Supreme Unurt of the United States Mashington, D.C. CHAMBERS OF THE CHIEF JUSTICE November 19, 1946 My dear Mr. President: I have your letter of November 9th, relative to Secretary Patterson's request that Federal Judges be made available for service on the War Crimes Tribunal. I prepared a lengthy letter to Secretary Patterson, setting forth the situation of the courts and the need for the services of every Judge in the country to cope with the increased workload, particularly the many cases that must be tried by jury. I told the Secretary last Saturday night that the letter would be forth- coming. He indicated that there was no necessity of my going to great length in regard to my views on the subject, and that if it was my considered judgment it should not be done, all he needed was for me to say "No". I have written him a note to that effect. I would be happy to send you a memorandum, if you so desire, giving the many reasons why I do not think this should be done. You will recall that I mentioned some of the factors the last time I saw you but, of course, did not spell it out. I shall be glad to do this for you if you feel there is any need for it.
