redone with corrections - handed to Kup hley Pow Sport the French on 9/19/52 unp 6112NS the 11 Return is #3262 The Department of State refers to the French Embassy's note No. 402 of July 16, 1952 enclosing a memorandum submitted by the Legal Adviser of the Ministry of Foreign Affairs concerning certain legal aspects of the problem of prisoners of war in Korea. The Embassy requests the Department's views on these matters. At the beginning of the conflict in Korea the United States indicated to the International Committee of the Red Cross that without regard to their legal applicability in the Korean conflict the humanitarian principles of the Geneva Conventions of 1949, particularly Article 3 thereof, would be applied by the United States. The United Nations Command in Korea has from the beginning applied the Geneva Convention of 1949 on Prisoners of War, although the United States has not yet ratified the Convention.
