MEMORANDUM FOR THE PRESIDENT
In connection with our talks on reorganization,
it has dawned on me that I have overlooked a point
of great importance in considering these proposed
reorganization plans in relation to the Congress.
Here the Congress must take positive action
to defeat reorganization plans. In turn, they
become law by virtue of inaction on the part of
the Congress, quite in contrast to the situation
where the President suggests legislation and the
Congress defeats it by failure to act.
As I have been mulling over this situation in
relation to the 1939 experience I feel that this
is a very important point. In short, you are likely
to come through with nearly 100 per cent success
even with a recalcitrant Congress.
