised the Secretary of the Interior that the House
of Representatives had requested an opinion of the Department of
our
Justice and that we would argue the law of the case in that De-
tionl
Couneil
partment .
We are informed and believethe Secretary suggested to the Attor-
ney General that an answer to the House Resolution was inexpedient
because the case should be sent to the Courts.
Your request of the Attorney General for an opinion and a precis
of the case, with the suggestion that you desired exact justice
should be done our people, was of vital importance to our rights.
