580130 - DRIVEWAY AGREEMENT an WHEREAS, by instrument dated August 9th 1943, and recorded in the y office of the Recorder of Deeds of Jackson County, Missour i, at Indep- endence in Book 701, Page 616, J. D. Noland and Jennie Noland, husband and wife, and Harold E. Alexander and Gertrude B. Alexander, husband and wife, being then the owners of the properties hereinafter described, did create and establish an easement for a joint driveway for the use and benefit of themselves and the subsequent owners pf said properties, all as fully set out in said instrument, and WHEREAS, the undersigned Lawrence E. Floyd and Vivian V. Floyd, husband and wife, herein referred to as first parties, are the presen t owners of the South half of Lot 21, Block 2, in EVANSTON PARK, a subdivision in Jackson County, Missouri, and are also the owners of the East 173 feet of Lot 20 lying Northwesterly of the Northwesterly line of the right of way of U. S. Highway No. 24, in Block 2 of said herein referred to as second parties EVANSTON PARK; and Roland E. Smith and Ada D. Smith, husband and wite, are the present owners of the West 120 feet of Lot 20 except that they part thereof in Arlington Avenue, in Block 2, of said EVANSTON PARK, and the said first and second parties being now the owners of all of the property in any manner affected by, or benefited by, the easement created as aforesaid desire to change the mutual easements so created and established and to establish certain other rights in the driveways now existing on said properties, and to that end the said first and second parties do hereby cancel, void and annul the easements and rights created in the aforesaid instrument recorded in Book 701, Page 616. State NOW, THEREFORE the said parties of the first part hereby grant unto the said second parties an easement for ingress and egress over and the present established driveway running from the West line of the persona acknowledged South half of Lot 21, Block 2 of said EVANSTON PARK in a Southeasterly direction on a curve to the North line of said Lot 20; and also a like easement on the present established driveway running in a Northwesterly and Westerly direction from the Northwesterly line of U. S. Highway No. 24 to the West line, at a point near the North line, of that part of Lot 20 aforesaid now owned by first parties. And the said second parties do hereby grant to first parties
