1. The date of transfer can not now be fixed precisely, but will be determined by the President. It is expected to be on or about the date of establishment of the provisional government for Western Germany. 2. The President will issue an Executive Order which, among other matters pertinent to the transfer from the Army to the State Department of the direction of U.S. Governmental operations in Germany, would pro- vide in substance as follows: a. There shall be established a post of U.S. High Commissioner for Germnny and Mr. John J. McCloy will be designated by the President, by and with the advice and c onsent of the Senate, to fill this post. b. The U.S. High Commissioner shall be the supreme U.S. authority in Germeny and acting, subject to consulta- tion with and ultimate dircction by the President, under the immedicte supervision and direction of the Secretary of State, shall have the authority to exer- cise all the Covernmental functi. ons of the U.S. in Germany, other than the command of troops, shall represent the United States on the Allied High Com- mission for Germony, and oll exercise the appro- priate functions of a Chief of Mission, Class One, within the meaning of the nct of August 13, 1946 (60 Stat. 999). C. Mr. McCloy, under adninistrative arrangements which the President, acting under Par. 109d, Economic MATIONAL Cooperation Act of 1948, Public Law 472, as amended, ARCHIVEER had determined to be appropriate, subject to consulta- SERVICE tion with and ultimate direction by the President, under the immediate supervision and direction of the Administrator for Econ omic Cooperation and the coor- dination of the U.S. Special Representative in Europe, shall be their representative in all their relations and actions with respect to Germany. Mr. McCloy will be assisted by a Chief of Special Mission : to be appointed by the Administrator, who shall be accep- table to him. The Chief of Special Mission shall have the rank of Minister and act under immediate supervision and direction of Mr. McCloy. CONF IDENZ TAL
