Actually it defined with considerable accuracy the working arrangements which would govem the exercise of authority by the High Commissioner for Germany. 1 It did not, however, give the position statutory existence nor did it constitute a directive for the incumbent. It recognized that other agreements and directives were necessary and that these would constitute, in part, the end products of the planning which this letter should initiate. and what The Legal Working Group of CPG SERVICE In its initial organization the Committee on Planning for Ger- many, CPG, provided for a Legal Working Group. The assignments to the Group included the drafting of an Executive Order establish- ing and :defining the position of High Commissioner, appointment papers for John J. McCloy, an Executive Order appointing McCloy as ECA trepresentative in Germany, and an administrative directivé. It was to concern itself also with any over-all policy or ad- ministrative directives which ECA might issue for McCloy, with the policy directive which the Office of German Affairs was pre- paring, and with the directive to the Commander-in-Chief in Europe, drafted by. the Army 2 The Group was originally made up of J. M. Raymond for the State Department, Lt. Col. R. K. Smathers for the army, and Norman Paul for ECA: John Furman was later acted to the State Department reprosentation.³ Executive Order 10062 In drafting the Executive Order establishing the position of United States High Commissioner 'for Germany, the Legal Norking Group of CPG worked closely with LicCloy, Byrbade, and offici ls of the Bureau of the Budget. By the first of June an acceptable draft was ready, and Executive Order 10062 was signed by the President on June 6, 1949. Besidos citing his authority to create such a position and declaring it created, the President gave the force of law with little change to some of those basic principles which the Secretaries of Army and State and the Chief of ECA had agreed upon by an exchange of letters.
