the question of their desire to become members
of the german Government would be passed upon,
and at which they would also elect prospective
members of the Legislature who would represent
them if the vote proved to be in favor of joining
the federal state. This would be a novel and
perhaps you might characterize 1t "cockeyed"
expedient. We would appreciate any suggestions
which you might make to resolve these procectural
but very practical difficulties.
You will note that the foregoing proposal does not
deal, except very generally, with the question of troops
in germany, which is now being considered by the joint Chiefs
of staff. This question, of course, is fundamental and at
a meeting this morning your views received most careful
consideration and were evidently given great weight.

In your cable you make a specific reference to Paragraph
2 of the state Department Draft and indicate that it is
satisfactory except for the requirement for holding land and
local elections. We would like to verify that your statement
is made on the basis, first, that it will be provided in oux
plans for the CFM that we should proceed with the timetable
in the Western Laender as agreed upon at Frankfurt for approval,
ratification and elections unless at some time in the course
of CFM conference Russia agrees to the inclusion of the
Eastern Laender in the government to be set up under the
Bonn constitution; and, second, that if that agreement is
reached, we will still proceed with ratification in the
western Laender and proclamation of the occupation statute
for the western Laender with the general elections alone,
but nothing else, being deferred with the consent of the
Ministers President of the western Laender until after the
Eastern Laender had indicated their desire to be included
in the new federal state and at that time the occupation
statute and Trizonal Agreement would be revised to include
Russian participation.
Please let us have your thoughts by cable saturday or
by telecon at your convenience late saturday afternoon your time.
