On June 14 the Soviets presented their counter
proposal for the modus vivendi:
"In order to promote further the aims set
forth in the preceding paragraphs and in order
to improve and supplement the agreement as regards
the communications between the Eastern Zone and
the Western Zones and between the Zones and Berlin
as well as regards the transit (sic], the Occupa-
tion Authorities, each in its Zone, will take
measures for ensuring the norma function of rail,
water and road transport and that of the postal,
telephone, and telegraph communications."1
The Soviet counter-propogal was much less specific than
the tripartite proposal. 2 It contained no reference to
"access to and from Berlin". It did not refer to present
agreements on the subject or call for the negotiation of
new agreements, but stipulated only that the occupation
authorities in each zone would take action to ensure the
normal functioning of transport and communications
generally. It made no mention of the two "principles" in
the tripartite proposal and did not provide for any sort
of Western control over the Autobahn.
These and other points were discussed when the CFM
considered the Soviet counter-proposal. During the CFM
discussions, the Western Powers made a particular effort
to extract from Mr. Vyshinsky some sort of commitment
that the blockade would not be reimposed. That these
efforts were unsuccessful 1s revealed in the following
extract from the minutes:
"MR. ACHESON
said that his difficulty
with the Soviet redraft of paragraph 5 was that 1t
appeared to leave to each occupying authority to
take the measures to ensure normal functioning of
the subjects mentioned and that it would be up to
each of them to do what they saw fit. Furthermore,
he said that in his view it was quite possible for
railways, roads, water, etc. to function normally
and still not ensure the movement of persons and
goods; that functioning was one thing and the use
made of the facilities was another. (Mr. Vyshinsky
had difficulty in understanding this point in some
measure because of the fact that the word "functioning"
