In the Dumbarton Oaks draft there has been adopted also,
voluntarily it would appear, the flexible instead of the
rigid type of instrument and many of the concepts are
subject to subsequent interpretation and very broad vari-
ations of application. The me uhed has advantages, because
it permits of adaptation to different situations, but it
also has the objection of not clarifying the scope of
some of the most important rights and obligations of the
members, which are thus loft to the intorprotation,
possibly arbitrary, which may be givon them by the agencies
chargod with applying the Statute.
One must call attention with satisfaction to the
amplitude and importance which the draft gives to economic
and social ideas in the lifo of the insticution that is
to be croated, attributing their application to a body
independent of the Socurity Council and the Secretariat
General and dependent only on the Assembly. This would
assure effoctive work in this matter. Novortheless, it
is obsorved that nothing is soid in the draft concerning
the Labor Organization, a matter which is the subject of
study in these romarks. It is notod, likowise, that the
draft does not mention certain questions whose decision
was attributed to tho Goneva institution or connected
institutions, or considered as essentiel by a largo share
of world opinion. Such is the case, for example, with the
very notable questions of the mandates, of the protection
of dependent countrios, or intellectual, sanitary, financial
and monetary cooperation, of the narcotic drugs traffic,
of the white slave trnde. Some of these topics could,
strictly speaking, be considered as included in the general
enunciation of principles if these were broadly applied;
but it would be desiroble that at least the jurisdiction of
the general organization on such subject matters bo
enunciated, in order to be able to continue to carry on
with groater vigor the focund labor accomplished at Geneva.
