EXECUTIVE ORDER to 9661 POSSESSION, CONTROL, AND OPERATION OF THE TRANSPORTATION SYSTEM, PLANTS, AND FACILITIES OF THE GREAT Li KES TOWING company, CLEVELAND, OHIO WHEREAS after investigation I find and proclaim that as a result of a labor dispute there are interruptions of the operations of the trans portation system, plants, and facilities of The Great Lakes Towing Company located and operated upon the Groat Lakes and tributary W aters; that the war effort will be unduly impeded and delayed by such interrup- tions; that it has become necessary to take possession and assume control of the said transportation system, plants, and facilities for purposes that are needful or désirable in connection with the present wartime emorgency: and that the exercise, as hereinafter specified, of the powers vested in me is necessary to insure in the national interest the operation of the said transportation system, plants, and facilities: NARA NOW, THEREFORE, by virtuo of the powor and authority vested in me by the Constitution and laws of the United States, including section 9 of the Selectivo Training and Servico Act of 1940 as amonded by section 3 of the War Labor Disputes Act, tho Act of August 29, 1916, 39 Stat. 645, and thoFirst War Powors Act, 1941, as ident of the United States and Commander in Chiof of the Army and Navy, it is hereby ordered as follows: 1. Tho Director of the Office of Defense Transportation is authorized and directed, through or with tho aid of any public officors, Fedoral agoncies, or other govornment instrumontalities that ho may designate, to tako possession and assumo control of tho said trans portation systom, plants, and facilitics ownod or operated by Tho Groat Lakos Towing Company, including all real and personal property and other assets usod or useful in connection with the oporation of such t rans portation systom, plants, and facilities, and to operate or to arrange for tho operation of tho said transportation system, plants and facilities in such a manner as he may cem nocessary to carry out tho provisions, and accomplish the purposes of this order. 2. Subject to applicable provisions of existing law, including tho ordors of tho Offico of Defonso Transportation issuod pursuant to Executivo Order 8989, as amondod, tho said transportation system, plants, and facilitics shall be managed and oporatod undor the torms and conditions of employment in offect at tho timo possession is takon under this order. 3. Except with the prior written consent of tho Director, no attachment by mesne process, garnishmont, oxccution, or otherwiso shall bo lovied on or against any of tho roal or personal proporty or othor assots, tangiblo or intangiblo, in the possossion of the Diroctor horoundor. 4. Possession, control, and oporation of any plant or facility, or of the transportation systom, or any part thoroof, or any roal or porsonal proporty, takon undor this order shall be terminated by the Diroctor whon ho dotorminos that such possossion, control, and oporation are no longor nocos- sary to carry out tho provisions, and accomplish tho purposes of this order.
