agreement respecting the terms of our assent and therefore the French
application was not actually submitted to the Court. The new law has
presented the question whether it is dipossible, if the U.S. position
on the status and interpretation of the treaties is correct, to continue
United States assent on the terms previously agreed upon. The French
Government therefore again proposed that the entire matter be submitted
to the International Court of Justice in order to determine just what
treaty rights exist and whether or not there is compliance. The application
to the Court was filed by the Frenoh Government yesterday. The United States
is committed to submit to the compulsory jurisdiction of the Court in cases
of this type, and it is recognized that this is essentially an appropriate
and democratic way of resolving the di spute. Accordingly, it is felt that
a Court decision will provide the best means of establishing the rights of
the interested parties. The French Government has agreed that during the
pendency of the case before the Court, the present position of Americans
in Moroceo will not be adversely affected as a result of this action.
In view of the submission of these questions to the International
Court of Justice, the President will not make any determination, under
the amendment, as to compliance or non-compliance with the treaties while
the questions are pending before the Court.
