    "ocrText": "PASE\nI also wish to point out that the Congress has established, by\ngeneral law, procedures under which cases such as the present may be\nadjusted in ways both equitable and practical. These procedures afford\nroom for accommodating to each other the legitimate aspiration of Mr. Peon\nto have the fullest possible measure of freedom in managing his business\naffairs, and the equally legitimate aspiration of the Flathead Tribe to\npreserve its ancestral home lands as a source of livelihood for its members.\nUnder existing statutes applicable to the Flathead Reservation, the Secre-\ntary of the Interior would have authority upon application by Mr. Peon, to\noffer his allotment for sale, at not less than its appraised value, to the\nFlathead Tribe or to any of the members thereof, whichever may be the\nhigher bidder. If such efforts did not result in a sale at a fair price\nbeing consummated within a reasonable time, I believe the Secretary of the\nInterior would be justified in concluding that adequate recognition had\nbeen given the interests of the Tribe and its members. An application\nby Mr. Peon for termination of the trust and the issuance of a patent in\nfee could then be considered favorable, if 'supported by an adequate showing\nof Mr. Peon's qualifications. Such a procedure would not entail the\ndisregard of Indian interests, and of Federal responsibilities for their\nprotection, that is inherent in the present bill, however vell-intentioned.\nFor these reasons, I am constrained to withhold my approval from\nS. 403.\ndito\nat\nHARRY S.
