S 6 OF Office of General RECORDS * * * DEC 1 2 1946 MEMORANDUM FOR THE PRESIDENT This refers to your inquiry whether it is possible to permit foreign vessels to carry passengers or merchandise from ports in the continental United States to Alaska and, if so, whether such vessels may charge the same rates as vessels documented under the laws of the United States: By the Act of June 19, 1886, as amended (46 U.S.C. 289), and the Act of June 5, 1920, as amended (46 U.S.C. 883), foreign vessels were prohibited from transporting passengers or merchandise between ports or places within the United States including districts, terri- tories and possessions thereof. Title V of the Second War Powers Act (50 U.S.C. App. 635) per- mits the waiver of compliance with the navigation and vessel inspection laws of the United States if the head of the Government department or agency (Treasury) charged with the responsibility of administering the law deems that such action is necessary "in the conduct of the war." During the actual shooting war this provision was used to effect waivers of the above-mentioned statutory prohibi- tions. One such waiver is at present outstanding (Treasury Decision 51540, dated September 30, 1946) It permits the transportation of
