4910 - Loyalty and Security Program
4911 - Introduction
4911.1 - Purpose
.01 This order, which supergedes the Secretary of
Defense's order entitled "Adjudication of Loyalty Cases",
establishes a Loyalty-Security Board and prescribes procedures
for the disposition of all loyalty and security risk cages in-
volving civilian employees of the Department of Defense, ex-
cluding employees of the Departments of the Army, Navy and Air
Force. The regulations and directives duly promulgated by and
under the authority of the Loyalty Review Board in accord with
the provisions of Executive Order 9835, as set forth in Title
5, Chapter II, of the Code of Federal Regulations, constitute
the basic and controlling regulations to govern all loyalty
adjudication procedures in the units of organization to which
this order is applicable. The statement of procedures shown
hereinafter as applicable to the adjudication of loyalty cases
is therefore promulgated in accordance therewith. The state-
ment of procedures shown hereinafter as applicable to security
risk cases is promulgated under the provisions of Section 3 of
the Act of December 17, 1942, 56 Stat. 1053, which authorizes
immediate removal of any civilian employee when such action is
warranted by the demands of national security.
4911.2 - Jurisdiction
.01 For the purpose of the Federal Employees Loyalty Pro-
gram, employees and applicants for Federal positions are divided
into two groups, namely:
Group 1: Those employees who were on duty in the Federal
service on September 30, 1947, and who have remained con-
tinuously in service since that time without receiving a
new appointment in the competitive service by conversion,
transfer, reappointment, or reinstatement; those employees
who enter on duty in the Federal service in excepted posi-
tions subsequent to September 30, 1947; and persons who
are applicants for positions excepted from the competitive
service.
