My dear Mr. Secretary:
Executive Orders No. 9547 and No. 9660 provide for representa-
tion of the United States in preparing and prosecuting charges of
atrocities and war crimes against the leaders of the European Axis

Powers and the major leaders of Japan. It was contemplated, when
these orders were issued, that the cost of the trials would be borne,
within the limits of funds available, by the participating agencies.
I now find that sufficient funds are not available to certain
of the participating agencies for this work for the last half of
Fiscal Year 1946. It is my desire, therefore, that the War Depart-
ment assume the entire responsibility for financing this program,

beginning January 1, 1946, from funds available in its current appro-
priations. When personnel or services are provided by another depart-
ment, the War Department should make reimbursements for these costs.
To avoid the possibility of supplementation of appropriations of
other agencies through such reimbursements, it is requested that

you advise the Director of the Bureau of the Budget quarterly of
any reimbursements made in accordance with these instructions.
