CONFIDENTIAL -2- The present situation of these pastors, however, was not as bad as we had expected to find. Spoken to collec- tively, they recounted incidents of persecution such as imprisonment, fines, official interference with acts of worship and difficulties regarding, especially, marriages and burials of Protestants and the education of their children. Spoken to individually and specifically queried, it became apparent that the worst of their experiences occurred some years ago and that during the past two years they have not suffered what may be termed a uniform pattern of persecution. What they do suffer from is the uncer- tainty of their position arising from the fact that their legal status under Article VI of the Fuero de los Espagnoles (Spanish Charter) is not clearly defined and uniformly im- plemented. Their situations vary from community to commun- ity, depending on the attitudes of the local mayors and Civil Governors, on the size of the community and on the degree of the domination by or devotion to the Catholic hierarchy of these officials. All the pastors agreed that the Catholic hierarchy and the influence it wielded on local civil authorities to restrict Protestant activities was the real root of their troubles. Consequently, although this group of Protestants is not being strongly persecuted at present, its position in each community is only one of precarious toleration, but not of true tolerance. This toleration is usually extended extra-legally by the local authorities on the basis of personal arrangements by the pastors and can be restricted or withdrawn at any time -- as, for example, when a local Catholic priest or bishop remonstrates to a Mayor that Protestant funeral services at the grave are a "public manifestation" of a non-Catholic religion and therefore must, by law, be discontinued. The minimum desire of these Baptist pastors is that Article VI of the Fuero de los Espagnoles be clearly defined and implemented and that the religious tolerance guaranteed therein be locally protected and also enforced by the Madrid authorities, notwithstanding Catholic protests and interpretations, As it now stands, toleration, if not tolerance, is locally achieved in varying degrees, but instances of local intolerance and even persecution, when protested to Madrid, receive no redress from the central authorities.
