- 2 - (10) Judge Joseph C. Hutcheson of the Fifth Circuit Court at Houston Texas, who is regarded as one of the outstanding members of the bench in that area. He should not be asked to serve if Mr. Simmons, also of Houston, accepts. (11) 0. Max Gardner, former Governor of North Carolina, now practicing law in Washington, where he is well known. (12) William Thomas Laprade, Professor of History at Duke University and former President of the American Association of University Professors. He has written extensively on historical subjects. Bevin urges that each Government appoint seven members and that the Commission work through sub-committees. I have urged that each Government appoint five members. Bevin is to advise me of his appointments. If he names members of Parliament it may require that we name two members of the Congress. We would have to select men who have not committed themselves with reference to the subject matter; otherwise we would destroy the impartial character of the Commission. Because it is agreed that the Commission should be impartial it may be that we could justify appointing no man from the Congress when we know that they have been called upon in campaigns to make pledges on this subject. It really is not a friendly service to a Senator of Congressman to appoint him to this Commission. It may embarrass him.
