THE TERMS OF REFERENCE AND AGENDA OF THE
COUNCIL OF FOREIGN MINISTERS
Ao Terms of Reference
The section of the Protocol of the Berlin (Potsdam)
Conference providing for the establishment of the Council
of Foreign Ministers (Section I A) begins with a covering
sentence indicating that agreement had been reached to set
up a CFM "to do the necessary preparatory work for the peace
settlements". The exact text of the agreement on this
subject is then set forth in the subsequent eight sub-
paragraphs which are set off in quotation marks in the
published version of the Protocol. Among these
sub-
paragraphs is no (3) (111) which says that "Other matters
may from time to time be referred to the Council by agree
ment between the Member Governments."
The question arises as to whether these "other matters"
referred to in paragraph (3) (111) are subject to the general
limitation apparently imposed on the CFM by the covering
sentence. In other words, must the "other matters" be
related to the "preparatory work for the peace settlements"?
From a study of the Potsdam minutes it appears that
this question must be answered in the negative. The covering
sentence was not a part of the actual text approved by the
Foreign Ministers and the Heads of Government and this fact
is accurately reflected in the use of the quotation marks
in the published version of the Protocol. The covering
sentence was apparently added at the last minute by the
drafting committee which organized the agreements into a
coherent Protocol.
From the discussions at Potsdan of the scope of CFM
activities by the Foreign Ministers and by the Heads of
Government it appears that there was general agreement that
the CFM should first address itself to the preparation of
peace settlements, but It is also clear that the reference
to "other
