DEPARTMENT OF THE INTERIOR, wASHINGTON. September 16, 1902. The President, Oyster Bay, N. Y. Sir: I, yesterday, received the telegram of Assistant Secretary Loeb, Jr., expressing your desire to be advised, at the earliest opportunity, whether action can be taken, as suggested in the following quoted telegram from Senator Kearns: "Kindly have Secretary Interior send Indian Agent McLaughlin to Utah Reservation, to negotiate for opening reservation under terms of act of Congress, before payment is made, as serious ob- stacles will arise if payment is made before terms agreed to by. Indians. McLaughlin thoroughly understands situation. Program of Secretary of Interior is one which will cause great delay, re- sulting in serious immediate injury to us. Hope negotiations with Indians will begin without delay.' and immediately replied - "Kindly inform the President that a report in reply to Senator Kearns' telegram will be forwarded to him tomorrow." The payment referred to by Senator Kearns is one pro- vided for by Act of Congress approved May 27, 1902, in settlement of the claims of the Uintah and White River Utes for allotments on the Uintah Reservation to Uncompaghre Indians, and for which the latter had paid the Government ($60,064.48) and for money ($10,000) claimed by them for a small part of their reservation,
