DAWSON SUBJECT: COMMISSION'S PROCEDURES IN HANDLING REPORTS OF ARRESTS OF FEDERAL EMPLOYEES FOR SEX OFFENSES Briefly, the Commission's policy for handling the reports of arrests employees in the Executive branch of the government for sex offenses is as follows: employing ARCHIVES 'NATIONAL RECORDS TROMAN AND LIBRARY 1. In each case we send a copy of the report of arrest to the agency. 2. In cases where the Commission has jurisdiction, we take action to investigate, if necessary, and to decide these cases promptly. 3. In cases where the agencies have jurisdiction, we request the agency to notify the Commission as to the personnel action taken in the case. More specifically with reference to the various lists which the Commission has received recently, the following action has been taken on each list of arrests or groups of arrest record reports. On March 24, 1950, the Commission received from the State Department a list containing the names of 91 persons indicating that the individuals named had been separated from the State Department because of alleged sex deviation. Promptly upon receipt of that list, the Commission checked its service records to determine the identity of any of those persons then in Federal service as well as to identify the agency and the position in which employed. That search of our records revealed that 14 of the 91 persons were employed in the Executive branch. Of the 14 shown to be employed, 9 still were within Commission jurisdiction and 5 were within the jurisdiction of the employing agency. Of the 9 still under Commission jurisdiction, one has since resigned, letters requesting separation have been sent to the agencies in the cases of 6 and the 2 remaining are under investigation. Of the 5 under jurisdiction of the agencies, the Commission has received information informally that one has resigned. Reports have not been received from the agencies in the other 4 cases. The search of our records indicated that no information had been received by the Commission from the State Department or elsewhere indicating derogatory information in the cases of any of the 14 persons prior to the Commission's receipt of the list of 91 names from the State Department. The names of these 91 persons have been flagged in the Commission's Master Index in order that they may be identified if they seek re-entry into the Federal service. The Commission has since reminded agencies of its requirement that they report actual reasons for resignation in instances where employees are permitted to resign while under investigation or while charges are pending.
